CALL TO ORDER: MEMBERS PRESENT: MEMBERS ABSENT: STAFF PRESENT: The May 16, 2006 meeting of the Cottage Grove Public Safety, Health and Welfare Commission was called to order at 7:00 p.m. Kris Mienert, Brian Hagen, Dave Wick, Jeff Rothecker, Justin Olsen, Ben Franczok Jennifer Osborne Captain Craig Woolery, Deputy Fire Chief AI Beasley, Fire Captain Rick Redenius Approval of minutes: Chairperson Kris Mienert presented the April 18, 2006 minutes for review. On a motion by Commission member Justin Olsen, seconded by Commission member Jeff Rothecker, the April 18, 2006 minutes were approved as submitted. Motion carried. Approval of aqenda: Chairperson Kris Mienert presented the May 16, 2006 agenda of the Public Safety, Health and Weifare Commission for review. On a motion by Commission member Dave Wick, seconded by Commission member Brian Nagen, the May 16, 2006 agenda was accepted and approved by the Commission. Motion carried. OPEN FORUM Chairperson Mienert invited citizens present matters that were not on the approved agenda. to address the Commission regarding any There being no presentations, Chairperson Mienert closed the Open Forum segment of the meeting. COMMUNITY DEVELOPMENT The Commission reviewed the May 22, 2006 Planning Commission's meeting agenda. Comments were made by the Commission regarding the following items: — Item 6.1 Ho King Restaurant — CUP06-019 A conditional use permit to allow restaurant liquor at 8711 E. Pt. Douglas Road. The Commission approved the conditions set forth as is. There was one comment from Chairperson Mienert regarding public safety's training of employees regarding procurement and sales to under-aged persons as well as information regarding Page 2 PSHWC Meeting Minutes May 16, 2006 Washington County sponsored alcohol compliance inspections. This information will be forwarded to Business Oriented Policing Sergeant Steve McCarthy. - Item 6.2 Health East - Cases ZA06-023, CP06-024, SP06-025 The Commission had original comments regarding the lack of detail for parking, dumpster placement and questions about affects of the office facility on 70` Street and potential County improvements to 70 Street. Captain Woolery explained to the Commission that this was a Iand use zoning amendment application; that the detailed drawings and specs for the proposed development would be based on the approval of the land use permit from high density residential to commercial. The Commission understood this and agreed that the land use zoning change from residential to commercial would be appropriate and had no other comment. - Item 6.3 Temporary Fireworks Sales at Menards — Case ICUP06-026 The Commission had no comment and approved the temporary use permit as stated. - Item 6.4 Driveway Setbacks — Case TA06-027 There was no information provided to the Pubiic Safety, Health and Welfare Commission regarding the Code amendments for driveway setbacks therefore, no comments were made. There being no further discussion regarding the Planning Commission cases, this portion of the meeting was closed. OLD BUSINESS None at this time. NEW BUSINESS Case 06-05-01 Outdoor Event Permit Hpplication — DeMori's Restaurant, 6-10-06 At the Public Safety, Health and Welfare Commission's May 16, 2006 meeting, the Outdoor Event Permit Application was reviewed by the Commission for DeMori's Restaurant to have a street dance on June 10 2006 from 6:00 p.m. until midnight. The conditions for the outdoor event as presented bythe Public Safety Department were reviewed by the Commission and advised that the requirements set forth is similar to what has been in the past, that the staffing for police security protection and outdoor restroom facilities all met the needs of the outdoor events held in 2005. Captain Woolery also commented to the Commission that in 2005 there were only 3 noise related complaints related to the live band playing. On a motion by Dave Wick, seconded by Ben Franczok, the Commission unanimously approved the conditions of the Outdoor Event Permit Application. Page 3 PSHWC Meeting Minutes May 16, 2006 CONDITIONS FOR DEMORI'S RESTAURANT OUTDOOR EVENT OF JUNE 10 2006 • Trash and debris in all areas of the Cottage Square Mall parking lot and property shall be periodically picked up during the street dance and by 12:00 (noon) the next day. Including the removal of all temporary trash dumpsters. • Adequate policing as determined by the Director of Public Safety shall be provided to maintain order (4 officers for the hours of 8:30 p.m. to 1:00 a.m.) Any costs incurred for the police enforcement required for the events shall be the responsibility of the appiicant. • Adequate sanitary facilities shall consist of a minimum of six (6) portable