MDH Letter Wellhead Protection Plan Amendment 2012-09-19Protecting, nzaintaiziing and impz oviizg the health ofall Minnesotans September 19, 2012 Mr. Harry Taylor, Public Works Supervisor City of Cottage Grove 8635 West Point Douglas Road South Cottage Grove, Minnesota 55016 Dear Mr. Taylor: Re: Wellhead Protection (WHP) Plan Amendment According to our records, the city of Cottage Grove is currently implementing a WHP plan, which was approved on November 29, 2005, and is in effect until November 29, 2015. The WHP rule (Minnesota Rules, part 4720.5570, subpart 3) requires a public water supplier to begin the process of reviewing and amending a WHP plan eight years after the date of the last approval of a plan by the Minnesota Department of Health (MDH), As we discussed, the city of Cottage Grove has agreed to start amending their WHP plan early by starting on November 29, 2012, and submitting it to MDH by August 31, 2015. Submittal by this date allows adequate time for review by MDH and other state agencies as required by the state WHP rule. Also, the WHP rude (Minnesota Rules, part 4720.5270, subpart 4, items A and B) requires that a WHP plan be evaluated every two and a half years or less after a plan has been approved by our department and when a WHP plan is amended. At the Seeping I meeting for the amendment with MDH staff, the city of Cottage Grove will be required (Minnesota Rules, part 4720.5270, subpart 5) to submit an evaluation. I have enclosed a template which the city may use in conducting this evaluation. Failure to comply with these rule requirements may result in a Notice of Violation.
