WHEREAS, Plans and specifications were completed according to City standards, and WHEREAS, bids were requested to provide the necessary work, and WHEREAS, three firms submitted bids, and WHEREAS, it appears that Michels Corporation is the lowest responsible bid, and WHEREAS, it is the recommendation of the City Engineer the bid be awarded to Michels Corporation in the amount of $158,721.24 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Cottage Grove, County of Washington, State of Minnesota, the bid for the City of Cottage Grove Metropolitan Area Fiber Optic Network Expansion be awarded to Michels Corporation in the amount of $158,721.24. Grove Metropolitan Area Fiber Optic Network Recommendation Metropolitan Area Fiber Optic Network Recommendation 1. Document Goal The purpose of this study is to surrunarize our evaluation of the Metropolitan Area Fiber Optic Network Expansion bids for the City of Cottage Grove and to present our recommendation. Our evaluation of the bid responses is based upon the submitted pricing, vendor qualifications /capabilities, and completeness of the responses. 2. Bid Matrix Three (3) bids were submitted in response to the Bid for Metropolitan Area Fiber Optic Network Expansion. The following vendors submitted responses: 1) Michels Corporation 2) MP Nexlevel, LLC 3) TelCom Construction Bidder Bid Bonds Base Bid Michels x $158,721.24 MP NexLevel LLC Maple Lake, MN x $187,200.00 TelCom Construction Clearwater, MN x $162,200.00 3. References for Michels Michels received very positive feedback. According to their references, they were knowledgeable about the products they installed, they were pleasant and easy to work with, they stuck to their budgets, and they had quality installations. 4. Recommendation Elert & Associates recommends the City of Cottage Grove select Michels for the installation of the fiber optic infrastructure for Metro Area Fiber Network Expansion, per the specifications dated May 7, 2012. The main reasons for this decision are: ➢ The Contractor met all requested specifications. ➢ The Contractor is the lowest qualified bidder. Elert & Associates Page 2 The City of Cottage Grove Metropolitan Area Fiber Optic Nehvork Recommendation 5 Recommended Amount ofAward Base Bid $158,721.24 6 Contract Issues As part of the contract between the selected vendor and the City of Cottage Grove, Elert & Associates recommends that the original Request for Bid (RFB) be made part of the agreement. Further, this language should be added to the contract: "In the event of a discrepancy between the contract and the original RFB, the terns and provisions of the RFB shall take precedence." Any modifications or clarifications as well as all alternates selected should be included in the contract, including any cost changes. 7 Other Recommendations Elert & Associates recommends the review of purchasing, recommendation criteria, and procedures by the City of Cottage Grove legal counsel prior to award of the project to ensure compliance and compatibility with all public laws, policies, and procedures. Elert & Associates further strongly recommends the City of Cottage Grove require the selected vendor to provide a performance bond prior to the start of the project. Elert & Associates represents that the information and recommendations contained within this report are prepared for the City of Cottage Grove based on the most current data made available during the specified study period. This report is meant to be only advisory in nature. The City of Cottage Grove management is responsible for all consequences resulting from its decisions in accepting, rejecting, or implementing these recommendations. Elert & Associates Page 3