unisex toiiets. Portable toilets shall be pumped as necessary. • The applicant is responsible for maintaining alI fire and emergency lanes located within the Cottage Square Mall Shopping Center and in the general vicinity of the fenced area. These fire and emergency lanes shall be designated by the Public Safety Department. • Ali tents used shall meet the requirements listed in the Uniform Fire Code. Proof of fire retardancy treatment for all tents must be provided for inspection. • The applicant shall contact the Director of Public Safety during City Hall business hours to schedule aIl required inspections. One week prior to the event, the applicant shall submit a schedule and site plan detailing the dates and times to set-up (e.g. fence installation, temporary staging, tables, name(s) and telephone number(s) of people in charge of the event, etc.), removal and cleanup operations. These inspections must be completed prior to the opening or operation of the street dance. • The City of Cottage Grove shall be named as an additional insured by the appiicant's Comprehensive General Liability and �iquor Liability Insurance policies for a minimum of one million dollars. Proof of coverage shall be submitted in the form of a Certificate of Insurance no later than one week prior to the event. • The designated street dance area shall be fenced off contiguous with the building, and separate areas must be maintained where alcohoi is permitted. Page 4 PSHWC Meeting Minutes May 16, 2006 • No glass containers shall be used displayed or allowed in the street dance area or perimeter parking lots. • All necessary electrical permits shall be the responsibility of the electrical contractor. AI� electricai connections shali be inspected as required by the State Electrical Code. • No vehicles shall be allowed to park on the grass area surrounding the water tower. • Marked fire lanes shall be kept open around the dance area, and access to free-standing businesses (previous Goodyear Tire Store) shall be maintained. • All music and/or amplified communication shall cease by 12:00 midnight on Saturday. • All events must conform to the criteria concerning noise set forth in Section 28.51.1 of the Zoning Ordinance. • Trash and recycling bins shall be provided throughout the designated dance area and be clearly marked. Case 06-05-02 Outdoor Event Permit Application — Osman Shrine Car Show at VFW Red Barn on 7-23-06, 11:00 a.m. to 4:00 p.m. The Outdoor Event Permit Application was reviewed by the Commission for Osman Shrine Car Show to be held at the VFW Red Barn on July 23, 2006 from 11:00 a.m. until 4:00 p.m. It was also explained to the Commission that this event was held in 2005, there were no safety related incidents, there were officers scheduled for the event and �ue found that through previous events, that police security measures would not be needed. The following are the conditions set forth for the sale of alcoholic beverages and off street parking as well as the possibility of a D.J. Music Show being present. On a motion by Justin Olsen, seconded by Jeff Rothecker, the Commission unanimously approved the conditions of the Outdoor Event Permit Application. CONDITIONS FOR OSMAN SHRINE CAR SHOW JU�Y 23 2006 • The applicant is responsible for maintaining all fire and emergency lanes located within the property Page 5 PSHWC Meeting Minutes May 16, 2006 • Alcoholic Beverages — The V.F.W. employees have been issued a temporary "On Sale" non-intoxicating malt liquor license for this event a. A fence wiil be placed around the perimeter of the outdoor beer tent to be located contiguous to the building saie and possession of liquor (sold by the V.F.W.) outside this fenced area is prohibited from 11:00 a.m. and 4:00 p.m. b. Selling, serving, or dispensing liquor to a person under the age of twenty-one (21) years-of-age is prohibited. c. All security arrangements in place inside the building to control underage consumption during this event shall be extended to the outdoor permit area d. There shall be no sale or display of alcoholic beverages after 4;00 p.m. on 07/23/05. e. No glass containers shall be used or dispiayed • All music and/or amplified communication shall cease by 4:00 p.m. on 07/23/06 • All events must conform to the criteria concerning noise set forth in section #11- 6-17 of the City Code • Adequate sanitary facilities shall consist of a minimum of four (4) total restrooms • AII tents used shall meet the requirements listed in the Uniform Fire Code. Proof of fire retardant treatment for all tents must be provided for inspection • Trash and recycling bins shall be provided throughout the designated outdoor event area. Trash and debris on the