PUBLIC WORKS COMMISSION
May 10, 2004
Pursuant to due call and notice thereof, a meeting of the Public Works Commission of
Cottage Grove was duly held at the Public Works Garage, 8635 West Point Douglas
Road, Cottage Grove, Minnesota, on May 10, 2004 at 7:00 pm.
1. CALL TO ORDER
Chair Ken Boyden called the meeting to order at 7:00 pm.

5. NEW BUSINESS
A. Technical Review
6.1 CASE VO4-023
Delano Nelson has applied for a variance to allow construction of a garden shed in front
of his principal structure at 11801 Lockridge Avenue South.

6.2 CASE CUPO4-021
Ryan and Kathryn Maloney have applied for a variance to allow construction of a new
home 20 feet from the bluff line when 100 feet is required and 10 feet from the side
property line when 25 feet is required. This new home will be located on Lot 1 of Hale's
River Bluff Acres.
6.3 CASE VO4-025
Kenneth J. Trunnell, Jr., 8450 Jody Court South, has applied for a variance to allow a
sport court to be setback 3 feet from the side property line when 10 feet is required.
6.4 RSO4-026
Minnesota Pipeline Company has applied for a simple lot division to subdivide a 4.592
acre parcel into two parcels of 4.556 acres and .036 acres. The lot division is being
done to adjust the lot line to include all pipeline equipment on the Minnesota Pipeline
Property. The parcel is located south of 85� Street, north of the tank farm, and east of
Felde Addition.

Adam Paul Jaros has applied for an interim conditional use permit to allow temporary
outdoor sales of fireworks from a tent to be located at the Jamaica BP Amoco Station at
8490 East Point Douglas Road S.
B. Single Sort Recycling Program
Public Works Director Les Burshten explained that single sort recycling, along with
review of the current licensed hauler status will be discussed at the June 14, 2004
meeting. It is expected some City Council members will be in attendance along with
trash hauler representatives.
C. Stormwater Utility — Five Year Report
Burshten explained that the Stormwater Utility Fund was implemented for the
maintenance and cleaning of existing infrastructure, including ponds, pipes, drainage
ditches and drainage areas, however, added that the fund did not cover new
construction areas. Taxpayers in Cottage Grove are now paying an annual fee of
$21.00 per parcel or lot. Burshten went on to state that maintenance of storm water
areas is an unfunded mandate that the City is subject to.
Public Works Management Analyst Brian Voelker explained that many ponds in the City
are filling up with sand, gravel and excess material. In order to increase the quality of
the water, these materials must be removed.

In 1987, Congress implemented the Clean Water Act in order to establish N.P.D.E.S.
(National Pollutant Discharge Elimination System) requirements for stormwater
discharge. In 1990, initial permit applications were required for stormwater discharge
associated with industrial and municipal storm water systems for populations of
100,000 or more which was NPDES Phase 1. Phase 2 of the program is now being
reviewed.
Voelker explained that he has prepared estimated total costs of stormwater
maintenance and repair projects for the next five years, including:
Projects completed by City staff:
. Repair/replacement of pond inlet and outlet structures
• Pond maintenance (minor repairs)
• Pond mowing
. Rural ditch improvements
. Street sweeping city system (contracted)
• Storm sewer pipe and flume cleaning
Projects that must be completed by a contractor are as follows:
• Pond and structure improvements
. Pond maintenance (major sediment removal)
• Storm sewer pipe and flume cleaning
• Sump CB Cleaning
. Storm sewer pipe and structure repair
Additionally, there are NPDES- associated costs, including:
• Outside consultant engineers
. City Staffing (administrative and field
and storm piping)
• Storm sewer mapping updates
. Drainage district management analyst.
Inspection/ evaluation of existing ponds
Total stormwater utility-related costs total $1,806,678.30. To cover the repairs, annual
fees to taxpayers must be raised from the $21.00 per year currently being charged.
Additionally, there is an issue regarding maintenance of private ponds. For example, a
pond on the Menard's property must be maintained by Menard's. A problem may
occur when privately owned ponds are not properly maintained and cleaned.
It was discussed that costs for stormwater maintenance costs will level off eventually as
projects are completed, however, it may take awhile to get to this point.

Commission Member David Thiede inquired whether there was an overall plan for
ponds, as an example, the East Ravine area. Allan Larson responded that yes, this
would be part of the stormwater mapping process whereby an overall city map is
created showing existing and proposed ponds which will give the City a better idea on
the size of the pond to be used in a particular area.
In order to enter stormwater pond areas, each pond is required to have a maintenance
bench for proper access and for minimal disruption to the site. Another solution for
easy access to stormwater ponds would be through an out lot.
Thiede feels that residents should be informed of the stormwater plan in order to
address their questions or concerns about the increase in fees. Boyden added that
iYs important residents realize this is a federally mandated project and the City doesn't
have any option but to comply
Commission Member Randy Eckstein asked where funds were allotted for this work
before the stormwater utility fund existed. Burshten explained that costs were covered
by the general fund. Work was done on an as-needed basis and probably totaled
between $15,000-$30,000 per year.
Eckstein suggested it be emphasized that there only be public and no private ponds. In
this way, the City can ascertain pond areas are maintained and cleaned appropriately.
MOTION
THE PUBLIC WORKS COMMISSION IS IN AGREEMENT THAT THE CURRENT
ANNUAL STORMWATER MAINTENANCE FEE OF $21.00 BE INCREASED.
MOTION CARRIED UNANIMOUSLY.
Thiede suggested the annual rate be consistent with costs incurred with the
understanding the fee may be reduced as projects are complete.
6. OLD BUSINESS

7. PUBLIC WORKS UPDATE
80 Street Street Liqhts
The concrete bases are beginning to crack, however, the lights are still under a 10-year
warranty. The poles will be replaced and a portion of the installation cost will be
covered.
Pool Maintenance
Painting is being done today and tomorrow. Once again, the YMCA will operate the
facility, however, the City will have more input on operation of the pool this year.

. The intersection at Jamaica and Hillside is being repaired.
. Sealcoating will begin June 14
. Trees are being planted in various parks (Tree Mitigation)
. The Parks Department continues to battle dandelions
. Two horticulture interns are being hired
. Thompson Grove Traffic Study will be reviewed by the Public Safety Commission
tomorrow evening
• Spring Clean-Up on May 1st was again a success - 1,025 cars dropped by
Public Works to dispose of unwanted items, including hazardous waste.
8. EAST RAVINE UPDATE.
No new information.
9. CITY COUNCIL UPDATE
Meetina Schedule Chanqe
Wolcott explained that due to budget meetings, the City Council will meet just once
instead of twice in August —(August 11).
Stoltz Propertv — North of Kohis
. Due to concerns regarding inadequate space for semi trucks, as well as public
safety concerns, the building will be reduced 6 feet on the west end. There will
be no insurmountable curb. Additionally, two parking spaces have been
removed.
. A speed study will be done on Harkness Avenue.
. A workshop was also held regarding garden centers.
10. ENGINEERS REPORT
None.
11. COMMISSION COMMENTS AND REQUESTS
Ken Boyden indicated he received a notice of a meeting to take place on May 24 at the
Woodbury City Hall dealing with environmental issues, focusing on buckthorn.
