The attached resolution would grant a one year extension to the approvals. Background In March 2007 the City Council approved a PUD amendment, a conditional use permit, and a site plan for an S&C Bank at Almar Village located at Keats Avenue and 70th Street. The project was not constructed during the one-year period during which the approvals are in effect, and S&C Bank has requested an e�ension of these approvals. In the attached letter, the bank president describes that the project was delayed due to the bank being acquired by another bank group. They now plan to construct the bank building during 2008. The City Code ailows extensions of approvals. There are no changes to the project or to the surrounding area which would cause reconsideration of prior approvais. Attached is the report to the City Council on the project in 2007. Stransky, City Cierk EXCERPT FROM UNAPPROVED MINUTES OF THE PLANNING COMMISSION MEETING ON FEBRUARY 25, 2008 6.4 S&C Bank — Extension off Approvais S&C Bank is requesting the City's approval to extend their conditional use permit and site plan review for the construction of a new bank building at 7199 Jorgensen Lane South. Burbank reported that the PUD amendment, conditional use permit, and site plan re- view applications for the S& C Bank project were approved by the City in March 2007. He stated that the bank is proposing to start construction sometime this year, but not before the one-year time period elapses. Burbank explained that the City Code does permit the City Council to grant extensions since no changes were made to the ap- proved development plan. The Planning Commission was asked to make a recommen- dation to the City Council concerning the applicant's request for a one-year e�ension to their conditional use permit and site pian review applications. Thiede asked if anyone wanted to comment on the application. No one spoke in favor or against the request. Q �� Q ,IY,I . Plannina Commission The Planning Commission held a public hearing on the project on February 26 and recom- mended approval of the zoning amendment and site plan. No one appeared at the public hear- Honorable Mayor, City Cou�cil and Ryan Schroeder S&C Bank March 15, 2007 Page 2 of 8 ing to speak on the project. The Commission did recommend that additional brick be added to the e�erior of the proposed building. S&C Bank has revised the buiiding elevations to add brick and comply with the recommendation of the Commission. The Commission also discussed the alignment of the proposed drive-through lanes, but did not recommend any changes to the plan. Public Safety Commission The Public Safety Commission review the plans on February 20. The only comment from the Commission on this project was a question about whether the proposed drive lanes through the Almar Village parking lot wouid still accommodate fuel tanker trucks serving the gas station. This item was addressed in site planning for the project, and tanker trucks will continue to be able to maneuver through the parking lot if the bank project is built. Background The subject property is 0.4 acres in size and is the last vacant parcel in the Almar Village PUD approved by the City Council in December 2001 (Case ZA01-005). Construction was recently completed on the gas station in the northeast corner of the PUD and on Bonngards Family Meats in 4he northwest corner of the PUD. Planning Considerations Document Review The application review comments included in this report are based on the proposed review plans that were submitted to the City on January 22, 2007. Zoning Review The proposed site plan is different from the approved PUD site plan, thus requiring the zoning amendment. In addition to being in conformance with the construction details required under the PUD, the proposed site development is also in conformance with commercial development standards es- tablished by the City. The existing PUD layout for the site is depicted in the section beiow. Site Plan The two existing access drives will connect the site to the adjacent public roadways. The Fire Department has reviewed the access provisions and hydrant location information and has found them to be satisfactory. The proposed e�erior materials for all four Honorable Mayor, City Council and Ryan Schroeder S&C Bank March 15, 2007 Page 4 of 8 sides of the building inciude brick, stone, block, E.I.F.S. and architectural shingles. These mate- riais are consistent with those used in the existing materials in the development and conform to the approved PUD. Based on recommendations of the Planning Commission, the exterior ele- vations have been revised from the initial plans to increase the amount of brick and reduce the amount of E.I.F.S. The trash is proposed to be housed inside the structure. Interior The interior of the building has an efficient compact layout and includes a basement for storage and non-public use. Buildinq Interior First Floor Height The building is in compliance with ordinance criteria and the PUD. Setbacks As proposed, the development is in compliance with all required building and parking setbacks and the original PUD site design, with the exception of the area along the drive-through lane, which bumps out and encroaches past the typical front yard drive/setback area in order to ac- commodate the duai drive lanes. Landscaping and berming in addition to that approved under the original PUD will be required in this area. Parking/Drive-1"hrough Both levels of the building were conservatively