RE: Hope Community Church — Extension to their Conditional Use Permit
Proposal
Hope Community Church is requesting an extension to their conditional use permit for the con-
struction of a 3,778 square foot addition on the north side of their existing church. The City origi-
nally approved their application on March 15, 2006, and later was granted a one-year extension.
The Church is requesting another extension to their conditional use permit.
Background
The property is located at 8300 Hyde Avenue South. The proposed addition is two stories in
height. The main level is primarily offices, reception area, lobby, conference room, and one
classroom. The lower level provides five additional classrooms. Additional bathrooms, closets,
haliways, elevator, and stairways are proposed on both levels. The gravel parking lot on the
south side of the building would be paved and a stormwater basin was going to be graded in the
southern corner of the lot. Additional landscaping was also proposed on the site. Attached are a
site plan and a copy of the building elevations that were previousiy approved by the City.
The Church has postponed the construction of this project because they are still working to raise
money. They believe it might be one or two years before they could file a building permit
application.
In accordance with City ordinances, a conditionai use permit expires one year after it is granted,
uniess it is made use of within the year. The ordinance does allow for Ionger periods, but City
Council approval is required.
Recommendation
On February 25, 2008, the Pianning Commission reviewed the proposed extension and
unanimously recommended approval of the request. The Commission based this
recommendation on the fact that the plans for the project conform to those previously approved
by the City and all conditions of approval remain in effect.

WHEREAS, Hope Community Church, 8300 Hyde Avenue South, applied for an
amendment to their conditional use permit to allow construction of an addition; and
WHEREAS, the City Council of the City of Cottage Grove adopted Resolution
No. 06-053, which approved the conditional use permit amendment, on March 15,
2006; and
WHEREAS, in accordance with the City Code, a conditional use permit expires
one year after being granted unless it is made use of with the year; and
WHEREAS, Nope Community Church requested and was granted an extension
of the deadline for their conditionai use permit to raise capitai to begin the project
(Resolution No. 06-216); and
WHEREAS, the Church has applied for a two-year extension on their conditional
use permit to allow an addition; and
WHEREAS, the Planning Commission unanimously (7-to-0 vote) recommended
that the two-year extension be granted.
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Cottage
Grove, County of Washington, State of Minnesota, approves extension of Resolution
No. 06-053, which approved an amendment to Hope Community Church's conditional
use permit to construct an addition on the north side of the existing church, to March
15, 2010.

6.5 Hope Community Church — Extension of Approvals
Hope Community Church, 8300 Hyde Avenue South, is requesting an extensioaa to
their conditional use permit for their proposed expansion.
McCool summarized the planning staff report and reported that Planning staff has no
objection to allowing a two-year extension to the conditional use permit as long as
the project is consistent with the plans previously approved by the City Council and
ail the conditions of approval remain in effect.
Folch-Freiermuth asked if it was common for projects to receive City approvals but
not begin construction within one year. McCool said most projects do start construc-
tion within one year; but with this particular project, the Church had not yet reached
their fundraising goal for this capitai improvement and is not sure when they will
being construction in the future.
Thiede asked if anyone wanted to comment on the application. No one spoke in
favor or against the request.
Poncin moved to recommend fo the City Council that a two-year extension to
Hope Community Church's conditional use permit be granted. Seconded by
Whillite. The motion passed unanimously (]-to-1 vote).

Hope Community Church — Amendment to Conditional Use Permit
Vanman Architects & Builders, Inc., on behalf of Hope Community Church, have applied for an
amendment to Hope Community Church's conditional use permit to construct a 3,778 square
foot (foundation footprint) addition on the north side of the existing church. The proposed addi-
tion is two-stories in height. The main level would be primarily offices, reception area, lobby,
conference room, and one classroom. The lower level provides five additional classrooms.
Additional bathrooms, closets, hallways, elevator, and stairways will be pravided on both levels.
The gravel parking lot an the south side of the buiiding wiil be paved, a stormwater basin will be
graded in the southern corner of the lot, and additional landscaping is also proposed on the site.
The totaf number of paved parking spaces is 139 with an additional 46 spaces that aouid be
constructed in the future. A copy of the site plan is attached as Exhibit A.

