Discussion The Environmental Task Force was established in May 2009 and has since studied the 3M Incinerator as well as other air emissions and water quality issues. At the January 23 City Council goal setting session, it was determined that the Task Force should become an ongoing City advisory commission. Attached is an amendment to the City Code which establishes the Commission. It is proposed that the commission will meet on the second Wednesday of each month and the meetings will be televised. Action should also be taken to appoint the existing Task Force members to the Commission. As with most other City Commissions, members would eventually be appointed for two -year terms. To avoid having all terms end at once, it is suggested that initial terms be staggered for one, two, and three year periods. Task Force members have been asked for their preferred term length. AN ORDINANCE FOR THE CITY OF COTTAGE GROVE, MINNESOTA, ADDING TITLE 2, SECTION 2 OF THE COTTAGE GROVE CITY CODE ESTABLISHING AN ENVIRONMENTAL COMMISSION The City Council of the City of Cottage Grove, Washington County, Minnesota, does hereby ordain as follows: SECTION 1. AMENDMENT `The Code of the City of Cottage Grove, County of Washington, State of Minnesota," shall be amended by amending Title 2 -1 -1 to read as follows: 2 -1 -1: ESTABLISHMENT OF BOARDS AND COMMISSIONS The following boards and commissions are hereby established. Each board and commission shall have the powers and duties set forth in this Title: A. Human Services /Human Rights Commission. B. Parks, Recreation and Natural Resources Commission. C. Planning Commission. D. Public Safety, Health and Welfare Commission E. Public Works Commission F. Environmental Commission SECTION 2. AMENDMENT `The Code of the City of Cottage Grove, County of Washington, State of Minnesota," shall be amended by adding Title 2 -8 to read as follows: 2 -8 -1: PURPOSE. The purpose of the Environmental Commission is to assist and advise the Mayor, the City general well - being, and physical health of its citizens. 2 -8 -2: DUTIES. A. The Environmental Commission will advise the City on issues stemming from data assembled by and released from the following organizations: 1. Environmental Protection Agency (EPA) such as Toxic Release Inventory Data (TRI); 2. Minnesota Pollution Control Agency (MPCA) 3. Minnesota Department of Health (MDH) 4. The Minnesota Department of Natural Resources (MDNR) or 5. Any other Federal or State agency tasks with addressing environmental issues as they relate to health and safety. Ordinance No. XXX Page 2 B. The Environmental Commission shall seek to advise the City on issues of environmental equity, environmental safety and environmental health. The Commission will: 1. Act as a conduit for information and education of Cottage Grove residents and government officials on issues affecting the City's environmental health and well - bein 2. Act as an advocate for the environmental cleanup and prevention of pollution within the City; 3. Promote sustainable development in Cottage Grove and sustainable City operations. 4. Act in partnership with other agencies and organizations to promote policies and practices that impact the well -being of Cottage Grove residents; 5. Act in partnership with other agencies and organizations to promote policies and practices that impact the sell -being of Cottage Grove businesses; 6. Act as environmental ambassadors to promote Cottage Grove as forward thinking and acting on environmental issues 7. Advise the Mayor and City Council on proposed legislation and policies that impact Cottage Grove and its environment; 8. Advocate for the full enforcement of environmental laws 9. Engage in public and community relations activities; 10. Recommend annual goals and an annual Environmental Action Plan for the City of Cottage Grove. 2 -8 -3. QUALIFICATIONS OF MEMBERS Membership of the Environmental Commission shall reflect a diversity of viewpoints regarding the appropriate level of environmental regulation in the City of Cottage Grove. Commissioners shall be persons actively engaged in or familiar with activities and /or programs relating to improving the environmental and environmental health of Cottage Grove and its residents. SECTION 3. EFFECTIVE DATE This ordinance shall be in full force and effect from and after its passage and publication according to law. Passed this 17th day of February 2010. XXX BY TITLE AND SUMMARY WHEREAS, the City Council of the City of Cottage Grove adopted Ordinance No. XXX, which amends City Code Title 2, Section 2 relating to establishing an Environmental Advisory Committee; and WHEREAS, Minnesota Statutes, Section 412.191, subd. 4 allows publication by title and summary in the case of lengthy ordinances; and WHEREAS, the City Council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Cottage Grove, County of Washington, State of Minnesota, that the City Clerk shall cause the following summary of Ordinance No. XXX to be published in the official newspaper in lieu of the entire ordinance: Public Notice The City Council of the City of Cottage Grove has adopted Ordinance No. XXX. This ordinance amends City Code Title 2 -1 -1, Establishment of Boards and Commissions; and adds Title 2, Chapter 8, Advisory Commission on the Environment. This amendment established a new commission, the Advisory Commission on the Environment. The entire text of Ordinance No. XXX is available for inspection at Cottage Grove City Hall during regular business hours and is posted at the Washington County Park Grove Library. BE IT FURTHER RESOLVED that a complete copy of the ordinance is kept in the City Clerk's office at City Hall for public inspection and a copy of the ordinance will be posted on the Public Notice Bulletin Board at City Hall, 7516 — 80th Street South.
