WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held thereon the 17 day of February, 2010, at which all persons desiring to be heard were given an opportunity to be heard thereon. WHEREAS, the City desires to assess the cost of said improvements to all benefited properties; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF COTTAGE GROVE, MINNESOTA: Such improvement is necessary, cost - effective, and feasible as detailed in the feasibility report. The improvement shall include road rehabilitation, trail, turn - around, storm sewer, and quiet zone. 2. Such improvement is hereby ordered. Short Elliot Hendrickson is hereby designated as the engineer for this improvement. The engineer shall prepare plans and specifications for the making of such improvement. 4. The city council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bond. Adopted by the council this 17 day of March, 2010. Hold Public Hearing 2. Order Project 3. Authorize Preparation of Plans and Specifications Background This pavement management area has been identified for reclamation since the adoption of the Pavement Management Program in 1994. The projects identified in the 1994 report were then programmed into the Capital Improvement Program (CIP) and have been reviewed annually. The area identified as the 2010 Pavement Management Area, River Acres District H, had been delayed a few years because the 2008 Pavement Management Project scheduled ahead of it was delayed. The project was also delayed an additional year to better evaluate the PFC private well contamination issue, which could have affected the project. Since 1994, there have been 51.26 miles of streets rehabilitated. Please see the enclosed map titled Pavement Management Projects. As part of the pavement management history, 4542 properties have been assessed for improvements since the start of Pavement Management in 1994. In 1989 the City paved 113 Street based upon a petition submitted by the residents. The road was paved in one lift of bituminous approximately 2" thick. The assessment was adopted on November 1, 1989 and twenty -five residents were assessed $765.68 each for the improvement. Project Development On October 21, 2009 the City Council authorized that a feasibility report be prepared for the 2010 Pavement Management Area. The 2010 Pavement Management Area is for the River Acres Area, known as District H, as established by the 1994 Pavement Management Program. The City Council held a workshop session on December 2, 2009 to discuss the various elements of the proposed improvements. The workshop session provided the necessary guidance to define the scope of the improvements. A neighborhood meeting was held for the proposed area on January 7, 2010 at 7:00 p.m. at City Hall. The meeting was attended by approximately 61 individuals. A presentation was made covering the history of pavement management in the community, the proposed scope and cost of the project, a project schedule and process for the improvements, and how the assessment process works. There were also two separate meetings held on the 7 th with residents that live on the two private roads, one at 6:00 p.m, and one at 6:30 p.m., that allowed time to discuss more specific and relevant issues to the unique situations each road segment presents. Streets The streets in the pavement management area were originally constructed in the 1960's. The width of the streets range from 19 feet to 24 feet; the proposed improvements do not recommend widening of the bituminous surface. The pavement has deteriorated to the point where crackfilling, patching and overlays are no longer feasible to improve the condition and life expectancy of the pavement. The question has been asked, why not seal coat the road rather than reclaim. The answer to that question is that the roads have deteriorated beyond the point that a seal coat application would work. Seal coating would not improve the condition of the street because the problems are with drainage, potholes, large block cracking, substantial alligator cracking, and age related bituminous deterioration. The road condition is poor and would not warrant spending dollars on a future sealcoat for the roadway if the project does not move forward. Another question raised at the neighborhood meeting was how much it costs to maintain the roads in the River Acres area. The annual cost to maintain the roads over the last ten years has been approximately $19,100. Over the last ten years the total cost to maintain the roads was $191,000. This cost will continue to increase annually due to the deterioration of the pavement and the continued maintenance efforts to address the washouts on Inman Avenue. A bituminous trail is proposed on Ideal Avenue from 110" Street to 113 Street on the east side of the roadway within the existing right -of -way. The project will also include a turn - around on River Acres Road to allow vehicles to travel north following the quiet zone construction. Funding & Cost Analysis: The street cost portion of the project totals $1,415,767.25. The assessed amount would be 45% or $637,095.31. The approximate cost of the assessment for this portion would be $5,397.18 per parcel. The remaining 55% or $778,672.04 is from the property tax levy. Storm Sewer The proposed drainage improvements consist of installing storm sewer with proposed concrete curb and gutter along Inman Avenue and also a series of rain gardens at a low spot along 113 Street located between 113 Street Court and Inman Avenue. There will also be miscellaneous driveway culvert repairs done and ditch work as part of the project to help facilitate proper drainage. Funding & Cost Analysis: The storm sewer cost portion of the project totals $230,355.84. The assessed amount would be 45% or $103,660.13. The approximate cost of the assessment for this portion would be $878.16 per parcel. The remaining 55% or $126,695.71 is from the Storm Water Utility Fund. 2 Quiet Zone The construction of the quiet zone will consist of constructing a concrete curb and gutter median section for 100 feet