Re: AWAIR Safety Manual Amendment
The City employs many seasonal and part -time employees throughout the year. A
majority of those employees are 18 years of age or older. However, some are not. Staff
discussed amending the AWAIR policy to prohibit employees under the age of 18 from
driving City vehicles or driving his /her own personal vehicle for City business. It was also
discussed that some positions, where the employee may be over 18 years old, do not
need to be driving to fulfill the essential functions of their positions. Staff brought this to
the Central Safety Committee and they were in agreement with this proposal.
DISCUSSION
Staff and the Central Safety Committee are recommending adding some new language
to the AWAIR Safety Manual. Below is the proposed addition and change to the AWAIR
Safety Manual:
Article V; Section D. Driver Eligibility
Drivers of City -owned vehicles or a personal vehicle used on City business operated on the public
roadways shall have a valid driver's license. Employees under the age of 18 even if they have a
to the City outweighs the perceived benefit.
If an employee's driver's license is suspended, revoked, cancelled or restricted by the State
issued, or if an employee has a medical condition that would restrict their ability to safely operate
a vehicle, the employee must immediately notify their supervisor. The supervisor and Safety
Coordinator ter will review the driving record or medical information
and make a determination on eligibility to operate a vehicle in the course of their employment. If
the City learns an employee has not complied with the above reporting requirement, appropriate
disciplinary action will be handled through the disciplinary procedures identified in the employee's
union contract and /or the City's personnel policy.
Each employee's driving record shall be obtained and reviewed before an employee begins
employment and only for positions where driving a vehicle are an integral element of the job.
REQUESTED ACTION
Adopt the following Resolution to amend the AWAIR Safety Manual
REDUCTION (AWAIR) PROGRAM SAFETY MANUAL; AMENDING
RESOLUTION NO. 1
WHEREAS, in compliance with Minnesota Statutes 182.652, the
Minnesota OSHA, "A Workplace Accident and Injury Reduction Act" (AWAIR),
the City Council adopted a new Employee Safety Manual on May 21, 2003, now
THEREFORE BE IT RESOLVED, by the City Council of the City of
Cottage Grove, County of Washington, State of Minnesota, to amend Article V,
Section D of the AWAIR Employee Safety Manual to read as follows:
Article V; Section D. Driver Eligibility
Drivers of City -owned vehicles or a personal vehicle used on City business operated

of 18 even if they have a driver's license, shall not drive City -owned vehicles or
personal vehicles used on City business. The City Administrator also has the
authority to prohibit employees in certain positions from driving City -owned vehicles
or driving personal vehicles on City business if the liability exposure to the City
outweighs the perceived benefit.
If an employee's driver's license is suspended, revoked, cancelled or restricted by
the State issued, or if an employee has a medical condition that would restrict their
ability to safely operate a vehicle, the employee must immediately notify their
supervisor. The supervisor and Safety Coordinator OF Assistant City Administrate
will review the driving record or medical information and make a determination on
eligibility to operate a vehicle in the course of their employment. If the City learns an
employee has not complied with the above reporting requirement, appropriate
disciplinary action will be handled through the disciplinary procedures identified in the
employee's union contract and /or the City's personnel policy.
