Levitt, P.E., City Engineer Date: August 31, 2007 Re: Jamaica Avenue Roundabout Project (State Project No. 8502-117 (TH61=003)) Approve Terms & Conditions of Local Road Improvement Grants BackgroundlDiscussion: The City received two grants from the Local Road Improvement program from the MnDOT for the Jamaica Avenue Roundabout Project. The first grant was for $694,000 from the Local Road Improvement Program and second was from the Routes of Regional Significance for $400,000. As part of the improvement program, the State requires that the City pass a resolution agreeing to the terms and conditions of these grants. For your information, a copy of the Minnesota Statutes, Section 174.52, subdivision 5 is inciuded for review. The attached resolutions must be passed prior to payment being issued. Recommendation: It is recommended Council adopt the attached resolutions agreeing to the terms and conditions of the Local Road Improvement Program for State Project No. 8205-117 (TH 61=003). RESOLUTION NO. 07- RESOLUTION FOR AGREEMENT TO STATE TRANSPORTATION FUND LOCAL ROAD IMPROVEMENT PROGRAM GRAIdT TERMS AND CONDITIONS WHEREAS, the City of Cottage Grove has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of Local Road Improvement Project No. 8205-117 (TH 61 =003); and WHEREAS, the Commissioner of Transportation has given notice that funding for this Iocai road improvement project is available; and WHEREAS, the amount of the grant has been determined to be $694,000.00. NOW THEREFORE, be it resolved that the City of Cottage Grove appears to the City Council of the City of Cottage Grove does hereby agree to the terms and conditions of the grant consistent with Minnesota Statutes, section 174.52, subdivision 5, and will pay any additional amount by which the cost amount appropriated for the road project, but not required. Subdivision I. Fund ereated. A local road improvement'fund is created in the state treasury. The fund consists of money transferred to the fund Yhrough appropriation, gift, or granY. Subd. 2. Trunk highway corridor projects account. A frunk highway corridor projects account is established in the local road improvement fund. Money in the account is annually appropriated to the commissioner of transportaYion for expendifure as specificd in this section. Money in the account must be used as grants or loans to statutory or liome rule charter ciYies, towns, and counties to assist in paying the ]ocal share of frunk highway projects that have ]ocal costs that are directly or partially related to the trunk highway improvement and Yhat are not fiinded or are only partially funded with oYher state and federai funds. 1"he commissioner shall determine the amount of the local share of costs eligible for assistance �t�om the accounY. Subd. 3. Advisory committee. (a) The commissioner shall establish an advisory committee consisring of five members, including: (1) one cowity commissioner; (2) one county engineer; (3) one city engineer; (4) one eity eouncil member or eity administrator representing a city with a population over 5,000; and (5) one cify council member or city administrator representing a city with a population under 5,000. The advisory committee shall provide recommendations w the commissioner regarding expenditures from the trunk highway corridor projecTS account. (b) Notwithstanding section 15.059 subdivision 5, the committee does not expire. Subd. 4. Locat road account for routes of regional significance. A local xoad account for routes of regional signifieance is established in the locai road improvement fund. Money in the account is annually appropriated to the commissioner of transportation for expendiYure as specif ed in this section. Money in the accoimt mtiist be used as granYs or loans to statufory or home rule charter cities, towns, and couuYies to assist in payi��g the costs oFconstructing or reconstructing eity streets, county highways, or town roads wiYh sYatewide or regional significance fhat have noY been fully funded through other sYate, federal, or local funding sources. Subd. 4a. Rural road safety account; appropriation. (a) A rural road sa'Fety account is established in the Local road improvement fund. Money in the account is annually appropriated to the commissioner of transportation for expenditure as specified in this subdivision. Money in tfie account must be used as grants to counties to assist in paying the costs of capital improvement projeets on county state-aid highways that are intended primarily to reduce traffie crashes, deafhs, injuries, and property damage. (b) The commissioner shall establish procedures for counties to apply for grants from the 174.52, Minnesota Statutes 2006 rural road safery acconnt and criteria Yo be used to select projects for funding. The commissioner sliall establisl� these proceduees and criteria in consultation with representatives appointed by the Association of Mim�esota Counties. Eligibility for project selection must be based on the abiliry of each proposed project to reduce the frequency and severity of crashes. (c) Money in the account musY be allocated in each fiscal year as 'Follows: (,1) one-third of money us the account must be used for projects in the counties of Anoka, Chisago, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington; and (2) the remainder must be used for projects elsewhere in the state. Subd. 5. Grant procedures and criteria. The commissioner shall establish procedures for statutory or liome rule charter cities, towns, and counties to apply for grants or loans from the fund and criteria to be used to selecY projects 'for fundiug. The commissioner shall establish these procedures and criteria in consultafion with representatives appointed by the Association of MinnesoYa Countics, League of Minnesota Cities, Minnesota Association of Townships, and the appropriate state agency as needed. The criteria for determining project priority and the amotimt of a grant or loan musY be based upon consideration oF. (1) the availability oP other state, federal, and local funds; (2) the regional significance of the rouYe; (3) effectiveness of the proposed project in eliminafing a transportafion system deficiency; (4) the number of persons who will be positively impacted by the project; (5) Yhe projecPs contribution to other local, regional, or state economic development or redevelopment efforts including livestock and other agricultural operations permitted after the effecfive date of this section; and (6) ability of the local unit of �overnmenY to adeqiiately provide for the safe operation and maintenance of the facility upoiz project completion. Subci. 6. Administrative cosYS. A sum of 0.25 percent o�FYhe total amount in the fimd, other Yhan amounts deposited in the fund from the proceeds from the sale of state bonds, is available to be used far administrative costs incurred by the deparfinent in carrying out the provisions ofthis section.