V.F.W. property and allow adjacent to the V.F.W. shall be picked up after the event and completed no later than 12:00 (noon) the next day. • The applicant shall contact the Director of Public Safety during City NaII business hours to schedule all required inspections one week prior to the event. The applicant shall submit a schedule and final site plan detailing the dates and times to set up (e.g. fence installation, temporary staging tabies, name(s), and teiephone number(s) of people in charge of the event), removal and ciean-up operations. These inspections must be completed prior to the opening or operation of the event. Case 06-05-03 Outdoor Event Permit Application — Cottage Grove Jaycees Strawberry FesUCarnival/Dance 2006 The Outdoor Event Permit Application was reviewed by the Commission for the Cottage Grove Jaycee Strawberry Fest, Carnival and dance to be held primarily Page 6 PSHWC Meeting May 16, 2006 on the weekend of June 16 17` and 18` 2006. The conditions for the outdoor events as presented by the Public Safety Department were reviewed by the Commission and had the following concerns: 1) Over the potentiai amount of parking on area residentiai streets. The Commission understood that the Grey Cloud Elementary and Junior High parking Iots would be available to the public as a secure, off street parking option. Public Safety personnel will be aware of the potential safety concerns for parking on residential streets and will monitor the parking as it occurs throughout the duration of the festival. 2) It was also recommended that the conditions be changed for police protection for Saturday, June 17 seeing that the live band and entertainment is family oriented the police protection of 4 officers would be spread out over a longer period of time with an average of 2 officers on. The police officers' coverage will be scheduled from 3:00 p.m. to 8:00 p.m. to cover the "Battle of the Bands" and other stage performance in relation to the beer garden and 2 police officers from 8:00 p.m. until 12:30 a.m. will be scheduled in correlation with the Casabianca Orchestra and the adjacent beer garden. On a motion by Jeff Rothecker, seconded by Brian Hagen, the Commission unanimously approved the remaining conditions set for the carnival, the Strawberry Fest in general and for what is termed "the dance and stage area and beer gardens". CONDITIONS FOR COTTAGE GROVE STRAWBERRY FEST 2006 KINGSTON PARK Food Sa/es & Vendors Hours of operation: Saturday, June 17 — 10:00 a.m. to midnight Sunday, June 18 — 10:00 a.m. to 3:00 p.m. Licensing Requirements - All vendors providing food service must have current iicenses, and comply with all Minnesota and Washington County Department of Health regulations `See GENERAL CONDITIONS Liquor Sales(Beer Garden) — St. Paul ParkNewport Lions Club Temporary 3.2 beer sales Hours of operation: Saturday, June 17 — 12:00 p.m. to 11:30 p.m. Sunday, June 18 — 12:00 p.m. to 3:00 p.m. Page 7 PSHWC Meeting May 16, 2006 Licensing Requirements - Applicant employees have been issued a temporary "on sale" non-intoxicating malt liquor license for this event. Emergency lanes — The applicant is responsible for maintaining all fire and emergency Ianes located within the event held property. These fire and emergency lanes shali be designated by the Pubiic Safety Department. Tents — All tents used shall meet the requirements listed in the Uniform Fire Code. Proof of the fire retardancy treatment for all tents must be provided for inspection. Inspection — The applicant shall contact the Director of Public Safety during City Hall business hours to schedule all required inspections. One week prior to the event, the applicant shall submit a schedule and site plan detailing the dates and times to set up (e.g. fence installation, temporary staging, tabies, name(s) and telephone number(s) of people in charge of the event, etc.), removal and cleanup operations. These inspections must be completed prior to the opening of the event. Aicoholic beverages — applicants have been issued a temporary "on sale" non- intoxicating malt liquor license for this event. A fence will be placed around the perimeter of the outdoor beer tent to be located contiguous to the paved parking lot. Sale and possession of liquor (sold by The St. Paul Park/Newport Lions Club) outside of this fenced area is prohibited on Saturday, June 17 2006 between 12:00 p.m. and 11:30 p.m., Sunday, June 18' 2006 between 12:00 p.m. and 3:00 p.m. Selling, serving or dispensing liquor to a person under the age of twenty one (21) years of age is prohibited. Persons twenty one (21) years of age or older purchasing alcoholic beverages shall be issued a wristband for identification