HomeMy WebLinkAbout2002-05-13 MINUTESCITY OF COTTAGE GROVE PUBLIC WORKS COMMISSION May 13, 2002 Pursuant to due call and notice thereof, a meeting of the Public Works Commission of Cottage Grove was duly held at the Public Works Garage, 8635 West Point Douglas Road, Cottage Grove, Minnesota, on May 13, 2002, at 7:00 p.m. 1. CALL TO ORDER Chair Ken Boyden called the meeting to order at 7:00 p.m. 2. ROLL CALL Members Present: Ken Boyden, Steve Ingram, Dan Massarotti, Randy Eckstein, Jan Wuorenma, Roger Finnegan Staff Present: Les Burshten, Public Works Director Allan Larson, Public Works Technician Also Present: David Anderson, potential PWC Member Jim Wolcott, City Council Member 3. APPROVE MINUTES On a motion by Steve Ingram seconded by Jan Wuorenma, the April 8, 2002 Public Works Commission minutes were approved unanimously. 4. ADDITIONAL AGENDA ITEMS None 5. NEW BUSINESS A. NRG PROCESSING (Compost Site) Contract Review Public Works Technician Allan Larson explained that changes and/or additions to the compost site contract enclosed with the packet are indicated by underlines or strikethroughs noting there are no major changes. He added that he would like to discuss questions the PWC members have at this time. Public Works Commission May 13, 2002 — Page 2 Commission Chair Ken Boyden questioned item 3.4 on page three of the contract. He indicated the contract strikes the phrase: "T"^ "^^^'^� ^� ^^�" ;^ ^ +"^ f ^° ^ . ." Boyden indicated that contract language is not in place that stops NRG from raising fees. Larson agreed, however noted the following statement is also included: `The City shall be notified of the fee schedule thereto, prior to implementation". Boyden inquired whether the contract is in effect for two years to which Larson responded that it was. Discussion ensued regarding length and terms of the contract to which Public Works Director responded that in a worse case scenario, the contract could be terminated. Commission Member Wuorenma commented that in her experience with contracts such as this, it would be reasonable to have some type of guaranteed fees for the life of the contract. She added that unless there's contract language that fee increases are mutually agreed upon by the signing parties of the contract, iYs reasonable to think some sort of fee cap should be in place. Commission Member Randy Eckstein inquired whether the City Council would be notified of this commission's concerns about the tipping fees. At this time, it was mentioned that a motion may be put in place regarding the tipping fees portion of the contract. MOTION TO APPROVE THE CONTRACT BETWEEN THE CITY OF COTTAGE GROVE AND NRG PROCESSING SOLUTIONS FOR OPERATION AND MAINTENANCE OF YARDWASTE FACILITY PROVIDING A FEE CAP OR MUTUALLY AGREED UPON FEE INCREASE IS INCLUDED IN SAID CONTRACT. MOTION MADE BY JAN WUORENMA, SECONDED BY DAN MASSAROTTI. MOTION CARRIED. B. TECHNICAL REVIEW 6.1 CASE V02-036 Keith and Michelle Lidberg have applied for a variance to Title 11-2-4D, Visibility, of the City Code to allow an addition on a detached garage to be constructed 15 feet from the side property line when a 20-foot setback is required at 8813 Hadley Avenue South. Larson explained that the homeowners wish to increase the size of their garage to bring it up to date for more valid use. Planning will likely grant the variance. 6.2 CASE ICUP02-037 Rumpca Excavating has applied for an interim conditional use permit to allow on-site crushing and recycling of construction material at Up North Plastics, 9480 Jamaica Avenue South. Since the area is contained in the industrial park, staff will likely approve the variance. Public Works Commission May 13, 2002 - Page 3 6.3 CASES SP02-042 and CUP02-043 Crossroads Church has applied for a site plan review and conditional use permit to allow expansion of their parking lot at 7955 Ivystone Avenue south. Larson explained that this is a request to do some improvements to their site and indicated existing ponding on the site must be improved. 6.3 CASE ZA01-058, PP01-059, and SP01- 060 (continued from 4/22/02) Thompson Land Development has applied for a zoning amendment to change the zoning from R-2.5, Residential, and R-5, Medium Density Residential, to PUD, Planned Unit Development; and a preliminary plat and site plan review with variance of a multi- family residential development consisting of 300 dwelling units to be located on the northwest corner of 70 Street and Hinton Avenue. Case is still pending. 