Our research indicates that the southwest portion of the Site has been used for agricultural purposes since at least 1936.A gravel mine was located on Parcels 4 and 5 from at least the 1940 through the 1970s. At the time of the reconnaissance,the Site consisted of five parcels totaling approximately 151.63 acres. The Site consisted of cultivated agricultural land and vacant grass covered and partly wooded land with lowland areas,a holding pond, and a stormwater pond. This assessment identified no recognized environmental conditions in connection with the Site. This assessment identified no controlled recognized environmental conditions in connection with the Site. Additional Considerations An additional consideration is a condition that does not meet the definition of a recognized environmental condition,controlled recognized environmental condition,or historical recognized environmental condition but, in our opinion,should be brought to the attention of the User. The following additional considerations were identified during the Phase I ESA. Areas of Parcel 4 and 5 of the Site were formerly an aggregate mine pit. Mine pits present convenient locations for dumping unwanted soils and other materials. Backfilling mine pits with demolition debris, fly ash, and contaminated soils was a common practice in the past. Although we revealed no information that confirms or indicates placement of any backfill, based on experience,the potential exists that buried backfill materials are present at the Site.Although less likely,there is nevertheless a potential that buried materials may include contaminated soils and or materials that could require management as solid or hazardous waste. If fill soils(which could include demolition debris and other wastes) are encountered during a future redevelopment,additional evaluation of the fill soils might be required for management and disposal purposes. Purpose IBraun Intertec Corporation received authorization from Mr. Ryan Schroeder of City of Cottage Grove (Client)to conduct a Phase I Environmental Site Assessment(ESA)on five parcels of Glen Grove Industrial I Park located south of 95th Street South, North of 100th Street South and West of Jamaica Avenue in Cottage Grove, Minnesota (Site).The objective of the Phase I ESA was to evaluate the Site for indications of recognized environmental conditions and to assist in satisfying All Appropriate Inquiries (AAI) Istandards and practices.The Phase I ESA was conducted in general conformance with the scope and limitations of American Society for Testing and Materials(ASTM) Practice E1527-13 and 40 CFR Part 312. INo intentional deviations from the ASTM Practice E1527-13 were made in conducting this Phase I ESA for the Site.The Phase I ESA was prepared on behalf of, and for the use by City of Cottage Grove(User) in I accordance with the contract between City of Cottage Grove and Braun Intertec, including the Braun Intertec General Conditions. No other party has a right to rely on the contents of the Phase I ESA without written authorization by Braun Intertec.All authorized parties are entitled to rely on the attached report Iaccording to our contract with Client,and under the same terms,conditions and circumstances. Please note that our contract with Client may contain a limitation of our total liability. If so, such limitation also Iapplies to all those receiving this permission. According to the User,the Phase I ESA was conducted in association with the purchase of four parcels Iand the sale of one parcel of the Site. I The purpose of this Phase I ESA was to evaluate the Site for indications of"recognized environmental conditions."A recognized environmental condition is defined by ASTM Practice E1527-13 as: "the I presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: 1)due to any release to the environment, 2) under conditions indicative of a release to the environment: or 3) under conditions that pose a material threat of a future release to the environment. De minimis Iconditions are not recognized environmental conditions." I . Conducting a reconnaissance and environmental review of the Site, including observations of the Site for indications of hazardous materials, petroleum products, polychlorinated biphenyls (PCBs),wells,storage tanks,solid waste disposal, pits and sumps, and utilities. • r Conducting an area reconnaissance, including a brief review of adjoining property uses and ' pertinent environmental information noted in the Site vicinity. • Interviewing current owners and/or occupants of the Site and accessible past Site owners, operators and/or occupants. 1 • Interviewing local government officials or agencies having jurisdiction over hazardous waste disposal or other environmental matters in the area of the Site. • Reviewing previous environmental reports prepared for the Site, if provided. • Preparing a written report of our methods, results, and conclusions. The Standard Scope of the ASTM Practice E1527-13 is not intended to provide a universal analysis of potential environmental risks and hazards.This assessment included no analysis of non-standard scope environmental risks and hazards unless otherwise listed above.Analysis of other non-standard scope issues by Braun Intertec would require additional contractual arrangements. This assessment does not include vapor encroachment screening as defined in ASTM Practice E2600-10, Standard Guide for Vapor Encroachment Screening on Property Involved in Real Estate Transactions. ASTM Practice E2600-10 is not a requirement or component of"all appropriate inquiry," but a tool for evaluating vapor migration. Its results are not determinative of whether hazardous substances from a release are or may be present at the property for the sake of"all appropriate inquiry" or ASTM Practice E1527-13.An ASTM Practice E2600-10 vapor encroachment screen is not within the scope of this Phase I BRAUN INTERTEC ICity of Cottage Grove Project 814-06209 I September 4, 2014 Page 4 IESA and will not be conducted unless specifically requested by the User. However,vapors present or likely present from hazardous substances or petroleum products are considered no differently than I hazardous substances or petroleum products present or likely present as a result of