Minutes of Meeting
March 19, 2013
Pursuant to due notice, a meeting of the Public Safety, Health and Welfare Commission
was held at the City Hall.
01.A. Call to Order: The March 19, 2013, meeting of the Cottage Grove Public Safety,
Health and Welfare Commission was called to order at 7:05 pm.

01 B. Approval of Minutes
Commission member AJ Janssen presented the February 19, 2013 minutes of the
Public Safety, Health and Welfare Commission for review. On a motion by Commission
member Lori Hedican, seconded by Nick Maciejewski, the February 19, 2013 minutes
were accepted and approved by the Commission. Motion carried.
01 C. Approval of Aqenda
Commission member AJ Janssen presented the March 19, 2013 agenda of the Public
Safety, Health and Welfare Commission for review. On a motion by Commission
member Dave Barkow, seconded by Lori Hedican, the March 19, 2013 agenda was
accepted and approved by the Commission. Motion carried.
2. OPEN FORUM
Commission member AJ Janssen invited citizens present to address the Commission
regarding any matters that were not on the approved agenda.
There being no items, Commission member AJ Janssen closed the Open Forum
segment of the meeting.
3. Communitv Development
03.A Cross walks on Hinton near 72 Street — City Engineer Jennifer Levitt
City Engineer Jennifer Levitt made a presentation to the Commission regarding
crosswalks on Hinton Avenue near 72 Street and provided some options that have
been studied and would like a recommendation from the Commission to present to City
Council on the preferred option.

After general discussion, on a motion by Commission member AJ Janssen, seconded
by Nick Maciejewski, it was recommended the installation of the Rectangular Rapid
Flashing Beacon (RFB) at the crosswalk. Motion carries.

05.A Discussion on the purpose and duties of the Public Safety, Health and Welfare
Commission
Captain Koerner recapped a previous meeting regarding discussion on combining the
Public Safety, Health and Welfare Commission and the Public Works Commission. Our
response was sent to the City Council and the Public Works Commission didn't feel the
need to combine the two, it was decided to move forward and discuss what our current
ordinance states as the Commission's purpose and duties are. He did advise that the
ordinance is a little dated and welcomed any discussion from the Commission as to
what they would suggest is the purpose and duties. The next step would then be to
amend our ordinance. Captain Koerner did provide the Commission with a copy of the
current ordinance with what the purpose and duties are of the Commission attached.
Comments by members included Commission involvement in public awareness and
education on certain topics, ie. recycling, proper disposal, fire safety, ice safety as well
as including schools and disaster drills as an area of involvement. Also added was
possible involvement in the environment - air and/or water quality. Another comment
was to have joint meetings with other commissions if there is an overlapping matter that
each commission will need to review. Would like to see more public awareness of the
Public Safety Commission.
Captain Koerner thanked the Commission for all their input and remarks.

08.A Police — Deputy Director Koerner informed the Commission of the following:

Shelter.
Police Hiring — Last week written test. Next step is interviews. Authorized staff of 40.
The Police Department's current new hires are in 2� phase of Field Training.
Reserves — Interviews tonight- Last year the Reserves volunteered 3,230 hours.
Citizen Academy — Sergeant Martin is in charge of the Academy. Planning for a 3rd
Academy. Times will be posted in the next few weeks
Public Safety/City Hall Tours — Will be posted in the next few weeks
Human Rights/Human Services Commission — Culver's Night — Monday, March 25

08.B Fire — Fire department tours are going to be conducted for the public. Check the

08.0 Council Recap - Council Liaison Lehrke did update the Commission briefly in
regards to the following: Upcoming Pavement Management projects: north of 80 and
east of Jamaica Avenue; Hinton Avenue to 70 St.; WC and city combined effort on
Hwy 19, 70 and Military for a roundabout.

01 B. Approval of Agenda
PW Commission member Mike Edman presented the April 30, 2013 agenda for review.
It was the consensus of the Public Works Commission that the content of item 02.B —
Poultry/Fowl Review and Discussion, was not considered a matter that should be
discussed by their Commission. It was recommended that this item be removed from
the agenda to be discussed at a Public Safety, Health and Welfare Commission
meeting only. On a motion by PW Commission member Tony Jurgens, seconded by
PW Commission member Matt Forshee, the April 30, 2013 agenda was amended to
reflect the removal of Item 02.B and approved as amended. Motion carried.
2. Community Development
02.A 70 Street and Idsen Avenue Pedestrian Crossing Discussion — City Engineer
Jennifer Levitt
City Engineer Jennifer Levitt made a presentation and overview regarding pedestrian
crossing at 70 Street and Idsen Avenue. The purpose of presenting it to the two
commissions was the need to evaluate and discuss the options and costs relative to the
project. At the end of the presentation, there were options that Ms. Levitt introduced to
the Commission members.
Receive the report and monitor pedestrian traffic before implementing any short-
term options.

