Persons may address the City Council on subjects fhat are not a part of the Regular Meeting agenda, but must limit remarks to two (2) minutes. Open forum will adjourn to the Regular Meeting promptly at 7:30 p.m. Open Forum and a portion of the Regular Meeting are televised LIVE, airing on Government Channel 16. REGULAR MEETING - 7:30 P.M. CALL TO ORDER — Mayor ROLL CALL — City Clerk ADOPTION OF AGENDA 2. PRESENTATIONS 3. APPROVAL OF MINUTES 4. CONSENT CALENDAR A. Accept and Place on File the Following Minutes: i. Economic Development Authority of June 8, 2004 and July 13, 2004. ii. Public Works Commission of June 14, 2004. iii. Public Safety, Health and Welfare Commission of June 15, 2004 and July 20, 2004. iv. Planning Commission of July 26, 2004. B. Consider adopting a resolution in support of Denmark Township's Petition to incorporate into the City of Denmark. Staff Recommendation: Adopt the resolufion. C. Consider authorizing an exemption from Cottage Grove City Code 5-3-3 and 5- 3-6 regarding the discharge of firearms to Mr. Jacob Jordan. Staff Recommendation: Authorize the exemption subject to conditions outlined in Sergeant Jim Smith's memo dated August 19, 2004. This exemption would allow Mr. Jordan to destroy crows that are damaging crops on his property in the 9000 — 9500 block of Hadley Avenue. SEPTEMBER 1, 2004 AGENDA Cottage Grove City Council D. Consider approving the revisions to the 2004 Pay Plan and Benefits resolution to include: A. Reclassify the Building Inspector position to nonexempt to conform to the recent FLSA changes. B. Reclassify the MIS Technician position to nonexempt to conform to the recent FLSA changes. Staff Recommendation: Approve the revisions to the 2004 Pay Plan and Bene�ts resolution to conform to the recent FLSA changes. E. Consider approving a variance to allow a garage to be constructed in front of the principal structure at 11860 Lofton Avenue South. Staff Recommendation: Adopt the resolution approving a variance to allow a garage to be constructed in front of the principal structure at 11860 Lofton Avenue South. F. Consider approving a variance to allow a corner of an existing porch at 7188 Jenner Alcove South to be setback approximately 22 feet from the front property line when 30 feet is required. G. Consider approving a variance to allow a garage addition to setback 10 feet from the corner side property line when 20 feet is required at 8614 Hyde Avenue South. H. Receive update on Red Rock Corridor. Staff Recommendation: Receive update. I. Consider authorizing issuance of a temporary archery hunting permit to Robert Juckel of 8451 — 110th Street to allow archery hunting on his property for the 2004 archery season, which would be September 18 to December 31, 2004. Staff Recommendation: Authorize issuance of the temporary hunting permit to Robert Juckel to allow archery hunting on his properfy for the 2004 archery season only. J. Consider approving and signing the Joint Powers Agreement with School District 833 to allow the City to construct a recreational trail through school property. Sfaff Recommendation: Enter into ihis agreement so the City can extend the Cottage Grove Trailway Corridor irom Kingston Park to 80ih Street via the Xcel Energy Corridor. K. Consider adopting a resolution requesting a speed study by the Minnesota Department of Transportation for 80th Street between Highway 61 and Kimbro Avenue. Staff Recommendation: Adopt the resolution requesting the speed study. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES PUBLIC HEARINGS A. Hold the public hearing and consider adopt a resolution giving approval for a commercial facilities project by Human Services, Inc. Staff Recommendation: Adopt the resolution. 7. BID AWARDS SEPTEMBER 1, 2004 AGENDA Cottage Grove City Council UNFINISHED AND NEW BUSINESS A. Give representative from Cottage Grove VFW Post 8752 an opportunity to admit to or deny the allegation that their business failed the alcohol compliance check on May 12, 2004 by selling alcohol to an underage buyer. This item was tabled from the July 7, 2004 City Council Meeting. Staff Recommendation: Should representative admit to the violation or fail to attend fhe meeting, impose a$500 fine for their first violation in a 24-month period. Should representative deny the violation. authorize scheduling a contested-case hearing before an administrative law judge. B. Set date for the 2004/payable 2005 Truth in Taxation Hearing. Staff Recommendation: Set date for the 2004/payable 2005 Truth in Taxation Hearing. C. Consider adopting the proposed 2005 budget and the proposed 2004 tax levy collectible in 2005 for the City of Cottage Grove. Staff Recommendation: Adopt the resolufions as presented. D. Consider approving a preliminary plat for Pinecroft, to be developed by U.S. Home Corporation, which will consist of 61 lots for single-family homes and 2 outlots to be located on the northwest corner of 65th Street and Ideal Avenue South.
