RE: Assessment of Charges for Removing Hazardous Conditions on Private Property
Introduction
Minnesota State Statute 463 provides cities the ability to assess the costs associated with the
removal or elimination of public health or safety hazards from private property. There were 13
properties that the City was required to clean -up due to public health and safety concerns in the
last year.
Discussion
During 2010 and 2011, the Council approved the abatement of the listed properties due to
various hazardous and safety violations. The City completed the abatements because the
property owners failed to do so.

The City incurred costs to remove nuisance conditions that affect health and safety and invoiced
the property owners for these costs. These invoices have not been paid. Staff is recommending
that these costs be assessed to the listed properties per MN Statute 463. In addition to the
above charges, the City will incur $159.38 to publish the assessment notice and $4.00 /lot for
placing the assessment on the tax roll. The publishing fee will be distributed evenly among the
properties. Therefore, the total assessment amount of $7,237.34 is recommended.
The assessment notice will be published on September 21, 2011, and an individual notice will
be sent to the property owners. The assessment hearing will be held on October 5, 2011. Once
these costs are assessed they become a lien on the individual property that will be collected
along with property taxes over a one -year period.
Recommendation
Adopt the resolutions as presented to declare the costs and call the assessment hearing
RESOLUTION NO. 11 -XXX
RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING
PREPARATION OF PROPOSED ASSESSMENT ROLL FOR
REMOVAL OF HAZARDOUS CONDITIONS FROM PRIVATE PROPERTY
WHEREAS, contracts were let for the removal of hazardous conditions from private
properties. The costs incurred for such removal were $7,025.96 with additional publishing
fees of $159.38 and county fees of $4.00 /lot.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Cottage Grove,
County of Washington, State of Minnesota, as follows:
1. The net cost of such removal to be assessed is declared to be $7,237.34.
2. The Finance Director will calculate the proper amount to be assessed for such
improvements against the benefiting properties without regard to cash valuation
as provided by law and shall file a copy of proposed assessment roll in the City
Clerk's office for public inspection.
3. The City Clerk shall, upon completion of such assessment roll, notify the City
Council therefor

RESOLUTION NO. 11 -XXX
RESOLUTION CALLING FOR HEARING ON PROPOSED ASSESSMENTS FOR
REMOVING HAZARDOUS CONDITIONS FROM PRIVATE PROPERTY
WHEREAS, by Resolution 11 -XXX, passed by the City Council on September 7, 2011,
the Council directed the Finance Director to prepare the proposed assessment roll for
removing hazardous conditions from private properties and
WHEREAS, the City Clerk has notified the Council that such assessment roll is com-
plete and filed in her office for public inspection.
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove,
County of Washington, State of Minnesota, as follows:
1. A hearing shall be held on the 5 th day of October 2011 at 7:30 p.m. to pass upon
such proposed assessment roll.
2. The Finance Director is hereby directed to cause a Notice of Hearing on the pro-
posed assessments to be published in the Washington County Bulletin, the offi-
cial newspaper of the City, at least two (2) weeks prior to the hearing and shall
state in the notice the total cost of the improvement. The Finance Director shall
cause mailed notices to be given to the owner of each parcel described in the
assessment roll.

Dear Mr. & Ms. Naegeli,
It has been brought to the City's attention that the weeds and grass at the above stated
property are over the 8" allowable height, which is in violation of City Ordinance
Section 4 -3 -1. As the party responsible for this property, you are required to correct this
violation in a timely and compliant manner. These conditions contribute to a negative
appearance in the neighborhood and city code requires that you mow all grass and
eradicate all weeds for the benefit of the neighbors and community.
As stated in Ordinance Section 4 -3 -2, you have ten days from receipt of this letter to
comply. After that time, the city is obligated to mow the property and bill you for the
costs of manpower and equipment used. In addition, City Code 4 -3 -2 states that the
owner shall pay an administrative fee of fifty dollars for the first violation, one hundred
dollars for the second violation, and two hundred dollars for each subsequent violation,
plus the cost of mowing or cutting the weeds or grass.
Please take action to remedy the above noted violations by June 26, 2011. Your
cooperation will be a great help in our efforts to maintain our community as a safe and
attractive place to live.
