SUBJECT: Belden Boulevard Railroad Crossing Improvements
Approve Agreement No. 96778 Amendment
Background /Discussion
The City had received $60,000 to construct concrete medians and a new road section at the
Belden Boulevard railroad crossing. These safety improvements are funded by federal aid and
are part of the State Transportation Improvement Program for 2011. In September 2011 the
City was notified an additional $10,000 was being provided for the improvement. The
enclosed agreement amends agreement 96778 Revision 1 cost estimate.
2.2.1 Estimated costs for this project are $55,000 for road construction, $9,000 for
construction engineering and $5,000 for flagging services.
2.2.2 It is anticipated that 100% of the cost of the road construction will be paid from federal
funds made available by the FHWA and anticipated not to exceed $70,000
Staff's recommendation is to approve the agreement for the additional $10,000. Construction
is anticipated in the summer, 2012.
Recommendation
It is recommended the Council adopt the resolution approving the MN /DOT agreement
NO.96778 amendment for the Belden Boulevard railroad safety improvements.
RESOLUTION NO. 2012- [Resolution Number]
RESOLUTION AMENDING MNIDOT AGREEMENT NO. 96778 FOR THE
BELDON BLVD. RAILROAD CROSSING IMPROVEMENTS.
WHEREAS, the City of Cottage Grove entered into an agreement with the
Soo Line Railroad Company (d /b /a Canadian Pacific Railway) and the
Commissioner of Transportation to enhance grade crossing safety by
constructing safety improvements to Belden Blvd. railroad crossing, and
WHEREAS, in September 2011 the City was notified an additional
$10,000 was being provided for the improvements, and
WHEREAS, it is anticipated 100% of the cost of the road construction will
be paid from federal funds made available by the FHWA and anticipated not to
exceed $70,000, and
NOW, THEREFORE, BE IT RESOLVED, the City Council of Cottage
Grove, Washington County, Minnesota hereby approves an amendment to
MN /DOT agreement No. 96778 for the additional fund of $10,000 for the Belden
Boulevard railroad safety improvements.
BE IT FURTHER RESOLVED, the Mayor Myron Bailey and the City Clerk Caron
Stransky are hereby authorized to execute said agreement and any amendments
thereto for and on behalf of the City.

This amendment is by anXbetween the State of Minnesota, through its Commissioner of Transportation
( "State ") and Soo Line Railroad Company (D/B /A Canadian Pacific Railway) ( "Company ") and the City of
Cottage Grove ( "City ").
Recitals
1. The State has a contract with the City and Company identified as Mn/DOT Contract Number 96778
( "Original Contract ") to provide reimbursement to the City for the installation of median islands at a
railroad crossing identified as USDOTNO. 39125913.
2. Agreement No. 96778 dated December 9, 2011 is being amended because the available funds from
FHWA for this project have increased.
3. The State, City and the Company are willing to amend the Original Contract as stated below. -
Contract Amendment
In this amendment deleted Contract terms will be `^eke and the added Agreement terms will be bolded and
underlined.
REVISION 1. "COST ESTIMATE" is amended as follows:
2.2.1 Estimated costs for this project are $45,000 $55,000 for road construction, $9,000 for
construction engineering and $5,000.00 for flagging services.
2.2.2 It is anticipated that 100% of the cost of the road construction will be paid from federal funds
made available by the FIIWA and anticipated not to exceed $60,000.00 $70,000
Except as amended herein, the terms and conditions of the Original Contract remain in full force and effect.
