The East Point Douglas Road Street and Utility Improvement Project (Phase 1) is being
considered currently in conjunction with the Wal -Mart development which was approved
by the City Council on September 5, 2012. The project is considered physically and
financially feasible.
The public improvements identified by the feasibility study will benefit properties in the
immediate area. Costs for Phase I of the project may be assessed to the properties
benefiting from the improvements. The feasibility study estimates the Phase 1 project
cost to be $2,974,665.41.
A schedule of the affected properties and the proposed assessment amounts is
included in the feasibility report, Appendix C (page 35 and 36). Negotiations with
property owners and developers have yielded agreements regarding the proposed
assessment amounts which would ultimately eliminate the need to complete the full
Statute 429 process. However, those agreements are not complete at this time. The
VFW and Wal -Mart have verbally committed to signing those agreements, but
signatures have not been obtained.
If the Wal -Mart development does not ultimately go forward, construction of this project,
and any assessments would be postponed.

Assuming approval of this resolution, the anticipated schedule for the project would be
as follows:
• City to approve Plans & Specs (Phase 1) for Public Improvements
February 6, 2013 and Call for Bids
• Bids due March 14, 2013
• City to consider and award construction contract for Public Improvements
March 20, 2013
• Public Improvements substantially complete by November 1, 2013
Action Requested
Adopt the resolution ordering the East Point Douglas Road Street and Utility
Improvements Project (Phase 1) and authorizing the preparation of plans and
specifications for the project.
RESOLUTION NO. 12
RESOLUTION ORDERING THE EAST POINT DOUGLAS ROAD STREET AND
UTILITY IMPROVEMENTS PROJECT (Phase 1) AND CALLING FOR THE
PREPARATION OF PLANS AND SPECIFICATIONS
WHEREAS, a resolution of the City Council adopted the 19 December, 2012 as the fixed
date for the Council to hold a public hearing on the proposed improvement benefiting properties
between East Point Douglas Road from East Point Douglas Lane South to 2200 feet southeast of
East Point Douglas Lane South and turnlane construction at East Point Douglas Road and CSAH
19; and
WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given
and the public hearing was held, where all parties wishing to be heard were given an opportunity to
be heard; and
WHEREAS, the City desires to assess the cost of said improvements to the benefiting
properties.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Cottage Grove,
County of Washington, and State of Minnesota:
1. Such improvement is necessary, cost effective and feasible as detailed in the feasibility
report. The improvement will include road rehabilitation and expansion, trails and
sidewalks, water, sanitary sewer, storm water facilities and streetlights.
2. Such improvement is hereby ordered.
3. Bolton and Menk is hereby designated as the engineer for this project. The engineer shall
prepare plans and specifications for the making of said improvements.
Adopted by the City Council of the City of Cottage Grove this 19 day of December, 2012.
