CONSENT CALENDAR A. Accept and Place on File the Following Minutes: i. Environmental Commission Meeting Minutes from March 14, 2012 and April 11, 2012. B. Consider adopting a resolution proclaiming the week of May 20 — May 26, 2012 as Emergency Medical Services Week. Staff Recommendation: Adopt the resolutian. MAY 16, 2012 AGENDA Cottage Grove City Council C. 1. Consider passing an ordinance amending the City Code in reference to Criminal Histories and Background Investigations. 2. Consider adopting a resolution authorizing publication of the ordinance by title and summary. Staff Recommendation: Pass the ordrnance and adopt the resolution. D. Consider approving the final plat for Pineciiff 5th Addition, which consists of 27 single- family lots. Sfaff Recommendation: Adopt the resolution approving the final ptat for Pineclitf 5th Addition. E. 1. Consider approving an amendment to City Code Title 11-3-3A, Accessory Structures, to clarify exterior finish requirements for detached accessory structures. 2. Consider authorizing the publication of the ordinance amendment relative to accessory structure exterior materials by title and summary. Staff Recommendation: 1. Pass the ordinance amendment. 2. Adopt the resolution authorizing publication by title and summary. F. 1. Consider approving an amendment to City Code Title 11, Chapter 10, Business Districts, to update the ordinances relating to the City's commercial zoning districts. 2. Consider authorizing the publication of the ordinance amendment relative to updating the City's commercial zoning districts by title and summary. Staff Recommendatron: 1. Pass the ordinance amendment. 2. Adopt the resolution authorizing publication by tit(e and summary. G. 1. Consider approving an amendment to City Code Title 11-9A-3(3), Home Occupations, to delete the home occupation permit and fee requirements and to amend the home occupation criteria performance and enforcement standards. 2. Consider authorizing the pubiication of the ordinance amendment relative to home occupations by title and summary. Staff Recommendation: 1. Pass the ordinance amendment. 2. Adopt the resolution authorivng publication by title and summary. H. Consider approving the 2012 — 2014 Patrol and 49er Labor Contracts, adopting a resolution approving the 2012 Non-Represented Pay Plan and adopting a resolution amending the Personnel Policy to include a Short-term Disability Bank. Staff Recommendation: Approve the Labor Contracts, adopt the resolution approving the non-represented pay plan, and adopt the resolution amending the Personnel Policy. *I. During the required background check, no facts were found that woutd constitute a basis for denial of the apptication. "`J. Staff Recommendatron: Authorrze issuance of the tobacco sa/es license. During the required background check, no facts were found that would constitute a basis for denial of the application. 'K. Consider approving the purchase of three new replacement police squad vehicles and one unmarked vehicle from Nelson Auto Center in Fergus Falis, for a total purchase price of $104,809.07 with the remaining $17,990.93 to be allocated for equipment, installation and setup. Staff Recommendation: Approve the purchase. "`L. Consider authorizing a response to the Office of the State Auditor. Staff Recommendation: Authorize the response. "M. Consider proclaiming June 3, 2012 as Officer Frank Mackall Day in the City of Cottage Grove. Staff Recommendation: Proclaim June 3, 2012 as Officer Frank Mackall Day in the Crty of Cottage Grove. 5. RESPONSE TO PREVIOUS�Y RAISED OPEN FORUM ISSUES 6. PUBLIC HEARWGS MAY 16, 2012 AGENDA Cottage Grove City Council 7. BID AWARDS A. Consider awarding the bid for the Belden Rail Crossing to Hardrives, Inc. in the amount of $95,416.80. Staff Recommendatron: Award fhe bid for the Betden Rail Crossing to Hardrives, lnc., who submitfed the Iowest of three bids received. 8. UNFINISHED AND NEW BUSINESS A. AIIow the representative for RBF, LLC of Wisconsin / DBA Rainbow Foods to admit or deny the ailegation that their business sold aicohol to an underage buyer during the Public Safety DepartmenYs compliance check on April 10, 2012. Staff Recommendation: If the representative admits to the violation, impose the schedule penalty for their lst violation in a 24-month period of a$500.00 fine and one-day suspension, or, at the Ciry CounciPs discretion, in lieu of the suspension, the participation of all employees in an educational program approved by the Public Safery Director. If the representative denies the allegation, schedule a contested case hearing before an administrative lawjudge. B. 1. Consider authorizing approval of the development agreement with Stonehenge USA contingent upon Council adoption of planning authorizations. 2. Consider adopting a resolution approving modification of the minimum assessment agreement with Home Depot from 2002 to reflect the increase in minimum market value both of which are necessary in order to provide the opportunity for redevelopment of the current Home Depot parcel at 7210 East Point Douglas Road.