2. Receive the report and make preparations to install the sidewalk and have the
County do the signing and striping as outlined in short-term Option 1.
3. Receive the report, monitor pedestrian traffic, and seek additional third party
funds for a mid-and/or long- range project.
City Engineer Jennifer Levitt did cover short and long term solutions and costs during
her presentation. Also in attendance was Traffic Surveyor/Engineer Kevin Kielb, who is
with the consulting firm Bolton & Menk, Inc. His firm did a Gap Analysis for this area, in
which they counted vehicles, not pedestrians, to see how many gaps would be available
for pedestrians to cross during the P.M. peak and he informed the Commission the
study resulted in a level F, which means that pedestrians are more likely to take risks
because there aren't that many gaps available, roughly seven during the peak hour, for
pedestrians to cross. The roadway has 6,000 vehicles per day. They also did an
abbreviated speed study and found that the 85 percentile of the speed was right at 50
mph. Commission members would like to have some type of manner to count
pedestrians crossing the roadway to use the park as well. Commission members did
wish to get more information on pedestrian counts due to the Splash Pad being installed
at Highlands Park later in the summer months of last year and with this season being a
full season, a current count would help. All concurred that there needs to be some
manner for pedestrians to cross.
Both Commissions would like to reconvene in October 2013 to review more current
pedestrian and/or traffic counts to make a more informed decision/recommendation as
to pedestrian crossing solutions.
Motion made by PW Commission member Tony Jurgens, seconded by PW Commission
member Mike Smith to reconvene possibly in October 2013. Motion carried.

3. CommunitV Development
03.A Poultry/Fowl Review and Recommendation — Captain Pete Koerner, Senior
Planner John McCool and Mary Britton Clouse from the Chicken Run Rescue
organization

Captain Koerner made a short presentation to the Commission on Poultry and Fowl in
Urban Residential Neighborhoods. As a result of the April 20, 2013 All City Commission
meeting with City Council, the City Council has requested that the Public Safety, Health
and Welfare Commission review this matter. The Public Safety, Health and Welfare
Commission has been asked to address or comment on the following:
• Enforcement
• Disease/Health Implications
• Predator animals
• Varmints/Rodent issues
When the Commission met in January 2013, the Commission recommended not making
any amendments to the Zoning Ordinance and Animal Control Ordinance to allow
poultry and fowl in the backyard. Captain Koerner then highlighted some of the
comments from that meeting made by the Commission, such as who was going to
enforce some of these issues, who does the inspections vs the enforcement, also some
concerns about the coop standards where the health implications were brought up, what
would be the lot sizes and then neighborhood permissions. Captain Koerner then invited
Community Development Department Senior Planner John McCool to make his
presentation.
John McCool provided the Commission with research information that was collected
over the past several months regarding chickens in backyards. There were 52 cities
contacted. 35 cities did not allow chickens in the backyard urban lot. 17 cities allowed
chickens with coop, pen, minimum lot, licensing etc. requirements. Also received
resource material from Chicken Run Rescue both for the pros and cons about raising
chickens. Last December the city did a"Survey Monkey" with 237 responses. The
majority of responses were there were concerns with having chickens in urban lots. He
then introduced Mary Britton Clouse from the Chicken Run Rescue organization.
Mary Britton Clouse provided the Commission her observations and her experience
operating Chicken Run Rescue. Most of the chickens that she has in her care are
either abandoned/strays, owner surrendered or picked up by the Minneapolis Animal
Control office. She stated she has been working with Minneapolis Animal Control since
2001 and the Animal Humane Society since 2007 and on how this "fad" has exploded.
Last year, the city of Minneapolis issued 200 permits. She contacted them last week
and they advised her that they are receiving 25 permit applications per week, which
means 1,200 applications per year. There was some discussion regarding the care of
and lack thereof, by people having chickens as well as veterinarians that are
experienced avian care, only about 20, 3 which are avian experts.