included in the parking calculations even though the top floor is on�y open to the public. Based on the City parking criteria, 14 parking spaces are required. Of the required parking, 11 are being provided on this site, and the additional 3 parking spaces for the building is via a cross parking easement with the main retail mall. The distribution of the on-site parking places one standard parking space and one handicapped stall directiy in front of the proposed bank. The drive-through aiso reduces the parking needs of the site. The Public Safety Commission voiced concern about the handicap parking space design, vehi- cle stacking in the drive-through, and how the bank would impact the overall traffic flow of the common access and parking areas on the entire site. The applicant has provided information on actual customer usage of a similarly sized and oper- ated bank located in Stillwater. This information is attached. The information identifies that the average ATM usage to the site was 10 visits per day. The data also identified the number of times there were more than two customers inside the bank and the number of times there were more than two customer vehicles in the drive through. Based on the data the instances of multi- ple vehicles in the drive-through were typically during the lunch and afternoon peak traffic hours, and there were three or fewer stacked vehicles, with two being the common number. Based on this information, the vehicie stacking room in the proposed drive through and the provided parking have been determined to be adequate. The inclusion of the drive-through does neces- sitate the inclusion of an outdoor speaker/intercom system, which was prohibited under the original PUD approval and will be allowed with restriction. The function and reiationship of the building pads, traffic lanes, and parking of the entire PUD were all designed and reviewed as a part of the ariginai approval and should not be negatively impacted by the proposal. Transportation/Access The access to the site is via the existing commercial drive entrances that abut Jorgensen Lane and Keats Avenue. No access issues were identified related to the main access points to the site. Pedestrian Access The proposed project has pedestrian access that meets the building and zoning codes and links with the existing private retail and public sidewalk systems. No pedestrian access issues were identified. The site proposal includes the installation of bench seating areas, which is one of tne original conditions of approvai of the site plan. One additional bench will be required to be in- stalled somewhere along the trailways associated with the PUD. The benches shall meet the City's current bench design standards. Uffilities The public portions of the water and sanitary sewer utilities to the property were instalied as a part of the PUD. The fire hydrant relocation was found to be appropriate. Staff recommends that prior to the issuance of a building permit, some minor modifications be completed to the landscaping plan that was submitted. The changes identified include the inclusion of additionai buiiding perimeter landscaping along the west side of the building and six additional black hills spruce trees adja- cent to the loeding area and area facing the residential units. L 3 Trash Enclosure/Accessory Structure If a trash enciosure is ever placed outside, it needs to be located in an area that is screened from public view and does not hinder vehicular movements on the site. The final construction plans need to submitted in accordance with Title 11-6-3. At-grade mechanical equipment for the building is also required to be screened. No other accessory structures are proposed on the site. Signage The submitted building elevations inciude some details of the proposed sign copy areas for the wall signage. The plans do not depict a freestanding monument sign. The existing PUD ap- proval requires a shared monument sign. This condition will continue with this application. Lighfing A detailed lighting plan was included with the application submittal. WaII lighting and parking lot perimeter lighting are proposed as part of the application. The current city requirements are that all lighting shali be downward directed and shall not exceed one footcandle at the property line adjacent to commercial areas and .5 footcandles at property lines abutting residentiai. Prior to the issuance of a building permit, the applicant shall submit a comprehensive lighting package to the City for review and approval. Parkland Dedication The parkland dedication requirements were satisfied for the site during the initiai platting of the property. Area Charges The area charges triggered by the development of the property were satisfied for the site during the initiai platting of the property. Public Hearing Notices Public hearing notices were mailed to 59 property owners who are within 500 feet of the pro- posed retail development. These notices were mailed on February 14, 2007. The location map shows the 500-foot buffer around the site. Conclusion The site plan application is consistent with the comprehensive plan and is in compliance with the zoning ordinance performance standards, as well as with the City's development policies. Pubiic utilities have been extended to the site to accommodate the proposed development, and the de- velopment of the site will add additionai commercial tax base to the City. I�ecommendation The Pianning Commission recommended approvai of the requests, subject to the following con- ditions: 1. Ali site, landscaping, must conform to submitted pians dated January 22, 2007. All buiid- ing elevations must conform to a revised architectural drawing dated March 14, 2007 2. The original conditions of approval identified in Ordinance No. 698 and Resolution Nos. 01-173 and 01-174 must be complied with. 3. All applicable permits (i.e., building, electrical, grading, mechanical) and a commercial plan review packet must be compieted, submitted, and approved by the City prior to the com- mencement of any construction activities. Final e�erior construction materials and colors must be reviewed and approved by the Planning Department prior to the issuance of a building permit. 