agenda, but must limit remarks to two (2) minutes. Open forum will adjourn to the Regular
Meeting promptly at 7:30 p.m. Open Forum and a portion of the Regular Meeting are
televised LIVE, airing on Government Channel 16.

C. Consider approving a conditional use permit to allow a restaurant with liquor,
Las Margaritas Mexican Restaurant, to be located in the Shoppes at Gateway,
7750 Harkness Avenue South.
Staff Recommendation: Adopt the resolution approving the conditional use permit to allow a
restaurant with liquor, Las Margaritas, to located in the Shoppes at Gateway retail development.
D. Consider approving an amendment to a conditional use permit for a horse
boarding facility to allow a 60-foot by 80-foot addition for an indoor horse
training arena at 11050 Manning Avenue South.
Staff Recommendation: Adopt the resolution approving the amendment to a conditional use
permit for a horse boarding facility to allow a 60-foot by 80-foot addition for an indoor horse
training arena at 11050 Manning Avenue South.
E. Receive information regarding local elementary school field trips to City Hall.
Staff Recommendation: Receive information.
F. Consider appointing James Litton to the Human Services/Human Rights
Commission.
Staff Recommendation. Appoint Mr. Litton to the Human Services/Human Rights Commission.
G. Receive information regarding the Thompson Grove Traffic Control Analysis.
Staff Recommendation: Receive information regarding the Thompson Grove Traffic Control
Ana/ysis.
H. Consider renewal of a two-year contract between the City of Cottage Grove and
Biff's, Inc. Portabie Restrooms Rental and Service.
Staff Recommendation: Renew the contract between the Ciry of Cottage Grove and Biff's. Biff's
has consistently provided excellent service and will provide units at the current price for the next
hvo years.
I. Consider adopting a resolution adopting assessments for the off-site ponding
fee for the Subway Development on East Point Douglas Road.
Staff Recommendation: Adopt the resolution as presented. No public hearing is required for this
assessment under Minnesota Statutes 429 and 444 because the property owner has signed the
petition and waiver agreement.
J. Receive update on code enforcement activities in the City.
Staff Recommendation: Receive update.
K. Consider adopting a 2005 pay plan for non-represented employees.
Staff Recommendation: Adopt the resolution adopting a 2005 pay plan for non-represented
emp/oyees.
L. Receive information on the property tax impacts of additional financing for
future facilities.
Staff Recommendation: Receive information.
M. Consider approving the 2005 — 2007 Prosecution Contract.
Staff Recommendation: Authorize the Mayor to enter into a new prosecution contract on behalf
of the City with Joseph Taylor.

UNFINISHED AND NEW BUSINESS
A. Give representative from Cottage Grove VFW Post 8752 an opportunity to
admit to or deny the allegation that their business failed the alcohol compliance
check on May 12, 2004 by selling alcohol to an underage buyer. This item was
tabled from the July 7, 2004 and September 1, 2004 City Council meetings.
Staff Recommendation: Should the representative admit to the violation or fail to attend the
meeting, impose a$500 fine for their first violation in a 24-month period. Shou/d representative
deny the violation, authorize scheduling a contested-case hearing before an administrative law
judge.
B. Give representatives from Mississippi Dunes Golf Course and River Oaks Golf
Course an opportunity to admit to or deny the allegation that their businesses
failed the alcohol compliance check on October 11, 2004 by selling alcohol to
underage buyers.
Staff Recommendation: Should representative admit to the violation or fail to attend the
meeting, impose a$500 fine for their first violation in a 24-month period. Should representative
deny the vio/ation, authorize scheduling a contested-case hearing before an administrative law
judge.
C. Consider an amendment to the City Code allowing a fourth licensed residential
trash hauler for the City of Cottage Grove.
Staff Recommendation Per the recommendation of the Public Works Commission on June 14,
2004, do not amend the City Code by adding a fourth licensed residential trash hauler.
D. Discuss and provide direction to staff regarding the appointment of directors to
the South Washington County Telecommunications Commission.
Staff Recommendation: Per discussion. Staff recommendation is to be consistent with
appointments to other commissions by either an amendment to the City Code or via a separate
policy.
'E. Consider approving the 2005 — 2009 Capital Improvements Plan (CIP).
Staff Recommendation: Approve the 2005 — 2009 Capital Improvements Plan (CIP).
"F. Consider approval of a development agreement between the City of Cottage
Grove and Presbyterian Homes Housing and Assisted Living concerning
distribution of 2004 Community Development Block Grant (CDBG) funds.
Staff Recommendation: Approve the deve/opment agreement behveen the City and
Presbyterian Homes concerning distribution of 2004 CDBG funds.