The floor was opened for public comment. Mr. Robert Burtman, 9476 Harknes� Ct.
approached the Commission. He advised that he does not have chickens, however, he
does have four ducks. He talked about possibly allowing 4— 6 ducks/chickens per
household, coop size, lot size, and acreage. He mentioned the discussion about
neighbors being a big factor and having 100% approval, he said that if someone moves
in next to him or adjacent to his property, he does not have a say on whether they can
have a cat or dog. He also mentioned the health issue of dogs and cats leaving feces in
yards. He would like to have the Commission consider his comments and having his
ducks allowed in the city.
John McCool advised the Commission that in contacting other communities, they are
attempting to get quantitative data or information; how much time is used for code
enforcement, how many calls do you respond to because of a crowing rooster. Cottage
Grove does not provide that kind of detail of what those complaints have been or much
staff time it takes to monitor those things. No city has that kind of detail in their records.
They reply that they responded, but how long did it take to resolve the issue/problem,
they don't keep those records.
There were many other concerns, ie. Noise, reports of rodents, diseases — transmitted
from bird to humans and bird to bird were also discussed.
Ricky Morrison approached the Commission on behalf of his daughter who lives next
door to Mr. Burtman (duck owner) and expressed concerns regarding the noise issue
made by the ducks. This happens whenever there is movement in the yard next to the
ducks, ie. on the deck, in the yard, and have to talk above the ducks noise. He stated
that now that spring as arrived, the windows are open and his grandson has developed
a respiratory ailment (allergies) which he never had before. He added that the kitchen
window is 40 feet from the kennel where the ducks are kept and it's not cleaned. He
worries that because duck droppings seep into the ground and when dry, become
airborne and enter through the open windows.
After a lengthy discussion, on a motion by Commission member Jodi Lewis, seconded
by Commission member Lori Hedican, recommending to Council not to amend the
ordinance language. Six ayes, one nay by Commission Chair Janssen. Motion carries.
Councilman Lehrke asked the Commission to discuss the topic brought up by
Councilman Theide that is in their packets, regarding amending the ordinance definition
language referencing dogs and cats to "pets". The Commission did believe that by
doing so, then this would mean allowing other animals, ie. chickens, ducks, pygmy
horses, goats, etc., to live inside the house as do dogs and cats. On a motion by
Commission member Jodi Lewis, seconded by Commission Chair Janssen,
recommending not amending the language of pets in the ordinance. Motion carries.

7. COMMISSION COMMENTS AND REQUESTS
Commission member Jodi Lewis advised the Commission that the Cottage Grove Lions
have partnered with Cottage Grove Middle School and Oltman Middle School and are
doing a campaign on anti-bullying at the middle schools and on Saturday, May 18,
2013, there will be a 5K run/walk called "Standing Strong" and all proceeds go to the
Standing Strong Foundation which will send each 8 th grader in the city to a Courage
Retreat through Youth Frontiers next year. The mission of the Courage Retreat is anti-
bullying. Invites anybody to come, registration is same day starting at 7:30 and the race
starts at 9:00.
Commission Chair AJ Janssen informed the Commission that there is a young child that
lives in his neighborhood who is deaf and was requesting that a"Deaf Child" sign be
placed in his neighborhood as he has concerns for the safety of this deaf child. He
added that he was informed by the city that this type of signage is not part of the
signage policy and are not placed in neighborhoods. He would like the city to review
this and change it to allow the placement of the sign to help protect this child, before
something happens.
8. STAFF REPORTS
08.A Police — Deputy Director Koerner informed the Commission of the following:
Officer Pat Nickle returned on May 14, 2013 after of yearlong deployment.
The Police Department has received the much anticipated Speed Trailer that was
funded by donations from the Crime Board. He added that officers are currently being
trained on how it functions. He hopes to put it near the splash pad in the near future as
weather gets warmer. Looking at creating a request process so if citizens want it in their
neighborhood, this will help.
Construction season is here. Be aware of the construction zones. The city is placing
construction updates on the city web page.

Police Hiring — Did interviews a couple of weeks ago and doing the background one
candidate. Within the next few weeks all vacant positions should be filled.
Reserves — Two new CSO started, Andrew Lemay and William Henk, both have
experience here as Reserves and studying to become police officers, and are currently
in training.
08.B Fire — Fire Chief Redenius informed the Commission of the following:
He informed that calls are at 866 total calls for EMS and Fire response. We are ahead
of last year's pace by about 20-some calls. Some weekends have been busy, about 40
calls, which include from 4:00 pm. Friday afternoon until Monday morning at 4:00 a.m.
Our crews are staying busy.
We will be hiring in June. This week we will be interviewing 6 people for one position
and then the interview committee will recommend the top 3-4 candidates to interview
with the Fire Chief, Director of Public Safety and Human Resources representative and
get a strong candidate from that interview. He will also be budgeting for two more full
time personnel for 2014.
Getting more requests for appearances at different events and trying to schedule with
personnel and if available, will at least stop by and shake some hands and let the kids
go o� some trucks and/or ambulances.
On the Council agenda tomorrow is a request to sell a fire engine on ebay which is the
one we replaced with in October 2012. He will keep the Commission informed if it sells.
Coming the first part of June as part of our Shared Services agreement with Woodbury,
there will be a training exercise and we will be sending over our training trailer and 4
trainers. Last fall Woodbury watched Cottage Grove train in an entanglement box and
would like to train as they have never done it.
We recently had Fire Fighter 1& 2 and HazMat training with new recruits, which
included Director Woolery. Some can start on the street and others need EMT training.
08.0 Council Recap - Council Liaison Lehrke advised the Commission that if they had
any questions prior to the meeting regarding the meeting agenda items that they are

welcome to contact him at any time. He offered to talk before or after the meetings as
well.