Planninq Commission
The Pfanning Commission held the public hearing at their meeting on Monday, February 27. No
public testimony or written comments were received at this meeting. The Planning Commission
unanimously recommended approval of this conditianal use permit amendment based on

conditions listed in the draft resolution. An excerpt from the unapproved Planning Commi�sion
minutes is attached.
Public Safetv Commission
The Public Safety Commission made no comments on this application at their February 21,
2006, meeting.
Background
In 1983, the City approved the construction of a second floor to the church building and a new
parking lot on the north side of the church buiiding. The new floor provided sanctuary seating for
400 people. A portion of the church building was converted to a school facility for students from
kindergarten through 12th grade. The classrooms are primarily in ttre lower level of the building.
The private school provides an education curriculum for approximately 60 students.
Planning Considerations
Ordinance Criteria
The property is zoned R-3, Single-Family Residential District. Churches and schoois are allowed
as conditional uses. The minimum building setback for aIl church 6uildings is 50 feet from resi-
dential uses. All building and parking setbacks for this property is greater than city ardinance
minimum requirements.
Modifying the original conditional use permit approvai requires city review and approval. City
Gode requires that certain criteria must be met before the City Council grants a conditional use
permit:
1. The use must conform with the Gity°s Comprehensive Plan and with the purpose, intent
and applicable standards of zoning ordinance requirements.
2. The use must be focated, designed, maintained, operated and compatible with the exist-
ing or intended character of the zoning district it is located in.
3. The use should not depreciate values of surrounding property.
4. The use cannot be hazardaus, detrimental or disturbing to present and potential sur-
rounding land uses due ta noises, giare, smoke, dust, odor, fumes, water pollution, vibra-
tion, generai unsightiiness or other nuisances.
5. The use must not excessively generate vehicular traffic on local streets as defined by the
transportation element of the Comprehensive Pian. The use must not create traffic con-
gestion, unsafe access or parking needs that wili cause inconveniences to the adjoining
properties.
6. The use must be served adequately by essentiai public services, such as streets, police,
fire protection and utilities.
7. The use must not create excessive additional requirements at public cost for pubiic facili-
ties and servicss and must not be deTrimental to the economic welfare of the City.
8. The use must preserve and incorporate the site's important natural and scenic features
into the development design.
9. Tfie use must not cause significant adverse effects to the environment.

14. The use must not adversely affect the potential development of adjacsnt vacant land.
The existing and current proposal meets the 10 general criteria for granting a conditional use
permit.
Properly Characteristics
This parcel is approximately 3.9 acres in size. It has 600 feet of frontage along Hyde Avenue
and 209 feet along Hemingway Avenue. Two private access drives connect to Hyde Avenue.
The north access drive leads to the main parking lot (north) that has 117 parking spaces. A
landscape is)and exists at the west and east ends of the 46 parking spaces centered in the north
parking lot. The south access drive leads to a gravel parking lot (south) that appears to be
occasionally used for parking. A 26-foot by 26-foot detached garage and dumpster enclosure is
located at the west end of the north parking lot. A copy of the properry's existing conditions is
shown on the Certificate of Survey, which is attached as Exhibit B.

Architecture
The existing church building was constructed mostly with a gray concrete block that has a verti-
cal rock-exposed rib. Off-white colored stucco accents the pillars and ends of the gable roof
structure. Windows are provided on the north and south sides of the building.
The proposed two-story addition is on the north side of the existing building. The exterior of the
new addition is primarily a stucco product that will be painted to match the off-white and gray
exterior colors of the existing building. Windows will be installed on both levels. The roof for the
proposed addition will be primarily flat, although there is a gable roof that will extend from the
main entrance to the gable roof on the existing structure. The architect attempted to mimic vari-
ous architectural features of the existing buiiding into the proposed addition, but the biggest ob-
stacle was the roof.
The proposed addition wili be approximately 132 feet from the north property line, which is about
40 feet closer than the existing building. The new addition wiil also be about 84 feet away from
the east property line (Hyde Avenue), which is 10 feet closer than the existing building. The floor
plan and e�erior 2levations for the proposed addition are attached as Exhibits C, D, and E.
Nonconformities
Two free-standing signs exist on the property. City ordinance only allows ane free-standing sign
for churches and schools. The total number of free-standing signs violates city ordinance limita-
tions, but the cumulative square footage of both signs appears to be less than the 5d square
feet allowed by city ordinance.
Forty-five trees and 60 shrubs are proposed to be planted, which doubles the number of tree
plantings existing on the property. The appiicant has submitted a revised landscaping plan that
added 10 trees and 20 shrubs. These additional trees and shrubs will be planted east of the
existing church.
The gravel surfaced parking lot will be replaced with bituminous surface and concrete curbing.
Utiti#ies
The property is in the Metropoiitan Urban Service Area (MUSA). City water and sanitary sewer
services were extended to the existing structure at the time this particular neighborhood devel-
oped.
There are two city fire hydrants along the church's frontage along Hyde Avenue. A third fire hy-
drant is at the northeast corner of the Hyde Avenue and Hyde Court intersection. These fire hy-
drants provide coverage of the existing church structure and proposed addition. The existing
ci�urch building has a fire suppression system and the new building is proposed to be sprinkletl
with a similar fire suppression system.
A utility easement 95 feet wide exists afong the north side of the property. Within this easement,
there is an overhead utility line. A 10-fioot wide drainage and utility easement also exists along
the church's southwesterly property boundary line. There is alsa an overhead utility line within
this easement. The proposed addition and parking !ot improvemenfis vviil not afFect any of these
easements or existing utilities.

