SUBJECT: Deferral of Special Assessments
Introduction
A property owner has applied for the deferral of assessments for the 2010 Pavement Management
Program under the City program for deferral of special assessments for senior citizens, disabled,
and military persons pursuant to Minnesota Statute 435.193 to 435.195.
Discussion
The City Council adopted a policy in September 2008 that provides for the deferral of special
assessments for senior citizens, disabled, and military persons pursuant to Minnesota Statute
435.193 to 435.195. The established policy identifies income guidelines for determination of
hardship in order to defer payment of special assessments ($21,660 for a one person household,
$29,140 for a two person household etc.).
The option to defer the payment of special assessments shall terminate and all amounts
accumulated plus applicable interest, shall become due upon the occurrence of any of the
following events: (a) the death of the owner, provided that the spouse is otherwise not eligible for
the benefits hereunder; (b) the sale, transfer, or subdivision of the property of any part thereof; (c)
if the property should for any reason lose its homestead status; or (d) if for any reason the taxing
authority deferring the payments shall determine that there would be no hardship to require
immediate or partial payment.
The request for deferral was received after the assessment was certified to Washington County for
the first installment. If deferral is approved, all principal and interest subsequent to 2011 will be
deferred.
The property owner meets the qualification guidelines.

WHEREAS, on September 3, 2008, the City Council of the City of Cottage
Grove, Minnesota adopted Ordinance 844, Establishing a Program to Defer
Payment of Special Assessments, which provides guidelines for determining the
eligibility to defer payment of special assessments; and
WHEREAS, the owner of the property located at:
7706 113 Street South 32- 027 -21- 120 -07 $4,925
has submitted the required application for the deferred payment of a special
assessment and qualify for the deferral under Ordinance 844.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of
Cottage Grove, County of Washington, State of Minnesota, that the assessments
for the above properties for street improvements in the 2010 Pavement
Management District adopted October 20, 2010 be deferred in accordance with
Ordinance 844.