a release to the environment. Therefore,while a vapor encroachment screening per the ASTM Practice E2600-10 standard is not part of this assessment,the potential for impacts to the property from vapor migration Ithat is a result of a release of hazardous substances and/or petroleum products to the environment will be considered when assessing for the presence of a recognized environmental condition as defined by IASTM E1527-13. A.4. User-Provided Information The purpose of this section is to describe tasks to be performed by the "User."The "User" as defined by iASTM Practice E1527-13, is"the party seeking to use ASTM Practice E1527-13 to complete an environmental site assessment of the property.A User may include,without limitation, a potential Ipurchaser of property,a potential tenant of property,an owner of property, a lender, or a property manager." IAs stated in 40 CFR 312(the rule),the Brownfields Amendments provide important liability protections for Users who qualify as contiguous property owners, bona fide prospective purchasers,or innocent Ilandowners.To meet the statutory requirements for any of these Landowner Liability Protections(LLPs), a User must meet certain threshold requirements and satisfy certain continuing obligations.To qualify as I one of the three LLPs,the User must perform "all appropriate inquiries" (AAI)on or before the date on which the User acquired the Site.The rule defines AAI,which includes inquiries and activities performed by the User and an environmental professional (EP). The rule allows (but does not mandate)the User performing AAI to conduct inquiries or activities that Imay include searches for environmental liens, assessments of any specialized knowledge on the part of the User, an assessment of commonly known or reasonably ascertainable information about the Site, I and an assessment of the relationship of the purchase price to fair market value. However, if the User performing AAI conducts one or more of these inquiries and/or activities,the rule allows(but does not mandate)that the User may communicate information gathered from these inquiries and/or activities Ito their EP to identify a possible recognized environmental condition. I Braun Intertec provided a User Questionnaire to the Client as a means to communicate information gathered from these inquiries and/or activities to the EP.The User may elect whether to communicate this information to the EP and/or to communicate this information to the EP by other means (e.g., Ithrough conversation or submission of documents).As indicated in our contract, if multiple Users are I BRAUN INTERTEC City of Cottage Grove Project B14-06209 1 September 4, 2014 Page 5 requesting reliance on the Phase I ESA,the Client was responsible for forwarding a copy of the questionnaire to all appropriate entities(collectively the User). User-supplied information is discussed in applicable sections of this report. Sections A.4.a through A.4.f present any information communicated to us by the User that the EP has determined to indicate the possible presence or likely presence of a recognized environmental condition. ' A.4.a. Environmental Liens An environmental lien is a charge,security, or encumbrance, upon title to the Site to secure the payment 1 of a cost, damage, debt,obligation,or duty arising out of response actions,cleanup, or other remediation of environmental issues at the Site. No information was provided to us from the User that identified a record or awareness of environmental liens recorded against the Site. A.4.b. Activity and Use Limitations Activity and Use Limitations (AULs) are legal or physical restrictions or limitations on the use of, or access to, a Site to reduce or eliminate potential exposure to hazardous substances or petroleum products in the soil, soil vapor,groundwater,and/or surface water on the Site or to prevent activities that could interfere with the effectiveness of a response action, in order to ensure maintenance of a condition of no significant risk to public health or the environment.AULs,which may include institutional and/or engineering controls,are intended to prevent adverse impacts to individuals or populations that may be exposed to hazardous substances and petroleum products in the soil,groundwater, and/or surface water on the Site. No information was provided to us from the User that identified a record or awareness of AULs recorded against the Site. A.4.c. Specialized Environmental Knowledge Specialized environmental knowledge includes any information and/or experience related to the Site or adjoining properties including, but not limited to, any obvious indicators that point to the presence or likely presence of environmental issues at the Site. The User provided a previous environmental report conducted at the Site. A summary of that report is in Section B.6. The User was not aware of additional information regarding specialized environmental knowledge pertaining to the Site. Valuation Reduction for Environmental Issues Valuation reduction for environmental issues includes the relationship of the purchase price to the fair market value of the property. No information was provided to use by the User indicating any reduction in purchase price or fair market value of the Site due to environmental issues. A.4.e. Commonly Known or Reasonably Ascertainable Information Commonly known or reasonable ascertainable information includes information about the Site that generally is known to the public within the community where the Site is located and can be easily sought and found from individuals familiar with the Site or from easily attainable public sources of information. The User indicated that the Site consists of agricultural land. 1 A.4.f. Degree of Obviousness The User must consider the degree of obviousness of the presence or likely presence of releases or ' threatened releases at the Site and the ability to detect releases or threatened releases by appropriate investigation. The User was not aware of any obvious indications of the presence or likely presence of releases or threatened releases at the Site. I B. Records Review The purpose of the records review is to obtain and review records that will help identify recognized environmental conditions in