This petition proposes that the City of Cottage Grove and Lennar Homes fund the proposed sidewalk improvement. A copy of the petition and an aerial map showing the location of the proposed sidewalk improvement is attached. Background K. Hovnanian Homes was the developer for the Silverwood Addition, which consists of 64 homes. The City Council approved this project on February 1, 2006. The public improvements were constructed in 2006. The developer of this project did propose a sidewalk on one side of Hearthstone Avenue and 61 st Street. Lennar Homes was the developer for the Pinecliff neighborhood, which consists of 61 homes. The City approved the final plat for this project on December 1, 2004. The public improvements were constructed in 2005. At the time this project was approved, no sidewalk was proposed or required north of 62" " Street. Residents in the Silverwood and Pinecliff neighborhoods have also signed a petition requesting that the City develop a park in their neighborhood. This petition was presented to the Parks, Recreation and Natural Resources Commission at their August 9, 2010, meeting. City staff is collecting additional information and preparing cost estimates for developing a park in this area. This information will be presented to the Parks Commission at their meeting on September 13, 2010. y The streets within the Silverwood and Pinecliff subdivisions are local streets with low traffic vo- lumes. The City's Subdivision Ordinance does not require sidewalks or trails along local streets, but does require sidewalks or trails on both sides of arterial and collector streets. For the Pinecliff project, Lennar Homes did not propose to construct any sidewalks, but the City required a side- Honorable Mayor, City Council, and Ryan Schroeder Pinecliff Sidewalk Project September 9, 2010 Page 2 of 2 walk along one side of Hedgecroft Avenue and 62nd Street. One year after the Pinecliff project, K. Hovnanian Homes submitted their plans to develop the Silverwood project. This developer in- cluded a sidewalk along one side of Hearthstone Avenue and 61 st Street. All 17 lots where the sidewalk is proposed have been built upon. Each lot has a paved bitu- minous or concrete driveway and all the yard improvements are completed. The length of the proposed sidewalk is approximately 1,612 feet. If a sidewalk is constructed, it will be located within the public right -of -way. The boulevard area between the curb and sidewalk should be six to seven feet wide. A portion of each driveway and the concrete apron will be removed and reinstalled in order to construct the sidewalk. The grade between the curb and sidewalk must be re- graded. The grass area between the sidewalk and curb might also have to be re- graded on some of the affected lots. Retrofitting sidewalks across developed lots is challenging because yard and driveway slopes must be altered. Homeowners will be responsible to temporarily re- move and replace irrigation systems that are in the vicinity of the sidewalk or areas where the yard must be re- graded. The driveway apron will likely be steeper as compared to the existing condition. A feasibility report to construct the sidewalk has not been prepared, but the preliminary cost is estimated to be around $182,700. Lennar Homes has closed their Pinecliff project out, does not own any real estate in either subdivision, and objects to any cost participation in constructing this sidewalk. If a sidewalk is to be constructed, it is recommended that the cost be assessed. Because the petition requests that the City pay for the improvement, it is recommended that the City Council receive and place on file the petition and not take any other action. If the property owners still want to pursue this project as a public improvement project under Minnesota Statutes 429, the landowners would need to sign a new petition agreeing to be assessed the entire cost of the project and submit it to the City. If that petition is signed by 35 percent of the ownership, as re- quired under the Minnesota Statute 429.035, then the City Council can consider adopting a resolution ordering the preparation of a feasibility report. The petition contains 68 resident signatures that live in the Silverwood and Pinecliff subdivisions. Seventeen parcels abut the proposed sidewalk alignment. Twelve of the seventeen property owners (71 percent) abutting the proposed sidewalk signed the petition. A map showing the lo- cation of each property owner that signed the petition is attached. City of Cottage Grove 7516 80th Street South Cottage Grove, MN 55016 August 9, 2010 This is a formal petition request by the residents of Pinecliff and Silverwood development in Cottage Grove, Minnesota for the addition of sidewalks beginning at the North side of 62 "" St. S continuing onto the East side of Hedgecroft Ave. S. heading northward following the curve into the North side of 61 St. S. meeting the existing sidewalk on the western end of 61 St. S. We are petitioning this for the following reasons I) The corner of 62 St. S. and Hedgecroft Ave. S., is a bus stop for over 25 children in the neighborhood that goes to Cottage Grove Elementary. 2) In the winter time it is very difficult for the kids to get onto the bus as they typically have to climb over a 3 foot snow mound to get from the yard area of (7682 62 °d St. S. property where they wait for the bus) to the bus door. 3) The corner of 62 " St. S. and Hedgecroft is one of the main entrances in the neighborhood — therefore it is one of the busiest corners between the two developments. Cars often speed by_ and _some of the children that wait for the bus during the winter months end up _ standing on the street to wait for the bus as it is easier for them to stand on the street and keep their pants and shoes dry than stand on the yard where there is no sidewalk therefore their feet gets buried in the snow while they wait for the bus. 4) Silverwood and Pinecliff are home to many young families with very small children who often go for walks around the neighborhood or ride their bikes. It is quite dangerous for the children walking or riding their bikes going down from the corner of 62 St. S. and Hedgecroft towards 61" St. S., as the street slopes down. 5) The corner of 62" St. S and Hedgecroft is on of two main entrances for Silverwood and Pinecliff development. 62 St. S. is the street that most residents turn into as it is coming off of Hinton Ave. Majority Silverwood /Pinecliff residents have to pass this road to get to their respective homes. St. St, Hedgecroft Ave. S., 61 st St. S., Hearthstone Ave. S) are signing this petition for the City of Cottage Grove to add sidewalks from 62nd St. S. going northward on Hedgecroft Ave. S. towards 61 st St. S then heading westward toward the existing sidewalk on the west half of 61 st. St. This is due to 62nd St. S and Hedgecroft being a school bus stop for over 25 kids in the neighborhood and safety concerns especially in the Winter time when children have to clim over 3 ft. tall snow mounds to get to the school bus door. This neighborhood have young families with small children that would benefit from having sidewalks for families to take walks on or for children to ride their bikes on around the two neighborhoods.