Parking
The south gravel parking Iot will be removed and a new hard-surfaced parking Iot will be con-
structed. Stormwater runoff from this parking lot wili flow to the stormwater basin south of the
parking lot. A private storm sewer pipe will connect the basin to the city's storm sewer system. A
g� plan showing the on-site stormwater detention basin is shown in Exhibit F.
Based on the seating capacity of 486 people in the church sanctuary, a minimum of 139 parking
spaces is required. The number of paved parking spaces proposed on the church site is 139
spaces. Parking for school activities during the week is adequately provided in both parking lots
and adequately provided for church services and related functions on the weekends. The site
plan also shows the ability to add an additionai 46 parking spaces in the event more parking is
needed on-site.
Five new light fixtures mounted on 20-foot tail poles wili be installed on the perimeter of the
south parking lot. Each light fixture is a"shoe-box" designed fixture, which directs lighting
downward. The applicanYs consultant did prepare a light distribution plan. This plan shows the
outer limits of a 0.5 foot-candle and 1.0 foot-candle casting �or each light pole. The result of this
distribution pian shows the 0.5 foat-candle casting not extending beyond the Church's property
boundary Iine and therefore complies with city ordinance requirements.
Landscaping
There are six trees within the boulevard area along Hyde Avenue and three along Hemingway
Avenue. A few other trees, shrubs, and other landscaped features exist internally to the site, but
the overail numbers of plantings do not comply with today's minimum ordinance requirements.
With the construction of the proposed addition and relocated south parking, seven trees will be
removed. The shrubs a(ong the north side of the building will also be removed.
The church is proposing to plant 55 trees and 80 shrubs on the property, Most of the trees will
be planted on the north and south sides of both parking lots. in most cases, the new trees wilB
be befween abutting residentiai properties and the church's parking area. Their revised
landscaping plan proposes ten additiona( trees in the front yard east of the church building and
twenty additional shrubs along the east foundation of the existing building. A copy of the revised
landscape plan dated February 23, 2006 (Exhibit G) shows the location of these plantings.
Public Hearing Notices
Public hearing notices were mailed to 40 property owners who are within 500 feet of the subject
property. These notices were mailed on February 15, 2006. The location map shows the 500-
foot buffer around the site.
The Church held an information meeting on February 1J. Three neighboring property owners
attended this meeting. The applicant reported that a�l three residents had positive camments nn
their proposed project and iandscaping improvements.

A RESOLUTIOfV APPROVBNG AN AMEPIDMENT TO HOPE COMMUNITY CHURCH'S
CONDITIONAL USE PERMIT TO ALLOW AN ADDITION TO THEIR BUILDING AND
PARKING LOT AT 8300 HYDE AVENUE SOUTH
WHEREAS, Vanman Arcnitects & Builders, on behalf of Hope Community Church, appiied
for an amendment to their conditional use permit to allow an addition to their building and park-
ing Iot, located on the property Iegally described as:
Outlot 1, Thampson Grove Estate 1st Addition, Washington County, Minnesota.
Commonly known as 8300 Hyde Avenue South, Cottage Grove, Washington
County, Minnesota.
WHEREAS, public hearing notices were mailed to properry owners within 500 feet of the
property and a public hearing notice was published in the South Washington County Bulletin; and
WHEREAS, the Planning Commission held a public hearing on February 27, 2006; and
WHEREAS, a planning staff report, which detailed specific information on the property and
the application request, was prepared and presented; and
WHEREAS, the public hearing was open for public testimony and no one spoke for or
against the appiication. The applicant was prasent at the meeting; and
WHEREAS, #he Planning Commission unanimously approved the appBication, subject to
certain conditions listed below.
NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove,
Washington County, Minnesota, nereby approves the amendment to Hope Community Church's
conditionai use permit and development plans dated January 23, 2006 ta allow an addition to
their building and parking lofi, on the property legally described above, subject to the following
conditions:
1. All appiicable permifs (i.e., buiiding, electrical, etc.) must be applied for and issued
by the City prior to any work or construction taking place.