connection with the Site.We consulted only those regulatory and historical sources that were readily available, practically reviewable, and likely to be useful to develop a history of 1 previous uses of the Site and surrounding area within the time and cost constraints of this Phase I ESA. 111 B.1. Physical Setting Information B.1.a. Topography According to the United States Geological Survey(USGS)7.5-minute topographic map series,St. Paul Park, Minnesota quadrangle,the Site is located at an elevation that ranges from 770 to 810 feet above mean sea level. BRAUN INTERTEC City of Cottage Grove Project B14-06209 ' September 4, 2014 Page 7 B.1.b. Geology The unconsolidated sediment in the Site vicinity are Pleistocene age middle-terrace deposits,which consist of sand,gravelly sand,and loamy sand with thin deposits of silt, loam,or organic sediment on top (Meyer and Hobbs, 1989). The uppermost bedrock unit in the Site vicinity is the Lower Ordovician, Prairie du Chien Group (Olsen and Bloomgren, 1989).The Prairie du Chien Group is described as Dolostone that varies greatly in thickness because its top is a major erosional surface.The eastern part of the county is sandy with minor amounts of shale in the upper third to half of the section.The lower part of the section is less sandy except within 10 to 15 feet of the base.The depth to bedrock in the Site vicinity is less than 50 feet below 1 land surface (Patterson et al., 1990). ' B.1.c. Hydrogeology The depth to groundwater in the vicinity of the Site ranges from approximately less than 5 to 60 feet below land surface. According to published geologic information,the regional groundwater flow direction within the unconsolidated deposits in the Site vicinity is generally southwest(Kanivetsky and Cleland, 1990). However,the local direction of groundwater flow may be affected by nearby streams, 1 lakes,wells,and/or wetlands and may vary seasonally. The Site-specific groundwater flow direction was not determined through direct measurement during ' this Phase I ESA.Additional field investigation, beyond the Scope of Services of this Phase I ESA,would be required to determine this information. B.2. Regulatory Report We obtained regulatory database information pertaining to the Site and surrounding area from GeoSearch.The GeoSearch report is a compilation of records of facilities that are included on current federal and state environmental regulatory databases.The databases were searched based on the specified minimum search distances from the Site as established by ASTM Practice E1527-13. The GeoSearch report also includes a description,source reference, date of acquisition, and the specified approximate minimum search distance criteria for each database and list. A copy of the GeoSearch report is attached in Appendix D. We reviewed the GeoSearch report to identify records that indicate known or potential recognized environmental conditions on the Site and/or surrounding area and to evaluate the likelihood for those recognized environmental conditions to impact the Site based on the information obtained in this Phase I ESA. Site The Site is not listed in the GeoSearch report on any of the standard environmental record sources as ' specified in the ASTM Standard. B.2.b. Adjoining Properties The following facilities are identified on properties that adjoin the Site in the GeoSearch report: 1 • Several of the adjoining properties to the Site were listed on the Waste Discharge Permits (WDP)database. Being listed on the WDP database indicated that the facility obtained a construction stormwater permit in order to limit pollution during and after construction by controlling the erosion associated with construction activities. - Plastic Resources Inc., located at 7799 95th Street South on an adjoining property west of Parcel 4 was listed on the. - Cottage Grove Auto&Collision, located at 7515 95th Street South north of Parcel 3. - CCE Technologies Inc,7555 95th Street South north of Parcel 3. - Kappa Properties,9800 Hemingway Avenue west of Parcel 1 and south of Parcel 2. - Schmid&Sons,7699 95th Street South north of Parcel 3. - American Agco,7900 97th Street South north of Parcel 1 and south of Parcel 4. ' • Advance Corporation, 8200 97th Street South on an adjoining property north of parcel 1 and south of Parcel 5 was listed on the Resource Conservation and Recovery Act Hazardous Waste Generator(RCRAGN05)database. Identification of the facility on the RCRAGNO5 database indicates that the facility is required to register their hazardous waste activity 1 under RCRA and does not imply that a release has occurred at the facility. Identification of the facility on the RCRAGN05 database indicates that the facility is required to register their hazardous waste activity under RCRA Iand does not imply that a release has occurred at the facility. Being listed on the WDP database indicated that the facility obtained a construction stormwater permit in order to I limit pollution during and after construction by controlling the erosion associated with construction activities. Four underground storage tanks(USTs)were registered at this facility. I One active 20,000-gallon diesel UST,one active 2,500-gallon lube oil UST, one active 1,000- gallon waste oil UST, and one removed 1,000-gallon gasoline UST. I • Cottage Grove Compost Facility, located at 96th Street South and Glendenning Road east of Parcel 5 was listed on the UAST database. One removed 300-gallon unregulated gasoline AST Iwas registered at this facility. ■ Renewal by Anderson,990 Jamaica Avenue South, located on an adjoining property to the I east of Parcel 1 was listed on the RCRAGN05 and WDP databases. Identification of the facility on the RCRAGN05 database indicates that the facility is required to register their hazardous waste activity under RCRA and does not imply that a release has occurred at the facility. IBeing listed on the WDP database indicated that the facility obtained a construction stormwater permit in order to limit pollution during and after construction by controlling the Ierosion associated with construction activities. 