At the June 2, 2010, City Council meeting, Jeremy Thigpen spoke at the Open Forum to object
to the size and style of houses being built in the Mississippi Dunes subdivision. Mr. Thigpen is
a resident of Mississippi Dunes and believes some of the houses recently built do not conform
to the original intent of the development. Mr. Thigpen did not request City action on this matter,
but wished to make the City Council aware of the situation.
The preliminary plat for Mississippi Dunes was approved by the City Council in 2003. The
developer also recorded protective covenants for the subdivision. Until recently, all of the
homes constructed in Mississippi Dunes had a two -story design. With the downturn in the
market, the developer deeply discounted the remaining lots in the subdivision. Some of these
lots were purchased by Minks Custom Homes who constructed some split entry model homes
with less square footage and a lower sale price than most existing homes in the development.
The split entry homes meet the minimums established in the protective covenants. It should be
noted that the City does not enforce those private covenants. The City has no minimum house
size requirements in most areas of Cottage Grove, including Mississippi Dunes. Only in the
East Ravine area do minimum size requirements apply. As long as the new homes meet the
requirements of the Building Code, the City must issue building permits, regardless of the size
or home style.