north of the railroad intersection and approximately 70 feet south of the railroad intersection. The concrete median, along with railroad crossing gate arms, will provide a barrier so that cars cannot maneuver through the intersection when a train is present. Once the median is constructed and approved by the railroad, the train horns will no longer have to be sounded at the intersection. The total cost of the quiet zone is $28,600. According to the City's policy, 45% of the total project is assessed against the benefiting properties. The total project value that is assessed is $12,870.00. The average assessment per parcel is an additional $247.50. Approximate Total Assessment Value per Parcel: $6,275.34 - $6,522.84 for road, storm sewer, trail, quiet zone and turn - around. Staff is providing Council with various project options as follows: A. Determine if we proceed to bid on the entire project (Option #1 -YES) (Option #2 - NO) B. If Council determines to proceed, determine if 110 Street is included (Option #7) (yes /no) P C. If Council determines not to proceed with the full build project then it should individually consider project components as follows: 1. Quiet Zone (Option #3) (yes /no), if yes then must do Option #5. 2. Stormwater Improvements (Option #4) (yes /no) 3. Turn - around (Option #5) (yes /no) 4. Trail (Option #6) (yes /no) Options on how to proceed: Option #1 Order the Project Following the Public Hearing, the next step would be to Order the Project and authorize the preparation of plans and specifications. The project has been found to be necessary, cost - effective and feasible. The total project cost for the road work, storm sewer, and trail is $1,646,123.19. According to the City's policy, 45% of the total project is assessed against the benefiting properties. The total project value that is assessed is $740,755.44. The average assessment per parcel is $6,275.34. Since this area has many unique lot characteristics, the preliminary assessment roll is enclosed for review, on a parcel basis. The total cost of the quiet zone is $28,600. According to the City's policy, 45% of the total project is assessed against the benefiting properties. The total project value that is assessed is $12,870.00. The average assessment per parcel is an additional $247.50, bringing the total assessment for a resident who benefits from the quiet zone to $6,522.84. A benefit appraisal was conducted for eight properties within the project area. The agriculture parcels were appraised according to the City's policy and the value of the special benefit appraisal was used to determine the proposed assessment. It should be noted that the 42.80 acre parcel that is adjacent to Ideal Avenue was found to have no special benefit from the project. Based upon this determination, the overall value of the assessments for the remaining parcels in the project area experienced an increase. Currently the bidding environment is favorable, which could benefit the total project cost. The Council still has the ability to reject the bids if they are unfavorable or not within the engineer's estimate. An example of a favorable bidding environment is in the price of bituminous. The engineer's estimate assumed a bituminous bid price of $70 /ton, for a total cost of $512,750 for the bituminous work. The tables that follow show how the cost of the bituminous varies based upon the unit price per ton and what the potential savings for residents could amount to this year. As shown, residents could benefit by a savings of 9.5% if the bid for bituminous comes in at $55 /ton. In today's bidding environment there has been a project with bituminous as low as $35/Ton, which is exceptionally low and not to be expected. Also, the quantity of bituminous in 2008 was much higher than what is proposed in 2010, which would cause the bituminous price to also be higher than in 2008. Advantages of proceeding with the project: 1. Positive bidding environment provides the potential of cost reduction from engineer's estimate; this positive environment will likely be of limited duration. 2. Provides the opportunity to address neighborhood /individual requests for quiet zone, turn - around, trail and storm water enhancements beyond simply replacing pavement. 3. Reduces short and intermediate term maintenance efforts by City forces. 4. Improves the driving surface. 5. According to the benefit appraisal the project provides for a property value benefit beyond the individual parcel cost of the project. 6. Enhances safety for pedestrians to utilize a trail on the east side of Ideal Avenue, which is a 50 mph roadway. 7. Proceeding with the project is consistent with the Pavement Management Plan outlined in 1994. Disadvantages of proceeding with the project: 1. Taxpayer will be subjected to shouldering 55% of the project cost. 2. Individual property owners will be subjected to shouldering 45% of project cost. Please see advantages and disadvantages under Option #1. Option #3 ONLY Quiet Zone Improvements The issue of the quiet zone at the BNSF railroad crossing has been discussed for a number of years. The quiet zone construction would allow for the trains not to blow their horns when passing through the intersection. The residents in the area provided the City with a petition for the improvements. The total project cost for the quiet zone improvement is $28,600. The total assessment amount is $12,870 based upon 45% assessed to benefiting properties. The overall benefit of the quiet zone would be assessed against 52 properties in the project area (only parcels with homes). Please refer to the map titled Proposed River Acres Pavement Management Project — Quiet Zone Area. The value of the assessment to the benefiting properties would be $247.50. Option #4 ONLY Storm Sewer Improvements The storm sewer improvements revolve around two main issues: washouts on Inman Avenue and the poorly draining area on 113 Street between 113 Street Court and Inman Avenue. The total project cost for storm sewer is $230,355.84. The total assessment amount is $103,660.13 