1 I • Up North Plastics,9480 Jamaica Avenue South, located on an adjoining property to the north of Parcel 5 was listed on the UAST database.Two removed 40,000-gallon fuel oil USTs were registered at this facility and two 6,000-gallon active diesel ASTs were registered at this Ifacility. l B.2.c. Surrounding Area We reviewed the GeoSearch report for facilities located beyond adjoining properties that may indicate a I release or likely release of hazardous substances and/or petroleum products that may impact the Site. Based on factors that include regulatory status,distance from the Site, and/or location relative to the regional groundwater flow direction,as referenced in Section B.1., no facilities are identified in the 1 GeoSearch report that warrant further consideration as potential recognized environmental conditions. Unmapped Sites The GeoSearch report did not identified any"orphan" sites,which, because of poor or inadequate ' address information could not be mapped by GeoSearch. ' B.3. Regulatory Agency File and Records Review The purpose of the regulatory file review is to obtain sufficient information to assist in determining if a recognized environmental condition, historical recognized environmental condition, controlled recognized environmental condition,or a de minimis condition exists at the Site in connection with a regulatory report listing. ' Based on our review of the regulatory report, it is our opinion that a regulatory agency file and records review is not warranted due to factors that include regulatory status,distance from the Site, and/or location relative to the regional groundwater flow direction, as referenced in Section B.1. B.4. Additional Federal, State, and Local Environmental Records To enhance and supplement the regulatory rydatabase report,we obtained or reviewed practically ' reviewable or reasonably ascertainable local city and/or county records and/or additional state records to identify records that indicate known or potential recognized environmental conditions at the Site. B.4.a. Well Databases The Minnesota Geological Survey(MGS) maintains the Minnesota County Well Index(MCWI),which is a ' limited database of water well records.The MCWI was accessed through the Minnesota Department of Health (MDH)website. Not all private water wells are listed in that database. ' Our review of the MCWI database revealed no documentation of water wells located on the Site. B.4.b. State Regulatory Web Pages We accessed MPCA's Aboveground/Underground Storage Tank and Leak Site Search web page, Minnesota Department of Agriculture(MDA) "What's In My Neighborhood"Agricultural Interactive ' Mapping web page and the MPCA's "What's In My Neighborhood"web pages for information regarding the potential for the Site, adjoining properties,or surrounding properties to be of environmental concern ' that were not identified in the regulatory database report. ' We did not identify facilities on the state regulatory web pages we accessed that were not already listed in the GeoSearch report discussed in Section B.2 above. Historical-Use Information The objective of the historical-use information review was to develop a history of the previous uses of the Site and surrounding area,to help evaluate the likelihood of past uses having led to recognized environmental conditions in connection with the Site. B.5.a. Historical Maps ' We conducted an inquiry of the ProQuest on-line Digital Sanborn® Fire Insurance Maps library.The ProQuest on-line library includes the original Chadwyck-HealeyTM Sanborn® Fire Insurance Maps collection for the entire U.S.,with some 660,000 maps. Based on our review, no fire insurance map coverage exists for the Site. B.5.b. Historical Topographic Maps We retained HIG to obtain historical topographic maps of the Site and surrounding area. HIG provided historical topographic maps for the years 1950, 1951, 1967, 1972, 1980, 1993, and 2013. Copies of the historical topographic maps are attached in Appendix E. No buildings or structures are visible on the Site on the on any of the available historical topographic maps.The Site topography appears to slope downwards towards the southeast on Parcels 1, 2, and 3 and Parcels 4 and 5 appeared to slope downwards towards the southwest.A gravel pit is labeled in the location of Parcel 5 on the 1967 topographic map.The gravel pit is depicted as expanded on Parcel 4 on the 1972 through 1993 topographic maps. Portion of the existing industrial facility is depicted north of ' the Site on the 1980 and 1993 maps, and residential development id depicted west of the Site on the 1993 and 2013 topographic maps. B.5.c. Aerial Photographs We retained HIG to obtain aerial photographs of the Site and surrounding area. HIG provided aerial photographs for the years 1936, 1947, 1951, 1957, 1964, 1970, 1979, 1986, 1991, 1997, 2003, and 2013. Copies of the aerial photographs are attached in Appendix F. ' 1936 The majority of the Site appears to be primarily cultivated agricultural land with the exception of the northeast portion of Parcel 3 and Parcel 5,which appear to be vacant lowland areas. A drainage feature is visible traversing from the northwest to the southeast through Parcel 3.The drainage feature appears ' to continue towards the southeast between Parcel 1 and Parcels 4 and 5.A road consistent with the existing alignment of 100th Street South is visible along the south boundary of Parcel 1.Cultivated land and farmstead are visible surrounding the Site. A facility with numerous buildings is visible northeast of the Site. BRAUN_ INTERTEC City of Cottage Grove Project B14-06209 September 4, 2014 Page 12 1947-1970 A pathway is visible leading from the facility to the northeast of the Site onto the northwest portion of Parcel 5 and ends at an area of disturbed soil.According to the historical topographic maps,this is a gravel pit. In 1964, an additional manmade drainage feature is traversing along the south side of Parcels 4 and 5. 1970 The gravel pit is still visible on the northwest portion of Parcel 5 and has expanded in size and onto Parcel 4. 