CALL TO ORDER — Mayor ROLL CALL — City Clerk ADOPTION OF AGENDA 2. PRESENTATIONS 3. APPROVAL OF MINUTES A. November 5, 2003 Regular Meeting. 4. CONSENT CALENDAR A. Accept and Place on File the Following Minutes: i. Public Safety, Health and Welfare Commission of October 14, 2003. B. Consider adopting a resolution approving the Premise Permit for the Fraternal Order of Police, Minnesota Lodge #1, to conduct lawful gambling at Demori's Restaurant and Lounge, for the permit period of 2/1/04 through 1/31/06. Staff Recommendation: Adopt the resolution approving the premise permit. During the required background investigation, no facts were found that would constitute denial of the application. DECEMBER 17, 2003 AGENDA Cottage Grove City Council C. Consider authorizing renewal of liquor licenses for 2004 for the following establishments: Applebee's Neighborhood Grill & Bar, Boondocks Bar & Grill, Cedarhurst, Cottage Grove VFW Post 8752, Cub Foods, DeMori's, Dennis Brothers Liquor, G-Will Liquors, MGM Liquor Warehouse, New Moon Restaurant & Sports Bar, Rainbow Foods, River Oaks Golf Course, Rodeo, Shamrock Liquors, Superamerica #4183. Renewals are subject to compliance with State and Local Liquor Laws, receipt of appropriate application documentation, receipt of a Certificate of Liquor Liability Insurance or waiver, satisfactory completion of the required police investigation and fire inspection, payment of 2004 license fees, and payment of outstanding financial obligations by December 30, 2003 at 12:00 p.m. Staff Recommendation: Authorize renewal of liquor licenses contingent on compliance with established conditions. D. Consider approving the 2004 Emergency Medical Services Contract between the City of Cottage Grove and the Township of Grey Cloud Island and authorize the Mayor and City Administrator to execute the contract. Staff Recommendation: Approve the 2004 Emergency Medical Services Contracf between the City of Cottage Grove and the Township of Grey Cloud Island and authorize the Mayor and City Administrator to execute the contract. E. Consider authorizing the City Administrator to enter into an agreement with Regina Clinic to administer pre-employment and employment exams, testing and chemical screenings based on the results of the Request for Proposal (RFP) process. Staff Recommendation: Authorize the City Administrator to enter into the agreement. F. Consider accepting a donation from Cogentrix/LSP - Cottage Grove for the Economic Development Trust Fund. Staff Recommendation: Adopt the resolution accepting the donation. Under Minnesota Statute 465.03—Gifts to Municipalities—donations must be accepted by a resolufion of the governing body by a two-thirds majority of its members. G. Receive update on abatement of the nuisance property at 8724 — 95th Street South. Staff Recommendation: Receive update. H. Receive update on tree mitigation for the Oak Park Commons project. Staff Recommendation: Receive update. I. Consider purchase of a Holder C97.2 Tractor and attachments in the amount of $79,383.00 with funds from the 2003 EquipmenWehicle Replacement Fund. Staff Recommendation: Approve the purchase of the tractor and attachments in fhe amount of $79,383.00 from Cushman Motor Company. The City is eligible to purchase this equipment through the Minnesota Materials Management Division Contract. Cushman Motor Company, Inc., Minneapolis, has been awarded the state contract. J. Consider purchase of a New Holland TC45 Tractor and attachments in the amount of $28,774.17 with funds from the 2003 EquipmentNehicle Replacement Fund. Staff Recommendafion: Approve the purchase of the tractor and attachments in the amount of $28,774.17 from Werner Implement, who supplied the lower of two quotes received. This tractor will replace a 1983 Allis Chalmers tractor for the Parks Mainfenance Division. K. Consider approving Change Order #1 for the Timber Ridge 4th Addition. Staff Recommendation: Approve the change order, which includes addifional sform sewer work due to the existing condition of the DNR drainage way. DECEMBER 17, 2003 AGENDA Cottage Grove City Council L. Consider adopting a resolution amending the City Fee Schedule, effective 1/1/04. Staff Recommendation: Adopt the resolution. This resolution will amend certain fees within the City's existing fee schedule, effective 1/1/04. M. Consider approving the amendment to the ICMA City Administrator Pension Plan. Staff Recommendation: Approve the amendment. The City's annual confribution to the City Administrafor's pension would increase from $12,000 to $13,000. "N. Set a Public Hearing for the NPDES Annual Meeting on February 4, 2004. Staff Recommendation: The City of Cottage Grove will conduct a public meeting on February 4, 2004 as part of the Council Meeting to allow interested citizens an opportunity to comment on the Storm Water Pollution Prevention Plan (SWPPP) submitted to the MPCA on March 10th, 2003 as required by the City's NPDES Phase ll Storm Water Permit. A brief presentation will provide background on the Permit requirements and draft annual report material which will be submitted prior to March lOth, 2004. Time will be available during fhe meeting for oral statements from the public. Copies of the SWPPP are available for viewing at City Hall (7516 80th Street South) and the Public Works Facility (8635 West Poinf Douglas Road South). Written comments may be submitted prior to January 30, 2004 to the following address: City of Cottage Grove; Attn: Monica Percic; 8635 West Point Douglas Road South; Cottage Grove, MN 55016. *"O. Consider authorizing staff to enter into a renewal contract with Administration Resource Corporation to provide administrative services relating to our health care spending accounts, dependent care spending accounts, and COBRA/Retiree insurance coverage relating to the City's flexible benefits plan. Staff Recommendation: Authorize staff fo enter into the agreement. **P. Consider adopting a resolution to accept the donation of $1,000.00 from 3M Corporation and authorize subsequent payment to the South Washington County D.A.R.E. Fund for the purchase of supplies and equipment. Staff Recommendation: Adopt the resolution accepting the donation. `"`Q. Consider contracting with Bonestroo, Rosene, Anderlik and Associates to perform the Traffic Control Study of the Thompson Grove Area in the quoted amount of $4,500.00. Staff Recommendation: Award the Traffic Control Study of ihe Thompson Grove Area to Bonestroo, Rosene, Anderlik and Associates who submitted the lower of two quotes received. "R. Consider adopting a resolution certifying delinquent utility bills to the property tax rolis payable 2004. Staff Recommendation: Adopt the resolution. 5. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES A. Response to Randy Hostetler regarding nuisance ordinances and semi-tractor parking in residential neighborhoods. Staff Recommendation: Receive response. B. Response to John Rantala regarding abatement process for cleaning up property at 8724 — 95th Street South. Sfaff Recommendation: Receive response. C. Response to Thomas Bauer regarding Building Code requirements and code enforcement timeframes. Staff Recommendation: Receive response. 6. PUBLIC HEARINGS DECEMBER 17, 2003 AGENDA Cottage Grove City Council BID AWARDS UNFINISHED AND NEW BUSINESS A. 1. Consider authorizing entrance into a purchase agreement with RT Minneapolis Franchise, LLC for a 2.2-acre parcel of the Oakwood Commercial Property. 2. Consider authorizing approval of a letter of intent with Oppidan for purchase of a 72,579 square-foot site within the Oakwood Commercial Property. Staff Recommendation: 1. Authorize entrance into the purchase agreement. 2. Authorize approval of the letter of intent. B. Consider adopting resolutions adopting the 2004 budget and the 2003 tax levy collectible in 2004 for the City of Cottage Grove. Staff Recommendation: Adopt the resolutions. 9.
