CALL TO ORDER - Regular Meeting The City Council of the City of Cottage Grove, Washington County, Minnesota, held a regular meeting on February 6, 2013 at the Cottage Grove City Hall, 7516 80t" Street South. ROLL CALL The following were present: Mayor Myron Bailey, Council Member Justin Olsen, Council Member Jen Peterson, and Council Member Dave Thiede. The following were absent: Council Member Derrick Lehrke (Arrived Late). Also present were: Ryan Schroeder, City Administrator; Caron Stransky, City Clerk; Robin Roland, Finance Director; Corrine Heine, City Attorney-Kennedy & Graven; Jennifer Levitt, City Engineer; Craig Woolery, Public Safety Director; and Les Burshten, Public Works Di rector. Mayor Bailey presided over the meeting. 1. ADOPTION OF AGENDA MOTION BY COUNCIL MEMBER OLSEN, SECONDED BY COUNCIL MEMBER THIEDE, TO APPROVE THE AGENDA AS PRESENTED. MOTION CARRIED. 4-0. Council Member Lehrke arrived at 7:35 p.m. 2. PRESENTATIONS A. GFOA Certificate of Achievement for Excellence in Financial Reporting 2011 Finance Director Roland presented a Certificate of Achievement for Excellence in Financial Reporting that the City of Cottage Grove received from the GFOA. She recognized her staff, especially Brenda Malinowski for an excellent job preparing the Comprehensive Annual Financial Report. 3. APPROVAL OF MINUTES A. December 5, 2012 Regular Meeting Minutes Mayor Bailey declared the minutes of the December 5, 2012 Regular Meeting to stand approved as presented. 4. CONSENT CALENDAR The City Council pulled and briefly discussed items B and I. Council Member Lehrke pulled item I from the consent calendar for a separate vote. ACCEPT AND PLACE ON FILE THE FOLLOWING MINUTES: PLANNING COMMISSION MEETING FROM NOVEMBER 26, 2012. B. ACCEPT THE INCENTIVE AWARD OF A KUSTOM SIGNAL PROLASER III, A VALUE OF $2,500, FROM THE OFFICE OF TRAFFIC SAFETY, DEPARATMENT OF PUBLIC SAFETY, TO THE CITY FOR PARTICIPATING IN THE OCTOBER MOVILIZATION CAMPAIGN TO BE USED BY THE PATROL DIVISION OF THE PUBLIC SAFETY DEPARTMENT. C. APPROVE THE PURCHASE OF 47,753 POUNDS OF ROADSAVER 535MN CRAFCO SEALANT FROM BROCK WHITE FOR 58 CENTS PER POUND PLUS SALES TAX OR TOTAL AMOUNT OF $27,696.74. D. ADOPT RESOLUTION N0. 2013-010, A RESOLUTION APPROVING THE P�ANS AND SPECIFICATIONS AND ESTABLISHING A BID DATE OF MARCH 7, 2013 FOR THE PRESERVE AT COTTAGE GROVE FINAL STREET IMPROVEMENTS. G. ADOPT RESOLUTION N0. 2013-011, A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS AND ESTABLISHING BID DATE OF MARCH 21, 2013 FOR THE 2013 SEAL COAT PROGRAM. H. AUTHORIZE ISSUANCE OF A SINGLE-OCCASION GAMBLING PERMIT TO THE COTTAGE GROVE AREA STRAWBERRY FEST, INC. FOR A RAFFLE TO BE HELD IN CONJUNCTION WITH THE STRAWBERRY FEST ON JUNE 17, 2013. I. REMOVED FROM THE CONSENT CALENDAR FOR SEPARATE VOTE. APPROVE THE PURCHASE OF A NEW SCHWARTZ MODEL SP-10 SPRAY INJECTION PATCHER FROM RCM EQUIPMENT COMPANY FOR $65,866.94. K. Cottage Grove City Council I� February 6, 2013 Regular Meeting MOTION BY COUNCIL MEMBER OLSEN, SECONDED BY COUNCIL MEMBER PETERSON, TO DENY THE REQUEST OF DONALD AND BONNIE BIALUCHA'S TO AMEND RESOLUTION N0. 2012-048 AND TO DIRECT STAFF TO NOTIFY THE BIALUCHA'S OF THE DECISION. MOTION CARRIED. 4-1 WITH COUNCIL MEMBER LEHRKE VOTING NAY. 5. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES - None. 6. PUBLIC HEARINGS - None. 7. BID AWARDS - None. 8. UNFINISHED AND NEW BUSINESS A. Receive and Place on File the Planning Commission and Public Safety, Health and Welfare Commission's Recommendations Not to Amend the City's Zonin� Ordinance or Animal Control Ordinance for Purposes of Allowing Poultrx and/or Fowl in the Back Yards of Urban Residential Lots Senior Planner McCool provided background information on the request to amend the City Code to allow poultry and/or fowl in the backyards of urban residential lots. He stated that staff recommends that the City Council accept the recommendation of the Planning Commission, Public Safety, Health and Welfare Commission, and the Public Safety Department not to amend the City ordinance. City Attorney Heine stated that she does not believe that anyone has made a request to amend the City Code. The City Council asked the Commission to review the zoning and animal control ordinanceS and to report back to the Council. The City Council can place the recommendation on file taking no action on the request. Mayor Bailey asked if anyone in the audience wished to speak on this matter. Rykna Olson, 8153 Jeffery Avenue