1979 Additional soil disturbance is visible on Parcels 4 and 5; however,gravel mining no longer appears to be taking place.The disturbance may be associated with the reclamation of the pit. Portion of 95th Street South is visible along the north boundary of Parcel 5 with portion of the existing building located north of ' Parcel 5 visible beyond.A road consistent with the existing alignment of Jamaica Avenue is visible along the east boundary of Parcel 5. ' 1986 No significant changes are visible at the Site.A residential development is visible west of the Site. 1991 No significant changes are visible at the Site with the exception of the disturbed soil area appearing to be overgrown with grass and wooded vegetation. 95th Street South appears to have been extended to the west and is located along the north boundary of Parcels 3,4 and 5.An adjoining property to the north and west of Parcel 4 appears developed with the existing building and paved parking lot at that location. I 1997 No significant changes are visible at the Site.Grading activities are visible along the north side of Parcel 3. 1 2003 A road is visible extending from Jamaica Avenue to the west along the north side of Parcel 1 that is consistent with 97th Street South.Soil disturbance is visible along the north side of Parcel 1 that appears consistent with the existing dry stormwater pond and large soil mound on the west side of the stormwater pond at that location.An area of disturbed soil is also visible on the east portion of Parcel 5. Significant commercial, office/warehouse,and light industrial development is visible on the adjoining properties to the Site. I I BRAUN INTERTEC City of Cottage Grove Project B14-06209 ' September 4, 2014 Page 13 2013 Parcel 1 and Parcel 2 continue to be primarily cultivated land, Parcels 3,4, and 5 appear to be vacant land covered with grass and wooded vegetation and lowland.All of the existing structures on the adjoining properties to the Site are visible on this aerial photograph. B.5.d. City Directory Information We retained HIG to obtain city directory information pertaining to the Site and surrounding area. HIG ' provided city directories for 95th Street South, 97th Street South, and Jamaica Avenue at approximate five-year intervals from 1992 and 2012. All listings in the city directories are based on addresses. Because the Site has not been assigned an address,we looked at the surrounding area for information. The adjoining properties to the Site along 95th Street South were occupied by the following businesses ' between 2007 and 2012: Cottage Grove Collision&Auto, Hertz Rent-a-Car, United States Postal Service, CCE Technologies, Schmid&Son Packaging,Terramax Inc., Plastic Resources Inc. The adjoining properties to the Site along 97th Street South were occupied by the following businesses between 2007 and 2012: American Agco Inc.,American Engraving Inc.Tradehome Shoe Stores Inc., American Logistic Services,Advance Corporation. ' The adjoining properties to the Site along Jamaica Avenue were occupied by the following businesses between 2007 and 2012: Up North Plastics and Renewal by Anderson. B.6. Previous Environmental Documents ' We reviewed the following previous environmental documents regarding the Site: ' Phase I Environmental Site Assessment, Glen Grove Industrial Park, North of 100th Street and South of Highway 61, Cottage Grove, Minnesota, prepared by Braun Intertec (Project No. CMXX-00-0356),dated October 6, 2000 (2000 Phase I ESA). The 2000 Phase I ESA was completed for an approximate 480-acre undeveloped partly wooded,grassy parcel with apparent wetlands,two residential properties and a farmstead. According to historical research,the Site was documented as used for agricultural purposes since at least 1937.The surrounding area was developed for residential and industrial uses.The two residential properties and the surrounding farmstead were not included in the Site reconnaissance part of the 2000 Phase I ESA. BRAUN INTERTEC ICity of Cottage Grove Project 814-06209 I September 4, 2014 Page 14 IThe 2000 Phase I ESA documented that according to Washington County Department of Public Health and Environment file information,the Cottage Grove Yard Waste Compost (not located on the Site)was Ioperating at the property and a former quarry was a yard waste compost site and was suspect for dumping in the past. IThe 2000 Phase I ESA revealed no indications of recognized environmental conditions in connection with the property,with the exception of the following: I ' WashingtonCounty The Department of Public Health and Environment file information I indicated that the yard waste facility(also known as the city's compost site) located on the Site, is noted as being suspect for dumping in the past.Aerial photographs of the Site, also indicates soil disturbance in the vicinity of the composting site since at least 1957. I It was documented that the potential exists for well(s)or septic system(s)to be located at the Site. It I was recommended by Braun Intertec that if a well(s)or septic system(s)was encountered during future Site development activities,that the well(s) be properly sealed in accordance with Minnesota Rules, Chapter 4725 and the septic system(s) be properly abandoned in accordance with local regulations. IC. Interviews IWe contacted the following individual to obtain knowledge or historical and current land-use information regarding the Site: IMr.Gordon Glendenning,Wag Farms(owner of Parcels 1,3,4,and 5) IWe interviewed Mr.Glendenning on August 29,2014. Mr. Glendenning stated that his family has owned the Wag Farm parcels since the turn of the century. He said that no buildings or structures have ever l been located on the Site. He said that the Site parcels consist of cultivated land,fallow land,vacant grass covered and wooded land and lowland. Mr. Glendenning stated that the soil mounds located on Parcels 1 and 3 were made-up of soil from the construction of 97th Street South and the stormwater pond on IParcel 1. He said that gravel mining formerly took place of Parcels 4 and 5 of the Site until approximately 30 years ago and the City of Cottage Grove excavated soil from Parcel 5 in the early 2000s to create a 1 holding pond. He stated that when mining ended that the mine became overgrown and he was unaware if any reclamation was conducted. Mr.Glendenning stated that he was not aware of any dumping taking I place on his properties and was not aware of any environmental concerns in connection with the parcels. I BRAUN INTERTEC City of Cottage Grove Project B14-06209 ' September 4, 2014 Page 15 