Mayor Myron Bailey opened Open Forum at 7:15 p.m., and stated that during Open
Forum person may address the City Council on subjects that are not a part of the regular
meeting agenda, but must limit remarks to two (2) minutes. The purpose of open forum is
to provide the public the opportunity to provide information to or request action by the City
Council. It may not be used to make personal attacks, to air personality grievances, to
make political endorsements, or for political campaign purposes. Open Forum will adjourn
to the regular meeting promptly at 7:30 p.m.

Rick Munoz, 6828 Idsen' Avenue `South, Cottage Grove, addressing Council Member
Lehrke asked him to own up; to his bad decisions and to apologize for them instead of
deflecting blame. and wrong doings onto other people. He asked Council Member Lehrke
to take responsibility for his actions. Council Member Lehrke noted for the record that
Officer Munoz has been attacking him since the election campaign.
Dale Andrews, 8430 Keats Avenue South, Cottage Grove, stated that she asked the City
Administrator for a copy of the land swap agreement between the City and Washington
County and for a list of the legislation that staff was following. She commented that she
emailed her request, stopped in the office, received the agreement but she was still
waiting for the list of legislation.
Grace Krumm, 7847 74 Street South, Cottage Grove, asked why the new Public
Safety /City Hall building would not be on a referendum.

The City Council of the City of Cottage Grove, Washington County, Minnesota, held a
Regular Meeting on May 4, 2011, at the Cottage Grove City Hall located at 7516 80
Street South, Cottage Grove. Mayor Myron Bailey called the meeting to order at 7:30 p.m.

Police Sergeant Martin highlighted the new Citizen's Academy noting that through
the Academy, their goal was to enhance public safety, understand law enforcement

strategies and problems, reduce crime, provide crime prevention strategies, build
relationships with the citizens, and create police ambassadors in the community.

Senior Planner Burbank summarized the request to enter into an Agreement with
the Minnesota Land Trust establishing a restrictive land conservation easement on
an 11.2 -acre City -owned parcel of land formerly known as the "Gonyea Parcel" and
located in the 52 -acre Gateway North Park and Open Space area.
City Administrator Schroeder stated that Mr. Gibson was not opposed to this action,
he just wanted to continue to encourage the City to treat the development parcel
portion with sensitivity.

Senior Planner Burbank summarized his recommendation to create memorial
tribute feature design subcommittee for the new Civic Campus site (Public
Safety /City Hall facility) charged with the following tasks:
• Meet the established Civic Campus project design timeline requirements.
• Meet the budgetary parameters allocated for the memorial tribute feature within
the context of the overall site budget for the Public Safety /City Hall project.
• Determine a recommendation of who would be memorialized and honored with
the tribute feature.
• Determine a recommendation of how to memorialize and honor those who have
served.
• Determine a recommendation of an appropriate location for the memorial tribute
feature.

Council Member Olsen stated that increasing the size of the subcommittee from 10
to 16 members is a good idea because ai number of individuals expressing an
interest in serving on the subcommittee have approached him. He encouraged the
Citv Council to consider establishinq a 16- member subcommittee.
Council Member Peterson noted that the City Council tries to make sure that we
consider gender balance and cultural diversity balance on our committee.

Council Member Olsen stated that there were comments made during Open Forum
regarding public data and asked City Attorney Heine for clarification on what is public
data, what is not public data, and what is the City required to release.
City Attorney Heine stated that there is a general presumption that everything is public
unless a statute makes it not public. She stated that on the question about the timeline
for responding, the answer to that depends on what was being asked for. If you are
asking for data about yourself, like a City employee who comes in and wants to see
their personnel file, that information shall be provided immediately when it is possible,
but when it is not possible, within 10 days. City Attorney Heine stated that if a member
of the public comes in and asks for information and it is not information about
themselves, the requirement is that they be provided the information immediately if

possible and if that is not possible then within a reasonable fashion. What is
"reasonable and prompt" depends entirely upon the circumstances, how much data was
requested, and how difficult it would be to retrieve. It could also involve consideration of
what other duties the person who is responding might have. Reasonable and prompt is
not defined in Statute, but in opinions issued by the Commissioner of Administration,
she has not seen some go beyond three (3) weeks that the Commissioner thought was
reasonable. She stated that she generally says to use the 10 -day as a rule of thumb,
but three (3) weeks would be on the outside unless you had a very large request for
data.

City Administrator Schroeder noted for the record that he received a request for the
legislative bills that the City has been monitoring. His response has been that we have
been monitoring legislation generally without providing specific senate or house files.
