While updating the EMS contracts it was discovered that a 2011 EMS contract was not signed. There have been no changes to the contracts. We have reviewed with Finance and determined that the rate will remain flat in 2012. Grey Cloud Township continues to satisfy its non - payment debt. The Grey Cloud Town Board has approved the contract for both 2011 and 2012 and signed the contracts. The fee will be re- evaluated for 2013. Please place this item on the March 7, 2012 Cottage Grove City Council agenda for approval. Thanks. PJK/cce Attch. 12 -001 EMERGENCY MEDICAL SERVICES CONTRACT BETWEEN THE CITY OF COTTAGE GROVE AND THE TOWNSHIP OF GREY CLOUD 2011 THIS AGREEMENT, made and entered into on this 1st day of January, 2011, by and between the City of Cottage Grove, a municipal corporation, (hereinafter the "City "'), and Grey Cloud Island Township, (hereinafter the "Township "). WHEREAS, the City of Cottage Grove operates Emergency Medical Services which include ambulances and paramedics (hereinafter the "Services "), and WHEREAS, the Township desires to contract with the City for these Emergency Medical Services, and NOW THEREFORE, IT IS HEREBY AGREED by and between the parties hereto as follows: 1. Term. This agreement shall be for the calendar year of 2011. 2. City Services The City of Cottage Grove shall provide the following: a) All necessary equipment and qualified personnel for each request for Services within the township. b) Each party furnishing personnel shall be solely responsible for the action of its personnel; for the payment of all compensation of any of its personnel, including any injuries sustained by any such personnel while responding to a call for Services. 3. Fees. In consideration of the City providing the above described Services, the Township shall pay to the City the following: a) For the calendar year 2011, the sum of $3,952.14 shall be paid. In addition to the foregoing fee, the Township shall pay the City for any ambulance bills which are for Services rendered in the Township that are uncollectible once they exceed the annual contracted amount. The City shall submit bills to the individuals receiving Services, and in the event of nonpayment, the City to shall promptly notify the Township of any uncollectible bills for Service. Upon receipt of the notice, the Township shall remit payment to the City for the uncollectible bill, or portion thereof, within 30 days of the City's date of billing. Upon payment to the City, the City shall assign all of its interest in and to any uncollectible bill to the Township. After the City's assignment, the Township shall be solely and exclusively responsible for any collection of any unpaid bill, and shall be entitled to collect all proceeds therefrom. 4. Rates. The City agrees to charge the same rates for Services rendered within the Township as are charged to City residents. The City reserves the right to establish and adjust rates as necessary at the discretion of the city. 5. Law Enforcement Function If the City is required to perform any law enforcement services necessitated by the delivery of Emergency Medical Services, such law enforcement services shall be billed at actual cost with a minimum of 1 hour of service.