purposes. The appiicants will be required to obtain proof of age for purchasing or consuming liquor by: a. Vaiid driver's license or identification card issued by Minnesota, another state, or a province of Canada, which includes the photograph and date of birth of the Iicensed person. In the case of a foreign national, from a nation other than Canada, by a vafid passport. The applicants will comply with all other provisions of Cottage Grove City Code 3-3 and Minnesota Statute 340A relating to liquor control and security performance measures. There shall be no sale or display of alcoholic beverages after 12 midnight. Glass containers — No glass containers shall be used, displayed, or aliowed in the event or perimeter parking lots. Electrical — All necessary electricai permits shali be the responsibility of the electrical contractor. Ail electrical connections shall be inspected as required by the State Electrical Code. Fire Lanes — Marked fire lanes shall be kept open around the event area. Noise — All events must conform to the criteria concerning noise set forth in Section 28.51.1 of the Zoning Ordinance. Traffic — Applicant shall designate and maintain adequate egress and ingress entrances on streets adjacent to event held property to prevent traffic from stacking on adjacent roadways and property. Sanitary Facilities — The applicant shall provide adequate sanitary facilities which shall consist of a minimum of four (4) portabie unisex toilets. Portable toilets must be emptied as necessary. CONDITIONS FOR COTTAGE GROVE STRAWBERRY FEST 2006 CARNIVAL • Trash and debris within the parking lot, carnival area and surrounding area, shall be periodically picked up during the carnival. AII debris, trash, temporary barrels and/or dumpsters shall be removed before vacating the site, however, in any event, shall not be Iater than noon on the day following the last day of the carnivai. Page 9 PSHWC Meeting May 16, 2006 • Adequate sanitary facilities shall consist of a minimum of four (4) uni-sex toilets immediately adjacent to the carnival site. Portable sanitary facilities shall be pumped as necessary. . If water is requested from a fire hydrant, the applicant shall be responsible for all fees associated with such connection. The Director of Public Works shall approve aII connections and back-flow preventors shall be used. . No intoxicating beverages shall be consumed by any equipment operator while on duty. No operator shall operate any equipment associated with the carnival while under the influence of alcohol or drugs. • The City of Cottage Grove shall be named as an additional insured by the applicant's Comprehensive General Liability Insurance policy for a minimum of $1,000,000.00. Proof of coverage shall be submitted in the form of a Certificate of Insurance no later than one week prior to the event. • Fire and emergency lanes shall be designated within the interior of the carnival rides and parking area. Said fire lanes shall be inspected and approved by the Fire Marshall and the Police Department, prior to the opening of the carnival to the general public. AII campers, trailers and recreational vehicles having sanitary holding tanks, shall have said tanks pumped and drained as often as necessary to maintain sanitary conditions. Disposal of this material should be done by qualified personnel or at a designated dumping station. • The carnival shall cease operation by 11:00 p.m. each evening except on Sunday, June 18 it shall cease at 3:00 p.m. • The necessary electrical permits shali be the responsibility of the electrical contractor and shali be inspected as required by the State Electrical code. • All requirements for tents listed in the Uniform Fire Code, shall be applicable to carnival events. Proof of fire retardancy for all tents, must be provided at the time of the inspection. • The applicant and the carnival operator shall contact the Director of Public Safety during City Hall business hours, to schedule all required inspections. These inspections must be completed prior to the opening or operation of the carnival activity. . No smoking signs shall be adequately posted within any tent used for carnival activities. Page 10 PSHWC Meeting May 16, 2006 • Fire extinguishers shall be provided at the exits in every tent. • All carnival equipment and vehicles shali be removed from the site by 6:00 a.m. Monday, following the last day of the carnival. • All carnival activity must comply with the city's Noise regulations. . The operations of all carnival games of skill, including prizes awarded, shall conform to all applicable Minnesota State Statutes and Cottage Grove ordinances. No weapons shall be offered as prizes, including, guns, knives, night