5. The grading and erosion control plan for the site must comply with NPDES II Permit re- quirements. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control must be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Controi Planning Handbook" and the conditions stipulated in Title 10-5-8, Erosion Control During Con- strucfion, of the City's Subdivision Ordinance. 6. All curbing for the project must be consistent with the existing curbing in the project. 7. The applicant must provide the City with an as-built survey of all private utilities prior to certificate of occupancy. 8. The applicant wiil be responsible for ensuring that all appropriate stormwater and access cross easement documentation is completed prior to the issuance of any building permits. 9. Prior to the issuance of a buiiding permit, the applicant must submit a comprehensive sign package to the City for review and approval. 10. Prior to the issuance of a building permit, the applicant must submit a comprehensive lighting package consistent with the city redevelopment plan for review and approval. AII outdoor lighting must be directed downward and away from residential property and pub- lic streets and must not exceed one footcandle at the properiy lines. 11. The landscaping plan must be revised to address the items identified in the staff report. Said plan will be reviewed and approved by the Planning Department prior to the issu- ance of a building permit. 12. A bona fide cost estimate of the landscaping improvements must be submitted in con- junction with a letter of credit approved by the City in the amount of 150 percent of such estimate. Upon completion of the landscaping requirements, the applicant must in writing inform the City that said improvements have been completed. The City must retain the fi- nancial guarantee for a period of one year from the date of notice to insure the survival of the plantings, and until the as-buiit utility sunrey has been submitted. No building permit will be issued until the required financiai guarantee has been received and accepted by the City. 13. The amendment to Ordinance No. 698, approving the Planned Unit Development at 70th Street and Keats Avenue, on the property legally described above, is based on the following findings: • The location of the proposed commercial land use is consistent with the Comprehensive Guide plan previousiy adopted by the Council. • The proposed land uses and development standards proposed in the PUD are consistent with the standards that have been discussed for the neighborhood commercial zoning district. s The project building setbacks, road widths, parking areas, utilities, and other proposed infrastructure and buiiding improvements generally meet the city's current development perFormance s#andards. • There is adequate parking and vehicle stacking room for fhe proposed use on the site based on ordinance criteria and monitored use comparisons. • The project meets the goals and policies identified in the comprehensive plan that relate to the estabiishment of neighborhood commercial districts. The ordinance amendment is subject to the following conditions: 1. All site, landscaping, must conform to submitted plans dated January 22, 2007. All building elevations must conform to a revised architectural drawing dated March 14, 2007. Ordinance XXX Page 2 2. The original conditions of approval identified in Ordinance No. 698 and Resolution Nos. 01-173 and 01-174 must be complied with. 3. All applicable permits (i.e., building, electrical, grading, mechanical) and a commercial plan review packet must be completed, submitted, and approved by the Ci#y prior to the commencement of any construction activities. Detailed construction plans must be reviewed and approved by the Building Official and Fire Marshal. 4. Final architectural plans, Iighting details, and exterior construction materiais and colors must be reviewed and approved by the Planning Department prior to the issuance of a building permit. 5. The grading and erosion control plan for the site must comply with NPDES II Permit requirements. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control must be perFormed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Pianning Handbook" and the conditions stipulated in Title 10-5-8, Erosion Control During Construction, of the City's Subdivision Ordinance. 6. All curbing for the project must be consistent with the existing curbing in the project. 7. The applicant must provide the City with an as-built survey of all private utilities prior to issuance of certificate of occupancy. 8. The applicant will be responsibie for ensuring that all appropriate storm water and access cross easement documentation is completed prior to the issuance of any building permits. 