6.4 CASES SP02-038, CUP02-039, AND V02-040 KK Design, Alliance Representative for BP/Amoco, has applied for a site plan review and conditional use permit for a proposed new convenience store with six MPD's, a solar canopy, and a new canvash; a variance to Title 11-10B-6C, Development Standards in a B-2 Zoning District, to reduce the rear yard setback from the required 30 feet to 10 feet and to reduce the front yard setback from the required 60 feet to 54 feet. The proposed gas station/convenience store would be located at 8490 East Point Douglas Road South. Larson explained that an earlier request indicated the driveway entrance very close to the intersection of Jamaica and E. Pt. Douglas. The driveway has now been placed to the rear of the property. 6.5 CASE PP02-041 Pulte Homes has applied for a preliminary plat for Timber Ridge 3 rd Addition, which would consist of 115 lots for single family homes to be located south of the Timber Ridge subdivision and east of the Hidden Oaks subdivision. Commission Member Dan Massarotti stated development names (such as Timber Ridge) are unclear and suggested that street locations be included with the names in order to better identify the sites. Larson stated the first phase, built last year, is located at 70 Street and Harkness Avenue. Staff is concerned at this point about poor access to a proposed ponding area. Pond Concerns Massarotti inquired if steps can be taken by the City to prevent ponds from becoming health hazards. He added duck and geese inhabit ponds and wondered if a pond can be built in such a way to discourage this. He added if steep walls are built, there is just a 50% chance these animals will inhabit the area, however added safety becomes an issue with the construction of steep walls. Burshten agreed, stating that safety is the Public Works Commission May 13, 2002 — Page 4 most important factor in the design of the holding ponds, indicating thaYs the reason for the fairly flat slopes. Burshten added that a wrought iron fence will be constructed around the pond as well. Wuorenma wondered whether evidence exists indicating that waterfowl excrement contains parasites and other things, noting this topic may be worth a bit of research. Case PP02-041 (continued) Timber Ridqe Third Addition Commission Member Steve Ingram stated concerns with the proposed private driveway on the site indicating that it must be maintained and plowed. He suggested an agreement be made between the developer and the City stating the developer would maintain the roadway. Discussion ensued whereas members wondered if the driveway was actually necessary at that particular location. There was a consensus amongst the group that this private driveway does not appear to be a necessary part of the proposed Timber Ridge Addition. 6. OLD BUSINESS A. Pavement Management Burshten stated Danner started the project a couple of weeks ago and the work is going well despite the rain. Xcel Energy is staying ahead of them and doing a nice job. Overall, there have been minimal complaints from residents. "'Council Member Wolcott arrived at this time 7. PUBLIC WORKS UPDATE • The Public Works Open House will be Thursday, May 23 ■ Sod will be repaired on May 15 (in areas damaged by snowplows) ■ The seal coating project was re-bid. Allied Blacktop was the second bidder on the first bid date, however was low bidder the second time coming in lower. • The 103 Street Bridge area was closed earlier in May due to structural deficiencies discovered by Bonestroo. On Tuesday, May 7, the area reopened, deemed safe by Burlington Northern representatives. Wuorenma inquired if something were to happen regarding the bridge, who would be liable? Burshten responded the railroad would be responsible should anything happen, however, he noted the railroad will continue to monitor the area frequently. • Crack sealing was finished today. Public Works Commission May 13, 2002 — Page 5 ■ Spring Clean Up was held on May 4. 1,252 residents (about 100 cars per hour) took advantage of this clean-up opportunity with traffic at times backing up to Jamaica Avenue. • 10 hours workdays have started for the Streets and Parks Divisions for the summer months. 8. CITY COUNCIL UPDATE Ice Arena ■ The Ice Arena will enter into a contract with Coca Cola. Coca Cola offered $10,000 in marketing for a five-year contract. The funds will be put towards a new sound system. • New floor matting is being installed at a cost of $43,000, however, the Cottage Grove Hockey Association is donating $18,000 towards the project. • A new ball field is being proposed for the new Rose of Sharon site off 70` Street. • The first ballgame will be held tonight at the newly refurbished Woodridge grass infield. 9. ENGINEER'S REPORT No further discussion. 10. COMMISSON COMMENTS AND REQUESTS Jan Wuorenma announced the Great Grove Get Together will take place the weekend of June 8-9. 11. ADJOURNMENT
