CONSENT CA�ENDAR A. Accept and Place on File the Following Minutes: i. Planning Commission Meeting Minutes from March 26, 2012. B. Consider proclaiming May 20 - 26, 2012 as National Public Works Week. Staff Recommendation: Adopt the proctamation. C. Consider adopting a resolution proclaiming May 15, 2012 as Police Officers' Memorial Day and the week of May 13 - 19, 2012 as National Police Week. Staff Recommendatron: Adopt the reso(ution. MAY 2, 2012 AGENDA Cottage Grove City Council D. Consider appointing Lezlie Schriver to the Human Services/Human Rights Commission to a seat expiring February 28, 2014. StaffRecommendation: Approve the appointment. E. Consider approving the South Washington Watershed District agreements for the Cottage Grove PSCH Rain Harvesting System, Woodridge Park Pond Improvements, and ED-P5 Pond Improvements in the value of $246,495.00. Staff Recommendation: Adopt the resolutions. G. Consider approval for the purchase of: (2) Toro GroundsMaster 7210 D Mowers from MTI Distributing for a total price of $40,766.82, (1) John Deere 997 �uiiiifEiCiai L.C. �iese{�Max-Frane Z-Trak Mower fr�r� Joyr �eer �a���pary for a total price of $16,532.81 and (1) John Deere 14-Bushel, 3-Bag Material Collection System for the 997 w/ 60" Deck from Frontier Ag & Tur� for a total purchase price of $4,085.83. Staff Recommendation: Approve the purchases totaling $61,385.46. The budgeted amount for these purchases is $77,000.00. H. Consider not waiving the torf liability iimifs. Staff Recommendation: Staff recommends that the City Council not waive the statutory tort limits where an individual ctaimant would be able to recover no more than $500,000 on any claim to which the statufory tort limits appfy. The total which all clarmants would be able to recover for a srngle occurrence to which the statutory tort limits apply would be limifed to $1.5 million. I. Consider renewal of the workers compensation policy from the League of Minnesota Cities Insurance Trust (LMCIT) totaling $248,337 with a$10,000 per occurrence medical deductible and 14.5% premium credit. Staff Recommendation: Authorize the renewal. "J. Consider authorizing issuance of a temporary liquor license to the Cottage Grove Lions in conjunction with Frank Mackall "We Have Your Back" Benefit which is being held at the Cottage Grove VFW on June 3, 2012. Staff Recommendation: Authorize issuance of the temporary liquor license. During the required background investigation, no facts were found thaf would constitute a basis for denial of the application. 5. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES A. Receive response regarding recreational fires. 6. PUBLIC HEARINGS A. 1. Conduct the public hearing considering the assessment for the removal of weeds on private property. 2. Consider adopting the resolution adopting the assessments. Staff Recommendation: Hold the public hearing and adopt the resolution. 3. i-ioid the pubiic hearing and consider approvai ofi a spending pian for i ax Increment Financing District 1-1, 1-2, 1-8, and 1-12 under Minnesota State Statutes Section 469.176 Subd. 4m to utilize existing tax increment revenues from TIF districts to stimulate construction/rehabilitation of private development in a manner which will create or retain jobs. Staff Recommendafion: Hold the pubiic hearing and adopt the resolution approving the spending plan. MAY 2, 2012 AGENDA Cottage Grove City Council BID AWARDS A. Consider awarding the bid for the 2012 Joint Seal Coat Program for the Cities of Cottage Grove, St. Paul Park, Newport and Denmark Township to Pearson Brothers, Inc. in the amount of $493,259.76. Staff Recommendafion: Award the bid to Pearson Brothers, Inc. Pearson Brothers, Inc. submiffed the lowest of Phree bids received. UNFINISHED AND NEW BUSINESS A. Consider granting a variance to Title 11, Chapter 4, Section 6(G), Siting of the City's Zoning Ordinance for purposes of reducing the wind turbine minimum setback requirement of 1,320 feet from a public park to approximately 230 feet and approving a conditionaf use permit to aliow construction ot a 20kVV wind turbine consisting of a 99-foot monopole with 30-foot diameter rotor at the southwest corner of Werner Electric's building at 7450 — 95th Street South. Staff Recommendation: Adopt the resolution granting the variance and approving the conditional use permif, per the recommendation of the City's Planning Commission; Parks, Recreation and Natural Resources Commission; and Economic Development Authorify. 9.