9. Priar to the issuance of a building permit, the applicant must submit a comprehensive sign package to the City for review and approval. 10. Prior to the issuance of a building permit, the applicant must submit a comprehensive lighting package consistent with the city redeveiopment plan for review and approval. All outdoor lighting must be directed downward and away from residential property and public streets and must not exceed one footcandle at the property lines. 11. The landscaping plan must be revised and submitted for review and approval by the PBanning Department prior to the issuance of a building permit. 12. A bona fide cost estimate of the landscaping improvements must be submitted in conjunction with a Ietter of credit approved by the City in the amount of 150 Ordinance XXX Page 3 percent of such estimate. Upon completion of the landscaping requirements, the applic�nt must in writing inform the City that said improvements have been completed. The Ciiy must retain the financial guarantee for a period of one year from the date of notice to insure the survival of the piantings, and until the as- built utility survey has been submitted. Blin summarized the staff report and recommended approval subject to the conditions stipu- lated in the staff report. Mark Paschke, Frisbie Architects, River Falls, Wisconsin, stated that the trash will be con- tained within fhe building and the enclosure shown on the site plan is screening for mechani- caI equipment. He also stated that they would incorporate the additional landscaping recommended by staff along the south of the building. Folch stated that she likes the design of the building. She asked about the location of the drive-up ATM and pavement markings for the drive-through. Paschke responded that the ATM would be located in the second drive-through lane. Regarding pavement markings, he stated that they would work with staff to further identify the stacking positions. Thiede also expressed concern about stacking in the drive-through lanes and suggested that the building be turned so the ATM would be on the east side. Paschke stated that proposed configuration helps screen the drive-through Ianes from the public right-of-way. Blin stated that after looking at the number of transactions from another of their branches, staff is com- fortable that the five stacking spaces are sufficient to handle the peak demand at that loca- tion. Thiede asked if building design is a franchise Iayouf. Paschke stated that it is a new layout and not based on a prototype. Scott Johnson, President of the Metro Division of S&C Bank, explained the thought process on how the building was laid out and designed, noting that extending the drive-through to the east would intrude info the landscaping and would significantly affect the turning radius. He stated that they cut off a corner of the building to attempt to make that corner a little smoother. Thiede asked if they were confident that there would not be a back-up in the drive-tnrough lanes. Johnson explained that they did a study at their Oak Park Heights branch, tracking the number of vehicles in their drive-through lanes and looking at a report of their ATM usage, and there were very few times when they had more than two or three vehicles in the drive- through at the �ame time. Brittain opened the public hearing. No one spoke. Brittain closed the pubtic hearing. Blin responded a no left turn sign could be installed at the end of the drive-through lane. Brittain disagreed noting that section of the parking lot is very rough due to the gas tank covers. Bauer expressed concern for about the safety of pedestrians going to the restaurant due to the extra traffic from the bank. Brittain stated that would be a longer route and there could be issues with the gas station traffic. Hale stated that he does not see that this would be a big tra�c issue as the bank is far enough away from the existing businesses. Brittain agreed noting that it could be addressed if it does become a problem in the future. Hale asked if this site would connect to the existing storm sewer. Blin responded that a building had been planned for this site and the storm system was sized to accommodate that. Brittain expressed concern about the e�erior materials, noting that there should be more brick on the building. Thiede agreed, stating that the bank building should look more like the mall than the gas station and meat market do. Paschke stated that those are valid points and stated that they would take into consideration the Commission's comments on their finai design. Brittain recommended that they work with staff on this design prior to the C+ty Council meeting. It was the consensus of the Commis- sion 4hat more brick be added to the exterior of the buiiding to better match the existing mall. Thiede made a motion to approve the applications subject to the conditeons listed below with a recommendafion that the applicant work with staff on changes to the ex- terior elevations to more c/ose/y match the existing mall. Flale seconded. Hale asked if this should be done prior to the City Council meeting or should the designs come back before the Commission. Brittain responded that the recommendation would be that the City Council would make the finai approval of those exterior changes. Hale clarified that the motion should be that the approval is based on revising the exterior of the building prior to the plan being presented to the City Council.
