A copy of David Wolterstorff's letter requesting the extension is attached. Michael's Point is a 13-lot residential subdivision on 26 acres. The project is located north of The Preserve at Cottage Grove subdivision and west of Jamaica Avenue. A copy of the pre- liminary plat is attached. The City Council approved rezoning this property from AG-1, Agricultural Preserve, to R-2A, Residential District, and the preliminary plat on July 11, 2007. On September 3, 2008, the City Council approved a two-year extension to the preliminary plat. 1111MMM-M a Project Schedule The developer is postponing the development • this project for another one to two years. Be- fore the developer can proceed, a final plat application must be filed with the City prior to the expiration of the preliminary plat. At that time, a development agreement between the devel- •per and City must be approved before this project can proceed. Preliminary Plat Layout No changes have been made to the preliminary plat since initial City approval on July 11, 2007. No new conditions warrant revisions to the resolution approving the preliminary plat. That the City Council adopts a resolution granting a two-year extension to the already ap- proved preliminary plat for the Michael's Pointe subdivision, subject to conditions listed in the attached draft resolution. 0 1 . 11 Mll VIM [*I ilk I Z Fill 6 140 M 1 [44 M F-11 A :Lei I ilk I I = K • OL• IMAJil ANINAWWAII offi WHEREAS, WAI Continuum applied for a preliminary plat for Michael's Pointe, a 13-lot residential subdivision to be located on 26 acres north of The Preserve at Cottage Grove subdivision and west of Jamaica Avenue and legally described as: That part of the North 792.21 feet of the Northwest Quarter of the Southwest Quarter of Section 3 and that part of the North 792.21 feet of the Northeast Quarter of the Southeast Quarter of Section 4, all lying Westerly of Jamaica Avenue, all in Township 27 North, Range 21 West, Washington County, Minnesota, subject to Jamaica Avenue. WHEREAS, the City Council of the City of Cottage Grove adopted Resolution No. 07- 129, which approved the preliminary plat on July 11, 2007; and WHEREAS, in accordance with the City Code, City Council approval of a preliminary plat is good for one year, unless otherwise agreed upon by the subdivider and the City Council; and WHEREAS, Title 10-2-6, Effect of Subdivision Approval, of the City's Subdivision Ordinance states that the City Council may extend the approval period by agreement with the subdivider, subject to all applicable performance conditions and requirements or the Council may require submission of a new application; and WHEREAS, WAI Continuum requested from the City Council a two-year extension to the Michael's Pointe preliminary plat in 2008. The City Council granted such an extension on September 8, 2008, by adopting Resolution No. 08-158; and WHEREAS, WAI Continuum is requesting the City Council to grant another two-year extension to the Michael's Pointe preliminary plat. NOW THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove, County of Washington, State of Minnesota, hereby approves an extension to Resolution No. 08-158, which approved an extension to the preliminary plat for Michael's Pointe; subject to the following conditions: 1 The 21 conditions cited in Resolution No. 07-129 and the two conditions in Resolution No. 08-158 approving the preliminary plat for Michael's Pointe remain i1 e-Yect. Resolution No. 2010-XXX D O - 2. The approved preliminary plat will remain in effect until November 7, 2012. At that time, the City Council may require submission of a new preliminary application if a final plat has not yet been approved. Passed this 4th day of November, 2010.
