HomeMy WebLinkAbout2012-01-18 PACKET 08.A.REQUEST OF CITY COUNCIL ACTION COUNCIL AGENDA MEETING ITEM # DATE 1/18/2012 PREPARED BY City Clerk Caron Stransky ORIGINATING DEPARTMENT DEPARTMENT HEAD COUNCIL ACTION REQUEST Allow the representatives for Apple Minnesota, LLC, DBA/ Applebee's Neighborhood Grill & Bar; Veterans of Foreign Wars, DBA/ Cottage Grove VFW Post 8752; and MOPECA of Cottage Grove Inc., DBA/ Las Margaritas Bar and Grill, to admit to or deny the allegations that their establishments sold alcohol to a minor, under 21 years of age, during a Public Safety Department compliance check on November 29, 2011. STAFF RECOMMENDATION A. If the representatives admit to the violation or fail to attend the City Council meeting, impose the following scheduled fines: 1. Apple Minnesota, LLC DBA/ Applebee's Neighborhood Grill & Bar - $500.00 for a first violation in a 24 -month period. 2. Veterans of Foreign Wars, DBA/ Cottage Grove VFW Post 8752 - $500.00 for a first violation in a 24- month period; and 3. MOPECA of Cottage Grove, Inc., DBA / Las Margaritas Bar and Grill - $1,000 for a second violation in a 24 -month period. B. If the representatives deny the violation, schedule a contested -case hearing before an Administrative Law Judge. On this date a total of eighteen (18) compliance checks were attempted. Four businesses were closed at the time of the checks. They were Boondocks, Cedarhurst, River Oaks, and Mississippi Dunes. Of the remaining 14 establishments, there were three failures. They were Applebee's, VFW, and Las Margaritas. Since 2005, this is the first failure for both Applebee's and the VFW. In that same time frame, this is the sixth failure for Las Margaritas. The dates of their previous failures are 10- 19 -05, 9- 27 -07, 5- 14 -08, 5- 28 -09, and 5- 31 -11. The eleven (11) establishments that passed were Ruby Tuesday G -Will Liquors Super America MGM American Motorsports Bar and Grill Rainbow Shamrock Liquors Top Ten Wine and Spirits Cub Foods Carbones Dennis Brothers The data base in the police drive will be updated shortly. I have notified Washington County Public Health of the results. I will also be notifying the businesses that successfully passed this compliance check.
