Discussion CMC Enterprises is an automotive performance business that retails automotive parts, builds engines, and custom fabricates automotive parts. Occasionally this business may have an auto- mobile that they want to sell from their business at 9800 Hemingway Avenue. Because they may sell more than five vehicles in a 12 -month period, the applicant wants to obtain an auto- motive dealer license from the Minnesota Department of Public Safety — Driver and Vehicle Services. An automotive dealer license in Minnesota is required if someone wants to lease or sell more than five vehicles, wholesale or retail, within a 12 -month period. The applicant's property is zoned 1 -2, Limited Industry District. Their automotive repair business operates entirely inside a 20,500 square foot building. The City's Zoning Ordinance does not allow an automotive dealership in any of the five industrial zoning districts. Because the appli- cant's principal use on their property is automotive repair inside the principal structure, they are requesting that the City's Zoning Ordinance be amended to allow automotive sales as an acces- sory use with an automotive repair business in the 1 -2 District. For purposes of allowing occasional sales of automobiles in the 1 -2 District, certain performance standards were considered. These standards were developed to limit automotive sales within the 1 -2 zoning district. These standards include: 1) The principal structure must be a minimum of 20,500 square feet. 2) The property must be a minimum of three acres, but not greater than five acres. 3) Storing or displaying any vehicle that is for sale must be entirely inside the principal structure and not occupy more than 10 percent of the principal structure's gross floor area. 4) Loading and unloading vehicles from a transport vehicle may only take place on the site and is prohibited on public streets. 5) Outdoor signage displaying automotive sales, leasing or rental is prohibited. AMENDMENT "The Code of the City of Cottage Grove, County of 12 Washington, State of Minnesota," shall be amended by amending Title 11 -4 -9, Motor 13 Vehicle Sales and Leasing by adding the following: 14 15 11 -4 -9: MOTOR VEHICLE SALES AND LEASING: 16 17 Motor vehicle sales and leasing establishments except for limited automotive sales in 18 the 1 -2 Limited Industry District must conform to the following standards: 19 20 A. Lot Area and Dimensions: 21 1. Minimum lot size of eight (8) acres. 22 2. Maximum lot size of fifteen (15) acres. 23 3. Minimum lot width of three hundred feet (300'). 24 4. Minimum lot depth of one hundred fifty feet (150'). 25 26 B. Building Size and Setbacks: 27 1. Only one primary building is allowed with a minimum size of forty thousand 28 (40,000) square feet. n 2. Minimum front setback of seventy five feet (75'). 30 3. Minimum side yard setback of fifty feet (50'). 31 32 C. Landscaping and Screening: 33 1. All vehicle parking and inventory areas which are adjacent to public streets or side 34 and rear property lines must be screened by fencing constructed on top of a 35 continuous brick wall, with a fence design approved by the city. 36 2. A minimum of thirty five percent (35 %) of the site must be landscaped. 37 3. A minimum thirty foot (30') wide landscaped area must be established along the 38 perimeter of the site. This area must include landscaped berms no less than 39 three feet (3) in height. 40 4. A minimum of ten percent (10 %) of the parking and display area must be 41 landscaped and irrigated. 42 5. All other landscaping requirements must be met. 43 44 D. Other Requirements: 45 1. Motor vehicle display areas must be on one lot not separated by a public street 46 or other land use. 47 2. No vehicle parking is allowed in landscaped areas. 48 3. Customer and employee parking areas must be clearly indicated on the plan. The maximum floor area inside the principal building designated for motor vehicle display must not be greater than ten percent of the principal building's gross floor area. c. AMENDMENT "The Code of the City of Cottage Grove, County of Washington, State of Minnesota," shall be amended by amending Title 11 -11 -2; Permitted and Conditional Uses by adding the following accessory use: 11 -11 -2: PERMITTED AND CONDITIONAL USES: A. Except as provided in this title or otherwise as provided by law, a principal building, structure or land use shall be permitted only in the zones indicated in the following table. A principal use listed in the table in any zone denoted by the letter "P" is permitted and denoted by the letter "C" is a conditional use. The uses in table 1 of this section are permitted in the zones designated. However, the director of community development shall have the right to allow any other use which is similar to and compatible with those uses permitted in the district.
