COUNCIL ACTION REQUEST
Allow the representative for Apple Minnesota, LLC, DBA/ Applebee's Neighborhood Grill & Bar
to admit to or deny the allegation that their establishment sold alcohol to a minor, under 21
years of age, during a Public Safety Department compliance check on November 29, 2011.
STAFF RECOMMENDATION
A. If the representative admits to the violation or fails to attend the City Council meeting,
impose the following scheduled fine: $500.00 for the first violation in a 24 -month period. B. If
the representative denies the violation, schedule a contested -case hearing before an
Administrative Law Judge.

Subject: Alcohol Compliance Checks
On Tuesday November 29 ", Officer Liermann conducted alcohol compliance within the
City of Cottage Grove. On this date a total of eighteen (18) compliance checks were
attempted, Four businesses were closed at the time of the checks. They were
Boondocks, Cedarhurst, River Oaks, and Mississippi Dunes.
Of the remaining 14 establishments, there were three failures. They were Applebee's,
VFW, and Las Margaritas, Since 2006, this is the first failure for both Applebee's and
the VFW. in that same time frame, this is the sixth failure for Las Margaritas. The dates
of their previous failures are 10- 19 -05, 9- 27 -07, 5- 14 -08, 5- 28 -09, and 5- 31 -11.
The eleven (11) establishments that passed were:

G -Will Liquors
Super America
MGM
American Motorsports Bar and Grill
Rainbow
Shamrock Liquors
Top Ten Wine and Spirits
Cub Foods
Carbones
Dennis Brothers
The data base in the police drive will be updated shortly. I have notified Washington
County Public Health of the results. I will also be notifying the businesses that
successfully passed this compliance check.