We made inquiry to the following local government offices and/or officials with the city of Cottage Grove to obtain knowledge or records of historical and current land-use information regarding the Site and ' surrounding area: ' Mr. Ryan Schroeder,City Administrator,City of Cottage Grove(Client and representative for Parcel 2 and work conducted by the City of Cottage Grove at the parcels) We interviewed Mr.Schroeder on August 28, 2014. Mr. Schroeder stated that Parcel 2 has been cultivated agricultural land since at least the 1930s and the parcels owned by Wag Farms to his ' knowledge have been cultivated agricultural land and fallow land since the 1930s. He said that in the early 2000s when 97th Street South and the stormwater pond were constructed on Parcel 1, some of the graded and excavated soil was mounded on Parcel 1 and Parcel 3. Mr. Schroeder stated that no debris is located in either of the mounds. Mr. Schroeder was aware that gravel mining had been conducted on Parcels 4 and 5 of the Site. Mr. Schroeder was not aware of any environmental concerns in connection with the Site parcels. D. Site Reconnaissance The objective of the Site reconnaissance is to obtain information indicating the likelihood of identifying recognized environmental conditions in connection with the Site. ' A Braun Intertec environmentalp rofessional, Danielle Stickler,conducted a Site reconnaissance on ' August 26, 2014. We were unaccompanied during the Site reconnaissance.At the time of the Site reconnaissance,the weather was partly cloudy with a temperature of about 70 degrees Fahrenheit. D.1. Site Characteristics At the time of the reconnaissance,the Site consisted of five parcels totaling approximately 151.63 acres. The Site topography on Parcels 1, 2, and 3 was relatively flat with a gentle slope downward toward the ' north-northeast and the topography for Parcels 4 and 5 appeared to slope from the north downwards towards the south.The Site consisted of cultivated agricultural land and vacant grass covered and partly wooded land with lowland areas, a holding pond, and a stormwater pond. 111 BRAUN INTERTEC City of Cottage Grove Project B14-06209 ISeptember 4, 2014 Page 16 ID.2. Adjoining Property Use and Characteristics IThe Site was bordered on the north by 95th Street South,Jack Cooper Transportation Company, and Up North Plastics with light industrial, commercial and residential properties located beyond; on the east by I Jamaica Avenue,Cottage Grove Fire Station#4, and Cottage Grove Compost facility with residential and cultivated agricultural land located beyond; on the south by.100th Street South, cultivated agricultural land, and farmsteads with cultivated agricultural land located beyond; and on the west by Hemingway IAvenue South, office/warehouse properties,and residential development with residential development located beyond. The Site was located in a mixed-use area within the city of Cottage Grove. No observations of environmental concern were noted on adjoining properties to the Site at the time of I the reconnaissance. D.3. Site Improvements and Layout I The Site consisted of a mix of cultivated agricultural land and vacant grass covered and partly wooded I land with lowland areas,a holding pond, and a stormwater pond. • Parcel 1—consisted of cultivated agricultural land and windbreak tree rows with a dry Istormwater pond located on the north-central portion of the parcel and soil mound covered with grassy vegetation west of the stormwater pond. I • Parcel 2—consisted of cultivated agricultural land. I • Parcel 3—consisted of cultivated agricultural land windbreak tree rows on the southwest portion of the parcel and vacant partly wooded and grass covered land on the remainder of Ithe parcel. I .I Parcel 4—consisted of vacant, partly wooded and grass covered land with lowland areas and a holding pond. I • Parcel 5—consisted of vacant, partly wooded and grass covered land. Pits, Ponds, or Lagoons A dry stormwater pond was located on the north-central portion of Parcel 1. Lowlands were visible on Parcel 5.A manmade drainage channel was located along the north boundary of Parcel 3 and the south boundary of Parcels 4 and 5. D.S. Stained Soil, Pavement, or Corroded Surfaces No stained soil, pavement,or surfaces such as floors,walls,or ceilings were observed at the Site at the itime of our reconnaissance. D.6. Solid Waste Disposal No indications of waste disposal areas,observed fill or graded areas by non-natural causes, mounds, depressions,or burn pits were observed at the Site at the time of the reconnaissance with the exception of two soil mounds covered with grassy vegetation observed on the Site. One on the west side of a dry tstormwater pond on the north-central portion of Parcel 1 and the second on the southeast portion of Parcel 3. No debris was observed protruding from the soil mounds. D.7. Stressed Vegetation No areas of stressed,discolored, stained or dead vegetation beyond what would be expected due to seasonal conditions were observed at the time of the Site reconnaissance. D.B. Hazardous Substances No indications of current and/or historic use,storage,staining, or spills of hazardous substance were observed at the Site at the time of the reconnaissance. D.9. Petroleum Products No indications of current and/or historic use,storage, staining, or spills of petroleum product were observed at the Site at the time of the reconnaissance. Storage Tanks ' No indications of aboveground or underground storage tanks(AST/UST)were noted at the Site at the time of the reconnaissance. D.11. Unidentified Drums and Containers No drums containing unidentified substances suspected of being a hazardous substance or petroleum product were observed at the Site at the time of our reconnaissance. I D.12. Odors No indications of strong, pungent,un ent, or noxious odors were observed at the time of the Site reconnaissance. D.13. Potential PCB-Containing Electrical and Hydraulic Equipment No indications of potentially PCB-containing electrical or hydraulic equipment were noted at the Site at the time of the reconnaissance. D.14. Wastewater Discharges No indications of wastewater discharging into a drain,ditch, underground injection system, or stream on or adjacent to the Site were observed at the