South, Cottage Grove, Brian Wilson, 8153 Jeffery Avenue South, Cottage Grove, and Bob Burtman, 9476 Harkness Court South, Cottage Grove, voiced support for amending the ordinances to allow them to keep their ducks or chickens. Mr. Burtman read aloud a statement he prepared in favor of amending the City ordinances so he can keep his ducks. MOTION BY COUNCIL MEMBER LEHRKE, SECONDED BY COUNCIL MEMBER OLSEN, TO TABLE THIS MATTER FOR TWO WEEKS MINIMUM AND DURING THE TWO WEEK PERIOD, TO ALLOW THE TWO HOMEOWNERS TO MAINTAIN THE CHICKENS AND DUCKS THAT THEY MAINTAIN. Cottage Grove City Council I� February 6, 2013 Regular Meeting City Attorney Heine stated that when someone wants to amend the zoning ordinance that happens because a resident, the Council or staff initiates a request and it is sent through the formal process with a public hearing. Eventually the City Council would be asked to vote yes or no on an amendment. Mayor Bailey added that because there has been no change to the current ordinance, the two residents are in violation by maintaining poultry and foul at their residences. COUNCIL MEMBER LEHRKE AMENDED HIS MOTION TO CHANGE THE TWO WEEK PERIOD TO UNTIL THE CITY COUNCIL HAS MADE A DECISION. City Attorney Heine stated that the Council should table the matter to some date certain or a specific date. City Administrator asked the City Council to table the matter to the second meeting in March 2013. MOTION BY COUNCIL MEMBER LEHRKE, SECONDED BY COUNCIL MEMBER OLSEN, TO AMEND THE MOTION TO TABLE THIS MATTER TO THE SECOND MEETING IN MARCH. Council Member Olsen stated that it is important to note that if we as the City do not receive a request from the residents to amend the zoning ordinance at the second meeting in March, the matter closes. UPON VOTE BEING TAKEN ON MOTION AS AMENDED, MOTION CARRIED. 5-0. 9. RESPONSE TO PREVIOUSLY RAISED COUNCIL COMMENTS AND REQUESTS - None. 10. COUNCIL COMMENTS AND REQUESTS Council Member Olsen stated that the Crime Board is raising money to fund the purchase of a speed trailer for the Public Safety Department and asked for an update from Public Safety Director Woolery. Public Safety Director Woolery stated that we previously had a display board or speed trailer affixed to an old damaged vehicle. He stated that the Crime Board would like to purchase a new trailer for the Department which would cost approximately $18,000 and so far they have raised $6,000. Council Member Olsen reminded the public about the 2013 Inclusive Playground Task Force and encouraged the public to volunteer to help develop a park for children with disabilities. Cottage Grove City Council I� February 6, 2013 Regular Meeting Council Member Olsen reminded the public about the Jaime Anderson benefit that would be held at the River Oaks Golf Course on Saturday, February 9, 2013. Council Member Olsen asked Captain Peter Koerner to work with Public Works Director Les Burshten on combining the Public Safety, Health and Welfare Commission with the Public Works Commission. Council Member Peterson asked Cottage Grove residents to go to the City's website and complete the Shop Cottage Grove on-line survey; she noted that the next Fair for All was February 14; the Highlands Park Skate Night is February 8; and a community discussion on domestic violence would be on March 18. Mayor Bailey stated that he attended the Fish Fry at the River Oaks Golf Course on Friday, February 1 and it was excellent. MOTION BY COUNCIL MEMBER OLSEN, SECONDED BY COUNCIL MEMBER PETERSON, TO DIRECT THE PUBLIC SAFETY AND FINANCE DEPARTMENTS TO WORK TOGETHER ON FINDING FUNDING FOR APPROXIMATELY $12,000 TO PURCHASE A SPEED TRAILER. MOTION CARRIED. 5-0. MOTION BY COUNCIL MEMBER OLSEN, SECONDED BY COUNCIL MEMBER PETERSON, TO DIRECT STAFF TO CONSIDER CONSOLIDATING THE PUBLIC SAFETY, HEALTH, AND WELFARE COMMISSION AND THE PUBLIC WORKS COMMISSION AND TO OBTAIN POSSIBLE PROS AND CONS FOR DOING S0. MOTION CARRIED. 5-0. 11. PAY BILLS MOTION BY COUNCIL MEMBER OLSEN, SECONDED BY COUNCIL MEMBER THIEDE, TO APPROVE PAYMENT OF CHECK NUMBERS 179986 THROUGH 180229 TOTALING $674,306.39 AND EFT PAYMENT OF $76,610.40. (CHECK NUMBERS 179986 - 180027 IN THE AMOUNT OF $195,251.76 AND EFT PAYMENT OF $15,020.40 WERE ISSUED PRIOR TO COUNCIL APPROVAL). MOTION CARRIED. 5-0. 12. WORKSHOP SESSION - OPEN TO PUBLIC A. City Administrator Job Description The City Council reviewed various job descriptions for the position of City Administrator from surrounding communities. 13.
