Consider authorizing issuance of a 3.2% Off Sale Liquor License to Northern Tier Retail/DBA
SuperAmerica.
STAFF RECOMMENDATION:
Authorize issuance for the liquor license. During the required background investigation, no
facts were found that would constitute a basis for denial of the application. Northern Tier Retail
has purchased 166 SuperAmerica convenience stores, SuperMom's Bakeries, and the
Marathon Oil Refinery in St. Paul Park from Marathon Oil. The business closing is expected to
take place on December 1, 2010.

Subject: LIQUOR LICENSE APPLICATION -
INTRODUCTION
All locations within the City of Cottage Grove that sell alcoholic beverages, are required by State Law
and City Ordinance to be licensed.
BACKGROUND
Pursuant to City Ordinance, Mr. Rex Butcher, President of Northern Tier Retail, on behalf of Northern
Tier Retail dba/ SuperAmerica, located at 7162 East Pt. Douglas Road, Cottage Grove, Minnesota, has
submitted an application for an "Off Sale" 3.2 malt liquor license. Marathon Oil, the parent company of
SuperAmerica, has entered into a purchase agreement with Northern Tier Retail to purchase 166
SuperAmerica convenience stores, SuperMom's Bakeries and the Marathon Oil Refinery, currently
located in St. Paul Park. This agreement was entered into on May 19, 2010 and the anticipated
closing date is November 1, 2010. As part of that sale agreement, the current SuperAmerica Store
located at 7162 East Point Douglas Road, in the city of Cottage Grove, will be sold to Northern Tier
Retail. Northern Tier Retail advises that that there will be no changes in the methodology for which
alcohol sales will be transacted at the current Cottage Grove location. The Department of Public
Safety is required to conduct a police investigation of the applicants.
DISCUSSION
The application of Northern Tier Retail dba/ SuperAmerica as submitted, is complete and in compliance
with our ordinance.
We have investigated the applicants and have not found any facts that would constitute a basis for
denial of an "Off Sale" 3.2 malt liquor license, under the provisions of the City Liquor Ordinance or
Minnesota Statutes relating to alcoholic beverages.
COMPLIANCE
Ms. Rebecca Ann Momany will remain as the individual in charge as the local manager, it should be
noted that SuperAmerica has passed all of its alcohol compliance checks in 2010.
RECOMMENDATION
Recommend that the City Council approve the Liquor License application for Northern Tier Retail dba/
SuperAmerica.