Site at the time of the reconnaissance. D.15. Sewage Disposal System According to Mr.Schroeder with the City of Cottage Grove, municipal sewer services are available to the Site. D.16. Wells No indications of wells such as monitoring wells,dry wells, irrigation wells, injection wells, abandoned wells,or other non-potable wells were observed at the Site at the time of the reconnaissance. Potable Water Supply According to Mr.Schroeder with the City of Cottage Grove, municipal water services are available to the Site. I E. Limiting Conditions and Data Gaps The findings and conclusions presented in this report are based on procedures described in ASTM Practice E1527-13, inquiries with public officials,available literature cited in this report,conditions noted at the time of our Phase I ESA, and our interpretation of the information obtained as part of this Phase I ESA. Our findings and conclusions are limited to the specific project and properties described in this report and by the accuracy and completeness of information provided by others. An environmental site assessment cannot wholly eliminate uncertainty regarding the potential for recognized environmental conditions in connection with a property. Performance of this practice is intended to reduce, but not eliminate, uncertainty regarding the potential for recognized environmental conditions in connection with a property within reasonable limits of time and cost. In performing its services, Braun Intertec used that degree of care and skill ordinarily exercised under similar circumstances by reputable members of its profession currently practicing in the same locality. No warranty, express or implied, is made. The following limiting condition was encountered: ■ Observation of the Site was limited due to the size of the property being assessed, wooded areas on Parcels 1,3, and 5, and lowland area on Parcel 5. The identified limiting condition did not affect the environmental professional's ability to render opinions regarding conditions indicative of a release or threatened release. No data gaps were identified during the Phase I ESA process,with the exception of the following: I .' Historical resources were not readily available for 5-year-or-less intervals from the time of the first developed use. I F. Findings The findings include identified known or suspect recognized environmental conditions, controlled recognized environmental conditions, historical recognized conditions,de minimis conditions and additional issues in connection with the Site. The following findings are based on the results of our assessment: ' • The information indicates that the south and west portion of the Site (Parcels 1, 2, and portion of 3) has been cultivated agricultural land since at least 1936. • A gravel pit was located on the northeast portion of the Site(Parcels 4 and 5) between at least the 1940s and the 1970s. I • Soil mounds were located on the Site. • Several of the adjoining properties to the Site were listed on the Waste Discharge Permits (WDP) database. • Advance Corporation, located on an adjoining property north of Parcel 1 and south of Parcel 5 was listed on the RCRAGNO5 database. • Innovative Chemical Corporation, located on an adjoining property north of Parcel 1 and south of Parcel 5 was listed on the RCRAGNO5 and WDP databases. I . Allied Systems/Jack Cooper Transportation Company/Commercial Carriers, located on an adjoining property north of Parcel 4 was listed on the RCRAGN05, WDP, and UAST databases. • Cottage Grove Compost Facility, located at 96th Street South and Glendenning Road east of Parcel 5 was listed on the UAST database. r • Renewal by Anderson, located on an adjoining property to the east of Parcel 1 was listed on the RCRAGNO5 and WDP databases. ' G. Opinions According to the User,the Phase I ESA was conducted in association with the purchase of four parcels and the sale of one parcel of the Site.Opinions expressed herein are influenced by the stated reason for conducting the Phase I ESA. Furthermore,the expressed opinions might not be applicable to alternate reasons for reliance on the content of the Phase I ESA. G.1. Recognized Environmental Conditions A recognized environmental condition is defined by ASTM Practice E1527-13 as: "the presence or likely presence of any hazardous substances or petroleum products in,on,or at a property: 1) due to any release to the environment, 2) under conditions indicative of a release to the environment: or 3) under ' conditions that pose a material threat of a future release to the environment. De minimis conditions are not recognized environmental conditions." This assessment identified no recognized environmental conditions in connection with the Site. G.2. Controlled Recognized Environmental Conditions A controlled recognized environmental condition is defined by ASTM Practice E1527-13 as"a recognized environmental condition resulting from a past release of hazardous substances or petroleum products that has been addressed to the satisfaction of the applicable regulatory authority,with hazardous substances or petroleum products allowed to remain in place subject to the implementation of required controls." 111 This assessment identified no controlled recognized environmental conditions in connection with the 1 Site. This assessment identified no historical recognized environmental conditions in connection with the Site. G.4. De Minimis Conditions A de minimis condition is defined by ASTM Practice E1527-13 as"a condition that generally does not present a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies." The following findings are considered de minimis conditions: • The southwest portion of the Site has been used for agricultural purposes since at least 1936. It is our opinion that the use of the Site for agricultural purposes is considered a de minimis condition for the Site. I . Soil mounds were located on the west portion of a dry stormwater pond located on Parcel 1 and on the southeast portion of Parcel 3.The mounds became visible on the 2003 aerial photograph,the same aerial when the stormwater pond is observed on Parcel 1 and 97th tStreet South is constructed.According to interview information with the City of Cottage Grove,the soil mounds are made-up of