Properties acquired by the EDA can be held for development purposes or for their intended purpose for a period of 8 years. Staff recently became apprised by the County that the title for this parcel had not been transferred from the EDA to the City, so we are requesting at this time that the City Council take action to do that through the enclosed quit claim deed. This was approved by the EDA at their December 8, 2009 meeting. The parcel will remain tax exempt because under Minn. Stat. 272.02, subd. 8, "all public property exclusively used for any public purpose is exempt" from real estate taxes. This parcel is a public storm water drainage facility and is maintained by the city as part of the city's regional storm water drainage system. Recommendation: Staff recommends affirming the Quit Claim Deed. Action Requested: Adopt the attached resolution affirming the Quit Claim Deed. RESOLUTION NO. RESOLUTION AUTHORIZING THE ACCEPTANCE OF CERTAIN LAND WHEREAS, the Cottage Grove Economic Development Authority, a public body corporate and politic under the laws of the State of Minnesota ( "EDA ") wishes to convey certain real property situated in the County of Washington, more particularly described in the attached Exhibit A ( "the Property "); and WHEREAS,the EDA owns the Property and has no further use for the Property; WHEREAS, The Property is occupied by an existing City stone water drainage pond; WHEREAS, Minn. Stat. § 465.035 and 471.64 authorize any public corporation to convey its land for no consideration to another public corporation or government subdivision NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF COTTAGE GROVE AS FOLLOWS: 1. The City Council hereby determines that the acceptance of the Property is in the public's interest. 2. The City Council authorizes and directs staff to record the deed in the County land records.
