Present: Mayor Sandy Shiely Council Member Myron Bailey Council Member Fred Luden Council Member Pat Rice Also Present: Ryan Schroeder, City Administrator Howard Blin, Community Development Director Les Burshten, Public Works Director Ron Hedberg, Finance and Administrative Services Director Jennifer Levitt, City Engineer Craig Woolery, Public Safety Director Not Present: Council Member Mark Grossklaus Mayor Shiely opened the Open Forum at 7:15 p.m. There being no speakers, Mayor Shiely closed the Open Forum at 7:15 p.m. CALL TO ORDER The City Council of the City of Cottage Grove, Washington County, Minnesota, held a regular meeting on Wednesday, November 19, 2008, at the Cottage Grove City Hall, 7516 80 Street South. Mayor Shiely called the meeting to order at 7:30 p.m. ROLL CALL Present: Mayor Sandy Shiely Council Member Myron Bailey Council Member Fred Luden Council Member Pat Rice Regular Meeting — November 19, 2008 Cottage Grove City Council Also Present: Ryan Schroeder, City Administrator Howard Blin, Community Development Director Les Burshten, Public Works Director Ron Hedberg, Finance and Administrative Services Director Corrine Heine, City Attorney Jennifer Levitt, City Engineer Craig Woolery, Public Safety Director Not Present: Council Member Mark Grossklaus ADOPTION OF AGENDA Mayor Shiely reported additions to the evening's agenda: approval of minutes from the October 15, 2008, Regular Counting Meeting, and Consent Agenda Item G, consider adopting a resolution authorizing the City to apply for a grant and enter into an agreement with the State regarding safety vests. MOTION BY RICE, SECONDED BY LUDEN, TO APPROVE THE AGENDA AS AMENDED. MOTION CARRIED 4-0. PRESENTATIONS A. Eaqle Scout Award Presentation: Matthew G. Newman of Troop 777. Mayor Shiely congratulated and presented, on behalf of the Council and City, a plaque to Matthew G. Newman of Troop 777 in recognition of his achievement of the Eagle Scout Award. Mr. Newman explained his project, which was to build cubbies at the daycare center at Zion Lutheran Church. APPROVAL OF MINUTES A. October 15, 2008, Reaular Meetinq Mayor Shiely stated that the minutes stood approved as submitted. CONSENT CALENDAR MOTION BY BAILEY, SECONDED BY LUDEN, TO: A. ACCEPT AND PLACE ON FILE THE FOLLOWING MINUTES: I. PUBLIC SAFETY, HEALTH AND WELFARE COMMISSION MEETING FROM AUGUST 19, 2008. II. ECONOMIC DEVELOPMENT AUTHORITY MEETING FROM OCTOBER 2008. � Regular Meeting — November 19, 2008 Cottage Grove City Council III. ADVISORY COMMITTEE ON HISTORIC PRESERVATION MEETING FROM JULY 8, 2008. B. ENTER INTO AN AGREEMENT WITH THE YMCA TO OPERATE THE MUNICIPAL POOL FOR THE SUMMER OF 2009. C. ADOPT RESOLUTION NO. 08-200 ORDERING THE ABATEMENT OF NUISANCE CONDITIONS AT 7092 IRVIN AVENUE SOUTH. F. ADOPT RESOLUTION NO. 08-201 APPROVING THE 2009 PAY PLAN FOR NON-REPRESENTED EMPLOYEES. G. ADOPT RESOLUTION NO. 08-202 AUTHORIZING THE CITY TO APPLY FOR AND ENTER INTO AN AGREEMENT WITH THE STATE OF MINNESOTA, OSHA DIVISION, DEPARTMENT OF LABOR AND INDUSTRY, FOR A GRANT IN THE AMOUNT OF $1,142.50 FOR THE PURCHASE OF SAFETY VESTS FOR FIRE, EMS AND POLICE PERSONNEL. MOTION CARRIED 4-0. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES None. PUBLIC HEARINGS None. BID AWARDS None. UNFINISHED AND NEW BUSINESS A. 1� Consider adoptinq the ordinance amendment to allow real estate siqns and other similar temporarv sians to be located within the public riqht-of-wav from 11:00 a.m. to 6:00 p.m. on Saturdavs and Sundavs and from 10:00 a.m. to 2:00 p.m. on Tuesdavs. 