All Saints Lutheran Church has applied for conditional use permit to install a pre-assembled
columbarium that has 72 niches. The columbarium will be placed on the southeast side of the
church building. Two urns can be placed in each niche for a total of 144 urns. The proposed
columbarium is five feet in height with a five-foot, four-inch diameter. A paved walkway will be
installed around the base of the columbarium. All Saints Lutheran Church is located at 8100
Belden Boulevard and is shown on the location map below.

and the cemetery associations in Newport and Cottage Grove have agreed to accept the
columbarium if it needed to be relocated from the Church's property.
The Planning Commission unanimously (8-to-O vote) recommended that the City Council ap-
prove All Saints Lutheran Church's conditional use permit. An excerpt from the Planning Com-
mission's unapproved minutes is attached.

The City Code allows columbaria as a conditional use in various zoning districts. The proposed
columbarium is approximately 72 feet from the Church's southerly property line which abuts
Belden Boulevard. The setback exceeds the 50-foot minimum setback requirement.
All Saints Church's property can adequately accommodate the proposed columbarium, and its
proposed location does not adversely impact adjoining properties • cause any public safety is-
sues. The proposed columbarium complies with all other city regulations.
Proposed Columbarium
A columbarium is a usually a brick, stone, or concrete structure (indoor or outdoor) where family
members can place urns containing the ashes of cremated loved ones. The word 'columbarium' is
derived from the Latin term columba, meaning "dwelling place of a dove." They are designed in
various shapes and sizes. They can be incorporated into a wall structure that is integral to a
building, in in-ground walkways/patios, or exist as a free-standing modular columbarium system.
All Saints Lutheran Church proposes a 72-niche, 144-urn columbarium to be placed • th-

shaped, approximately five feet in height, and 56 inches in diameter. A granite cap is placed •
top • the columbarium. The applicant has not yet decided • the color of the granite, the design
or materials for a walkway around the base • the columbarium, • if there will be any
landscaping or benches next to it. The location and an example of the columbarium proposed by
the Church are shown below.

All Saints' Policies and Operating Rules
A draft copy of the applicant's policies and operating rules for the columbarium is attached. This
document establishes conventional rules that ensure that the procedures for inurement and me-
morializing are carried out in an orderly and consistent manner. The document also includes in-
formation and plan in the event the church disbands or decides to relocate the columbarium.

THE COLUMBARIU COMMITTEE: The Church Council of All Saints Lutheran Church shall have full
control of the columbarium. This control shall be exercised through a permanent standing
Columbarium Committee.
1. UNIFORMITY: Each section of the Columbarium shall consist of niches uniform in size for the
placing of cremated human ashes. Each niche shall have a name plate of uniform size. The
name plates and engraving shall be limited to the name of the deceased, and the dates of birth
and death. The cost of the name plate will be paid from the escrow maintenance fund. Name
plates will be ordered by the Columbarium Committee.
2. CONTROL: A record of numbered spaces arranged in a grid format will be maintained by the
Columbarium Committee and kept in the church office in paper form and on a computer disc.
The location of occupied or purchased spaces shall be indicated on the grid. All matters of
design shall be determined by the Columbarium Committee.
ELIGIBILITY: The right to submit applications to purchase and use space is available to all members of
All Saints Lutheran Church and their immediate families (immediate family members are defined as
spouse /partner, children and spouses /partners, parents, brothers, sisters, grandparents and
grandchildren). Former members may also submit applications to purchase and use space. The Church
Council of All Saints Lutheran Church through the Columbarium Committee, specifically reserves the
right to approve or disapprove all applications for purchase regardless of the status of the applicant.
l. The purchaser of this exclusive right, who has paid the purchase price in full and has been
assigned a specific niche shall receive a certificate signed by the chair, or designated member of
the Columbarium Committee attesting to his or her ownership of the sole and perpetual use of
a specified niche as personal property. There will beno assessments or future charges after the
purchase price has been paid.

any individual, other than to a member of the purchaser's immediate family as defined in the
eligibility section above. If not transferred to an immediate family member, ownership may
only be transferred to the Church, in which case the niche will be offered for purchase to
eligible persons as provided for in these policies and regulations.

escrowed for the maintenance and upkeep of the columbarium. The price of such exclusive
right may be increased from time to time by the Columbarium Committee as they deem
necessary at their sole discretion. The purchase price of the niches of the same size shall be
uniform, regardless of the location of the niche. The location of the niche purchased shall be
determined by the Columbarium Committee based on the order in which payment is received.

Lutheran Church ever dissolve, the columbarium would be moved to either of two local
cemeteries in Newport or Old Cotta Grove. Both cemeteries said they would allow the
columbarium to be placed in their cemetery.
OTHER CONDITIONS: The cu|un1behurn shall be open to visitors at all time. Cremated remains may be

staff. A copy of the death certificate shall berequired.
PURCHASE OF NICHES: Purchase of a columbarium niche may be made by submitting a signed
application and full payment of the sales price to All Saints Lutheran Church.
ADDITIONAL PROVISIONSIAMENDMENTS: The Church Council reserves the right, in its sole
discretion, to amend these Policies and Regulations and to add or delete provisions, without notice to
any party.

WHEREAS, All Saints Lutheran Church has applied for a conditional use permit to allow a
columbarium on their property, legally described as:

Commonly known as 8100 Belden Boulevard South, Cottage Grove, Washington
County, Minnesota.
WHEREAS, public hearing notices were mailed to property owners within 500 feet of the
property and a public hearing notice was published in the South Washington County Bulletin; and
WHEREAS, the Planning Commission held a public hearing on November 22, 201 and
WHEREAS, a planning staff report, which detailed specific information on the property and
the application request, was prepared and presented; and
WHEREAS, the public hearing was open for public testimony and testimony from the
applicant and the public was received and entered into the public record; and
WHEREAS, the Planning Commission unanimously (8-to-0 vote) recommended approval of
the application, subject to certain conditions listed below.
NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove,
Washington County, Minnesota, hereby approves the conditional use permit to allow a
columbariurn at All Saints Lutheran Church, located on the property legally described above,
subject to the following conditions:
1. All Saints Lutheran Church maintains a record of all inurnments.
2. A building permit application must be completed, submitted, and approved by the
City prior to the site preparation and installation of the columbaria. Detailed
construction plans must be reviewed and approved • the Building Official.

McCool summarized the staff report and recommended approval subject to the conditions
stipulated in the staff report.

Cheryl Eliason, 8013 Gary Boulevard, asked about security measures, fencing, traffic, and
why the columbarium is being put at the church and not a cemetery. Ted Fredrickson, 8291
River Acres Road, introduced himself as the Chair of the Columbarium Committee. He ex-
plained that the columbarium weighs 6,000 pounds, is made of granite, and will be placed
on a foundation. He stated that they are not adding ornamentation to the top due to con-
cerns about possible vandalism. In terms of security, they are not doing anything different
than a cemetery would do, and there will be no fence around it. The niches are very secure
and cannot be broken into. He explained that it is not being placed in a cemetery because
All Saints Lutheran Church does not have its own cemetery; they use a couple different
ones for burial. There will be a seating area and a small walkway around the columbarium.
Poncin asked if there are federal or state regulations related to cremated remains. McCool
responded no. Poncin asked about recordkeeping. Fredrickson explained that the church
will keep a log and the company they are buying the columbarium from will have compute-
rized records.
