Levitt, P.E., City Engineer Brenda Peper, Financial Analyst Date: September 29, 2010 Re: Lehigh Road and TH95 Project: Hold a Public Hearing Background: This area had been a concern to area residents and the City for a number of years. Specifically, the Lehigh and Trunk Highway 95 intersection had been a safety concern for some time with the skewed angle. An analysis of the MnDOT crash data of accidents occurring in close proximity to the intersection revealed nine accidents took place between 2002 and 2005. In each of these accidents, roadway design appeared to be a contributing factor. According to the crash report, all of these accidents occurred within 1/4 —mile of the intersection, and the crashes were all sideswipes, rear -end collisions, and vehicles running off the road to avoid slowing or stopping vehicles preparing to turn. In addition to the safety concerns, there was also poor drainage north of the intersection. Residents had made numerous complaints regarding the drainage in this area. Each spring a large section of Lehigh Road had water standing on it and many areas experienced washouts. These washouts have had temporary measures utilized each year to stabilize the road until an ultimate solution could be implemented. The ultimate solution was to create a ditch section along Lehigh Road to contain the water and add additional culverts to control drainage to existing drainage and utility easements. A History of City Actions on this project is as follows: The City Council authorized staff to submit an application to the MnDOT's 2008 Municipal Agreement Program on October 4, 2006 for the TH 95 and Lehigh Road improvements. Then on February 27, 2007, the City was notified that $135,041 had been offered for the improvement project. Council then authorized acceptance of the FY2008 Municipal Agreement Program Funding on March 21, 2007. In September 2007, WSB was selected to provide the engineering design services for the project. The City continued to negotiate for additional funds for the project due to additional requirements placed on the design of the bypass lane, turn lane and road re- alignment. Then on February 8, 2008, the City was notified that additional funds valued at $210,000 could be utilized for a reduced scope to eliminate the bypass lane and keep the turn lane and Lehigh re- alignment. Council approved the feasibility report on April 16, 2008 and called for a Public Improvement Hearing to be held on May 21, 2008. Public Hearing to Order the Project At the May 21, 2008 Public Hearing the City Council ordered the improvements to Lehigh Road and TH 95 intersection (Schedule A in the feasibility report) and a portion of the drainage improvements (Schedule D in the feasibility report) with a 4 -0 (Sandy Shiely was absent) vote. At the Public Hearing numerous project scope options were discussed. One option had to been to reconstruct Lehigh Road for just over a quarter of a mile. Please see the enclosed figure 'Trunk Highway 95 (Manning Avenue) at Lehigh Road" showing the project scope for the reconstruction option of Lehigh with the improvements on TH 95. Figure No. 4 shows the corresponding properties that would have been assessed that option. This option was not selected but provides the frame work for how the assessment amount was determined. The project which was selected and ordered was to construct only the TH 95 and Lehigh realignment portion and not do anything else on Lehigh Road. Please see sheet 2 of 50 which shows the scope of the project ordered. This would mean the City would be able to utilize the Cooperative Agreement money from the MnDOT and would have less assessments related to the project. The funding for the project would include the $210,000 in Cooperative Agreement Dollars, assessments, Stormwater Utility and State Aid funds. In the discussions at the Public Hearing, Council indicated they did not want to assess the two parcels for stormwater related activities. Council proposed a cap of $5,513.00($3,095.45 streets and $2,418.00 storm) for parcels 44.0001 and 44.0007 for an equitable road assessment even though the more extensive Lehigh Road improvement was not ordered. Please see the preliminary assessment roll from the feasibility report. Council further directed that the stormwater drainage assessment not be assessed so an assessment of $3,095.45 is proposed. The benefit appraisal dated 12/3112007 on the two parcels being assessed were $10,000 for property 25.027.21.44.0001 and $8,000 for property 25.3027.21.44.0007. Recommendation: It is recommended the Council conduct the public hearing and consider the adoption of the assessment roll for the Lehigh Road and TH 95 Project. RESOLUTION NO. 10- RESOLUTION ADOPTING ASSESSMENTS FOR THE LEHIGH AND TRUNK 95 ROADIMPROVEMENTS WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment of the Lehigh and Trunk 95 Road Improvements. NOW THEREFORE BE IT RESOLVED, the City Council of Cottage Grove, County of Washington, State of Minnesota, as follows: Such proposed assessment, in the amount of $6,190.90, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to benefit by the proposed improvement in the amount of the assessment levied against it. Such assessment shall be payable in equal annual installments extending over a period of 15 years, at an interest rate of 7 %, the first of the installments to be payable on or before the first Monday in January, 2011, and shall bear interest on the entire assessment from the date of this resolution until December 31, 2011. To each subsequent installment when due shall be added interest for one year on all unpaid installments. The owner, of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except no interest shall be charged if the entire assessment or on any amount $500 or greater is paid within 30 days from the adoption of this resolution; and she /he may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The Director of Finance shall transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County. Such assessment shall be collected and paid over in the same manner as other municipal taxes. Passed this 6th day of October 2010.