2) Consider adoptinq a resolution authorizinq the publication of this ordinance amendment bv title and summarv. The Community Development Director provided information regarding the City's current sign ordinance. 3 Regular Meeting — November 19, 2008 Cottage Grove City Council The proposed ordinance amendment would allow real estate and other similar temporary signs to be located within the public right-of-way from 11:00 a.m. to 6:00 p.m. on Saturdays and Sundays and from 10:00 a.m. to 2:00 p.m. on Tuesdays. Mayor Shiely commented that she had seen "Vote Pizza Man" signs in the City, and the Community Development Director responded that only "bona fide" candidates should be allowed to display. He also stated that the City will be removing new home builder advertising development signs that have been placed for extended periods of time. MOTION BY BAILEY, SECONDED BY RICE, TO: ADOPT ORDINANCE NO. 848 TO ALLOW REAL ESTATE SIGNS AND OTHER SIMILAR TEMPORARY SIGNS TO BE LOCATED WITHIN THE PUBLIC RIGHT-OF-WAY FROM 11:00 A.M. TO 6:00 P.M. ON SATURDAYS AND SUNDAYS AND FROM 10:00 A.M. TO 2 P.M. ON TUESDAYS. MOTION CARRIED 4-0. MOTION BY MAYOR SHIELY, SECONDED BY RICE, TO: ADOPT RESOLUTION NO. 08-203 AUTHORIZING THE PUBLICATION OF THE ORDINANCE AMENDMENT BY TITLE AND SUMMARY. MOTION CARRIED 4-0. B. 1) Consider adoptinq an amendment to the fencinq rectulations in the Zoninq Ordinance. 2) Consider adoptinq a resolution authorizinq the qublication of #his zoninq ordinance amendment bv title and summarv. The Community Development Director said the issue came to light following a dispute befinreen two property owners when an unfinished fence side faced the other neighbor. This - called into question that regulations should state the finished side face out. The Planning Commission recommends that fencing be specified, with a maximum height of six feet except in the front yard, which would have a maximum height of four feet, and fencing running 15 feet from the property line be reduced to a maximum drop of 30 inches and be 50% transparent. Mayor Shiely asked about barbed wire and electric fencing. The Community Development Director said there are large lots with horses that are adjacent to residential properties and those would be allowed but barbed wire and electric fencing would not be allowed in residential urban areas. Council Member Bailey Community Development property owners would be City. inquired about maintenance should fencing deteriorate. The Director said fencing must be maintained in good condition and responsible for doing so, which may have to be enforced by the 4 Regular Meeting — November 19, 2008 Cottage Grove City Council MOTION BY RICE, SECONDED BY LUDEN, TO: ADOPT ORDINANCE NO. 849 TO THE FENCING REGULATIONS IN THE ZONING ORDINANCE. MOTION CARRIED 4-0. MOTION BY RICE, SECONDED BY BAILEY, TO: ADOPT RESOLUTION NO. 08-204 AUTHORIZING THE PUBLICATION OF THE ORDINANCE AMENDMENT TO THE FENCING REGULATIONS BY TITLE AND SUMMARY. MOTION CARRIED 4-0. RESPONSE TO PREVIOUSLY RAISED COUNCIL COMMENTS AND REQUESTS None. COUNCIL COMMENTS AND REQUESTS Mayor Shiely offered a reminder about the Applebee's fundraising all-you-can-eat pancake breakfast on Saturday 8-10 a.m. for the Holiday Train, which will be coming to Cottage Grove on December 12 from 5:30 p.m. to 6:30 p.m. Tickets will go into a drawing for finro Holiday Train rides from Hastings to Cottage Grove. PAY BILLS MOTION BY RICE, SECONDED BY LUDEN, TO APPROVE PAYMENT OF CHECK NUMBERS 157721 TO 157920 IN THE AMOUNT OF $752,353.84. MOTION CARRIED 4-0. WORKSHOP SESSION — OPEN None.