sticks, num-chucks or other items commonly used in martial arts or combative activities. The sale of any food or drink items must conform to Minnesota and Washington County Department of Health regulations and must be currently licensed within this state. CONDITIONS FOR COTTAGE GROVE STRAWBERRY FEST 2006 — DANCE Trash and debris on park property, and in all areas adjacent to Kingston Park, shal� be picked up after the event and completed no later that 12:00 (noon) the next day. Adequate policing as determined by the Director of Public Safety shall be provided to maintain order. Any costs incurred for the police enforcement required for the event shall be the responsibility of the liquor licensee (St. Paul Park Lions Club), For this event, police protection of four (4) officers would be spread out over a Ionger period of time with an average of two (2) officers on. The police officers' coverage will be scheduled from 3:00 p.m. to 8:00 p.m. to cover the "Battle of the Bands" and other stage performance in relation to the beer garden and two (2) police officers from 8:00 p.m. until 12:30 a.m. will be scheduled in correlation with the Casablanca Orchestra and the adjacent beer garden four (4) sworn officers need to be present from 8:30 p.m. until 12:30 a.m. Adequate sanitary facilities shall consist of a minimum of eight (8) portable unisex toilets. Case 06-05-04 Review of Pawnbroker & Secondhand Goods Dealer Ordinance — City Cierk Caron Stransky The Commission reviewed proposed amendments to the city's Pawnbroker and Secondhand Goods Dealer Ordinance. it was explained to the Commission that changes incorporated were in preparation of a pawnbroker or secondhand goods dealer requesting to establish a business in the City of Cottage Grove, which at the current time, none exist. Primarily the ordinance requests the addition in compliance to the automated pawn system and documentation of persons making transactions on the items being received. The only comment came from Commission member Ben Franczok, who felt that no firearms sales should occur from a secondhand goods or pawnbroker and that the language should be amended to not allow firearms sales. in reviewing the Ordinance 3-5-7: Business Transactions; Requirements and Restrictions, under Subd. E, the ordinance does pertain to the storage of firearms and dangerous weapons, that they be stored in a locked and opaque compartment unless being viewed by a customer. The ordinance also requires that any sales and transactions of firearms must meet federal, state Page 13 PSHWC Meeting May 16, 2006 requirements regarding compliance in federal firearms licensing and permit applications. The ordinance was approved by the Commission as stated with the noted firearms comment. - Signage and Sidewalk Issues — Hadley Avenue and 84"' Street Allan Larson, Public Works Technician, provided the following response in regards to issue of sidewalks at Hadley Avenue and 84` Street. . The sidewalk on the west side of Hadiey at 84th Street ends due to the placement of an existing Excel Energy power poie. Sue Gille of Excel Energy was contacted about re-Iocating this pole. She has advised that Excel Energy will be moving the power pole. Public Works will then be extending the sidewalk. COMMISSION COMMENTS AND REQUESTS None at this time. STAFF REPORTS POLICE - Captain Woolery informed the Commission that the City Council authorized the consolidation of our Dispatch Center with Washington County's. The County has offered positions to ail of our Dispatch personnel and have until May 25 to decide if they will accept the offer. A tentative June 27 date is set for consolidation. Captain Woolery advised that the police department has ATVs in service through a grant received from Homeland Security. These ATVs will be able to access remote areas and be used for rescue and be involved in Strawberry Fest. Two new police officer candidates will be starting May 24; Tom Knutson and Dave Velasquez. High profile sexual misconduct case was handled and letters of commendation went to all involved in this detailed case. Letters of commendation were also given to officers who assisted the fire evacuation of tenants at 8120 E. Pt. Douglas on May 6. Captain Woolery also wished to thank the fire department for the great job they did. Page 14 PSHWC Meeting May 16, 2006 FIRE - AI Beasley also wished to thank the police department personnel who responded to the East Pt. Douglas fire call and commended them for their quick evacuation of tenants. Ai Beasley advised that 2 part time fire fighter/EMTs resigned in the past two weeks. He went on to say that part time fire fighter pay increased to $10 per hour. COUNCIL - None at this time.