based upon 45% assessed to benefiting properties. The overall benefit of the storm sewer improvements would be assessed against 68 properties in the project area. Please refer to the map titled Proposed River Acres Pavement Management Project— Storm Sewer Area for a visual representation of the benefiting parcels. The value of the assessment to the benefiting properties would be $1,524.41. The benefiting properties were determined based upon the drainage area and the poor roadway condition created by the drainage problems and those that need to utilize the roadway to access their property. It should be noted that a grant was submitted to the South Washington Watershed District for this improvement element. Option #5 ONLY Turn- Around Improvement The turn - around improvement would relocate the existing bus turn - around from the area north of the railroad tracks to the area shown by lot number 136. The bus turn - around would not be able to exist in its current location if the quiet zone were constructed. If the quiet zone was not constructed, there is still benefit to the lower district, as buses would then be able to pick up students on the river side of the railroad tracks, which currently does not occur because of the lack of a turn - around. The turn - around would also provide for a location for delivery truck turn- around. The total project cost for the turn - around improvement is $81,510. The total assessment amount is $36,679.50 based upon 45% assessed to benefiting properties. The overall benefit of the turn - around would be assessed against 71 properties in the project area. Please refer to the map titled Proposed River Acres Pavement Management Project— Turn - Around Area. The value of the assessment to the benefiting properties would be $516.61. This was determined by the necessity of moving /relocating the existing bus turn - around, which services both the upper and lower district area as shown on the referenced map. Option #6 ONLY Trait Improvement The proposed trail improvement is adjacent to Ideal from 110 Street to 113 Street. The total project cost for the trail improvement is $71,500. The total assessment amount is $32,175 a based upon 45% assessed to benefiting properties. The overall benefit of the trail would be assessed against 127 properties in the project area. Please refer to the map titled Proposed River Acres Pavement Management Project— Trail Area. The value of the assessment to the benefiting properties would be $253.35. Option #7 NOT Include 110 Street in the Project Residents along 110 Street have signed a petition requesting not to be included in the project area, please see the enclosed map outlining the properties included on the petition. The roadway in question has only had two sealcoat applications applied to it, it has never received an actual lift of bituminous. So the residents that live along the street have never paid for a street that is actually built to City standards. Past practice has shown that only one time has an area been excluded from a pavement management area. If 110 Street is left out of the project, there is less economics in the bidding environment, now and in the future, for the project. This means that residents in the remaining 2010 Pavement Management Area will now pay $50 more on their assessment because this roadway and benefiting properties will not be contributing to the project financially. Currently, even though the road was never built to the City's standard specifications, the City is still subsidizing the project by 55 %. According to the IMTF policy, Section 5.3.2, the project should not receive subsidizing, because it was never constructed to the City's standard rural road section. So the residents should be paying 100% for the road project, since they never paid for a paved surface. In the future, it would be questionable if the City would subsidize 55% of the project, as part of another Pavement Management project. Council may choose any combination of Options #347. It should be noted per Minnesota State Statute 429.031, the resolution must be adopted by four -fifths vote for the project or any option elements to be ordered. Mairter€ance on our type of road is cisy and cheap cornpared to bituminous streets. Because we believe that having a bituminous surface would give neither residents of 110 nor the City of Cottage Grove any benefit over the surface we currently have, we respectfully ask shai the Pavement Management Project he sealed back to not include I 10 St. S. Unfortunately, this is as far south as the pathway exists. The residents of House's Island View, south part of Gilmer's Addition, and River Acres are requesting a continuation of the bike and walking path on the east side of Ideal Avenue starting from 110 Street and continuing on to 113 Street. Our neighborhood consists of 95 households south of 110 Street. They live on 113" St, 113 St Ct, Inman Ave, 115 St, and River Acres Road. All must drive on Ideal Ave between 100 Street and 113 Street to enter and exit the neighborhood since no other route exists. The speed limit is 50 miles per hour on Ideal Avenue, a number of our residents walk, run, bike, rollerblade, or practice cross country skiing along Ideal Ave. They do so safely on the paved pathway south of 100 Street but they do so unsafely on the road south of 110 street sharing the road with traffic. This is a dangerous situation that our neighborhood - residents would like to have resolved by extending the trail to 11 3t Street. Since we have no other amenities here other than that trail to use, there are no driveway accesses that would conflict with this trail, and there is enough right -of -way between the tree line and the road to put in a trail, we are requesting an extension of that pathway. We understand that the Cottage Grove City Council will be discussing the 2010 Pavement Management Project in our area during the month of October. Even if the city does not carry forward the Pavement Management Project for 2010 we are requesting that you still pursue the trail project in 2010.