2. A right-of-way permit must be obtained from the Public Works Department for re-
moving the existing driveway and the construction of a new driveway.
3. All landscaping improvements as proposed on the revised landscaping plan dated
February 23, 2006 must be installed before a"certificate of occupancy" is issued
for the new addition.
4. Construction equipment, construction trailer, trailers, or construction materials are
prohibited from parking or being stored on Hyde or Hemingway Avenues.
5. All outdoor lighting must be directed downward and away from abutting property
owners. Reflected glare of spill light must not exceed five-tenths (0.5) foot-candle as
measured on the property line.
6. The grading and erosion control plan for the site must comply with NPDES II Per-
mit requirements. Erosion control devices must be installed prior to commence-
ment of any grading activity. Erosion control must be performed in accordance
with the recommended practices of the "Minnesota Construction Site Erosion and
Sediment Control Planning Handbook" and the conditions stipulated in Title 10-5-
8, Erosion Control During Construction, of the City's Subdivision Ordinance.
7. A final grading plan, stormwater calculations, and starmwater quality calculations
must be submitted to the City Engineer and South Washingtan Watershed District
for review and approvat before a building permit wil( be issued.
8. AII curbing for the project must be 8618 concrete design and the concrete drive
aprons compliant with city standards.
9. A bona fide cost estimate of th� landscaping improvements must be submitted in
conjunction with a letter of credit approved by the City in the arr2ount of 150 per-
cent of such estimate. Upon completion of the landscaping requirements, the ap-
plicant musfi notify the City that said improvements have been completed. The City
will retain the financial guarantee for a period of one year from the date of notice to
insure the survival of the plantings. No building permit must be issued until the re-
quired letter of credit has been received and accepted by the City.
10. Aii ground-mounted mechanicai equipmenfi accessory to the principal structure over
30 inches or greater than 12 cubic feet shall be screened from public views with
landscaping, berming, or a screen wallffence. Screening materials must be similar to
or compatible in design and color with those used on the principal structure. Screen-
ing material may include property maintained wood, vinyl, or metal screens or
fencing as required in Title 11-6-4(3) of the City Codes.
11. The applicant must compiy with all city ordinances and policies.
12. The applicant must remove the abandaned access drive connecting to Hyde Ave-
nue once the new private access drive to the new south parking iot is constructed
and open for access.

13. A system for improving stormwater quality before leaving the site must be
provided.
14. The Church is responsible for the cost of instal�ing a"STOP" sign at the new pri-
vate access drive for the south parking lot. The "STOP" sign must be 10 feet from
the roadway edge and 2 feet from the driveway edge. The bottom of the sign must
be 6 feet from the ground. The "STOP" sign must be a 30-inch sized sign having a
high intensity reflective face. Said sign should be mounted on a six-foot No. 3 and
eight-foot No. 2 steel post. The applicant may request the City's Public Works De-
partment to instail this sign, but must reimburse the City for actual costs incurred
by the City.
15. The storm sewer pipe between the stormwater basin in the southeast corner of the
site and the city's storm sewer system must be a concrete pipe and the velocity
within this private storm sewer pipe must not exceed 10.0 feet per second.
16. An iniet structure and buried storm sewer pipe must be constructed between the
southeast corner of the south parking lot to the stormwater basin. Rip-rap material
must be installed at the outlet of this private pipe.
17. A set of "as-builY' drawings for the private starm sewer system and drainage basin
must be submitted to the Public Works Department before a Gertificate of Occu-
pancy for the new building addition is issued by the City.
18. The design requirements stipulated in Bonestroo, Rosene, Anderlik & Associates
Ietter dated February 8, 2006 must be addressed and accurately depicted on the
revised grading and drainage plan. The City Engineer must approve the revised
grading and drainage pian before a building permit will be issued.

Hope Community Church has applied Sor an amendment to their conditionai use permit
to allow an addition to their building and parking lot located at 8300 Hyde Avenue South.
McCool summarized the staff report and recommended approval subject to the conditions
listed in the staff report.
Steve Wallich, Vanman Architects a�d Builders, Golden Valley, pointed out that the site plan
shows a proposed expansion for future parking to the north, a proposed pond in the north-
west corner, and an area to the south for an additional 13 parking spaces. He explained that
the improvements inciude changing the main entrance to the building on the north by moving
the steps inside and adding an elevator for wheelchairs, which would make the buiiding
handicapped accessible. The building will also be fully sprinkled.
Hale asked where the additional proposed 13 parking spaces, iniet structure, and buried
storm sewer pipe would be Iocated. McCool pointed to the locations on the map and ex-
plained how the storm sewer system would operate. Hale asked if the main entrance would
be changed. McCool stated that the south entrance wouid be closed and relocated ta the
north. Hale then asked about the west entrance to the building. Wallich stated that the west
door remains as is and there is a fire exit from the lower level.
Thiede asked if the appiicants had any objections to the lighting requirements in condition
#5. Wallich responded no.
Bauer asked about the minimum landscaping requirements for this site. McCool responded
that staff did not do the calculations for the entire site, but are asking for additional land-
scaping to bring the parcel closer to current ordinance requirements, which is the city's policy
when existing properties upgrade or expand.