soils from those projects. Based on no debris observed protruding from the soil mounds,the soil mounds appear to represent a de minimis condition. • Several of the adjoining properties to the Site were listed on the Waste Discharge Permits (WDP) database. Being listed on the WDP database indicated that the facility obtained a ' construction stormwater permit in order to limit pollution during and after construction by controlling the erosion associated with construction activities.These listing represent de minimis conditions for the Site. • Advance Corporation, located on an adjoining property north of Parcel 1 and south of Parcel 1 5 was listed on the RCRAGNO5 database. Identification of the facility on the RCRAGNO5 ' BRAUN INTE_RTEC City of Cottage Grove Project B14-06209 September 4, 2014 Page 23 database indicates that the facility is required to register their hazardous waste activity under RCRA and does not imply that a release has occurred at the facility and therefore 1 represents a de minimis condition for the Site. I . Innovative Chemical Corporation, located on an adjoining property north of Parcel 1 and south of Parcel 5 was listed on the RCRAGN05 and WDP databases. Identification of the facility on the RCRAGN05 database indicates that the facility is required to register their 1 hazardous waste activity under RCRA and does not imply that a release has occurred at the facility. Being listed on the WDP database indicated that the facility obtained a construction stormwater permit in order to limit pollution during and after construction by controlling the erosion associated with construction activities.These listings represent de minimis conditions for the Site. ■ Allied Systems/Jack Cooper Transportation Company/Commercial Carriers, located on an 1 adjoining property north of Parcel 4 was listed on the RCRAGN05, WDP, and UAST databases. Identification of the facility on the RCRAGN05 database indicates that the facility is required to register their hazardous waste activity under RCRA and does not imply that a release has ' occurred at the facility. Being listed on the WDP database indicated that the facility obtained a construction stormwater permit in order to limit pollution during and after construction by 1 controlling the erosion associated with construction activities. Four USTs were registered at this facility. Identification of a facility on the UST database indicates that the facility was the location of registered underground storage tanks and does not imply that a release has occurred at the facility. These listing represent a de minimis condition for the Site. 1 ■ Cottage Grove Compost Facility, located east of Parcel 5 was listed on the UAST database. One removed 300-gallon unregulated gasoline AST was registered at this facility. Additional Considerations An additional consideration is a condition that does not meet the definition of a recognized environmental condition,controlled recognized environmental condition, or historical recognized environmental condition but, in our opinion,should be brought to the attention of the User. The ' following additional considerations were identified during the Phase I ESA. Areas of Parcel 4 and 5 of the Site were formerly an aggregate mine pit. Mine pits present convenient locations for dumping unwanted soils and other materials. Backfilling mine pits with demolition debris, fly ash, and contaminated soils was a common practice in the past. Although we revealed no information 1 that confirms or indicates placement of any backfill, based on experience,the potential exists that buried backfill materials are present at the Site.Although less likely,there is nevertheless a potential that buried materials may include contaminated soils and or materials that could require management as solid or hazardous waste. If fill soils(which could include demolition debris and other wastes)are encountered during a future redevelopment, additional evaluation of the fill soils might be required for management and disposal purposes. H. Conclusions We have conducted this Phase I ESA of the Site in general conformance with the scope and limitations of ASTM Practice E1527-13.Any exceptions to,or deletions from,this practice are described in Section F of this report. Conducted Phase I and Phase II ESAs, implemented the RAP and procured initial liability assurance letters necessary to start site development.The site was developed into a luxury apartment complex. ■ Edina, MN—Conducted Phase I ESA of a former sheet metal fabrication ' facility, identifying several recognized environmental conditions. Conducted Phase II ESA and subsequent Remedial Investigation (RI)at the site, identifying the presence, extent and magnitude of petroleum contamination in the area ' from several former bulk aboveground storage tanks(ASTs).The RI results were used to obtain site closure from the MPCA. ■ Bigelow, MN—Managed a Phase II ESA of a parcel that was acquired by the ' Minnesota Department of Transportation for new alignment of Trunk Highway 60 from Worthington, MN to Bigelow.The parcel was occupied by a drainage contractor.The Phase II ESA found only minor petroleum contamination.The I MARK A. Designed and implemented a vapor intrusion soil investigation to evaluate the ' potential for vapor migration into the existing structures. Based on the findings, developed a Response Action Plan (RAP)that included installation of a soil vapor extraction system to mitigate vapor issues.Another component was a bituminous cap over unpaved areas of the site, restricting access to the contaminants.Assisted with procurement of State and County-funded ' environmental cleanup grants.Site is currently in the voluntary program; activities will include implementing the RAP and working toward No Action status. ' • Culver, IN—Conducted Phase I ESA of former automobile exhaust system manufacturer. Managed the Phase II ESA of the site,which identified several areas of soil and groundwater contamination. Managed the remedial investigation of the areas of contamination. Planned activities for this site include submittal of Phase II ESA and RI results with recommendations for groundwater monitoring and subsequent issuance of a Certificate of Completion and Covenant not to sue.
