Subject: AMENDMENT OF ON STREET PARKING RESTRICTIONS ORDINANCE
Earlier this year the City Council made a request to have staff and the Public Works
Commission look at the City's on street parking regulations specifically with the winter parking
ban. At the May 13 Public Works Commission meeting, Public Works Director Les Burshten
distributed additional information regarding general parking restrictions and winter parking
ordinances from other cities. He then described the ordinance and how public works responds.
The Public Works Commission minutes are included for further information on the discussion.
The Public Works Commission did make suggestions and recommended changes to the
ordinance.
The following changes were suggested:
� Change the prohibited months for on street parking (from 2:00 am to 6:00 am) for snow
and ice removal from "between October 1 and April 30" to "between November 1 and
March 31 ".
Remove the language "within fifteen (15) minutes of demand made by a city employee
for such removal. After such notice, it shall be unlawful to park on such streets until the
snow removal operation is completed in the area involved" and replace with the
language "if a motor vehicle is found in violation of this ordinance a police officer is
authorized to issue a citation and/or have the motor vehicle removed at the owner's
expense."
Snow and Ice Removal - Before November 1 and after March 31, on street parking shall
be permitted only when the same does not interfere with the removal of snow and ice
from the City streets, and vehicles so parked shall be removed from the street by their
owners. It shall be unlawful to park on such streets until the snow removal operation is
completed in the area involved. If a motor vehicle is found in violation of this ordinance a
police officer is authorized to ticket and/or have the motor vehicle removed at the
owner's expense.
At the July 15 the suggested changes were presented to the Public Works Commission for their
review and recommendation to amend the ordinance. The Commission did approve the revised
language but asked for the Public Safety Health and Welfare Commission to review and provide
comment prior to sending the recommendation to City Council.
Unfortunately tfie August PSHW Commission meeting was cancelled due to a lack of inembers
present for a quorum. At the September 17 meeting, the commission was given an opportunity
to review and provide comments. The PSHW Commission did not have additional comments.
The PSHW Commission recommended that the suggested changes be sent to City Council for
approval. The recommendation was unanimously approved by the commission.
RECOMMENDATION
Recommend that the City Council adopt the ordinance amending Title 6, Chapter 2, Section 1,
General Parking Restrictions — On Street Parking Regulations of the City Code and also adopt a
resolution authorizing the publication by title and summary.

RESOLUTION NO.
RESOLUTION AUTHORIZING SUMMARY PUBLICATION OF
ORDINANCE NO. - 6-2-1
WHEREAS, the City of Cottage Grove has adopted the above referenced amendment to
the Cottage Grove City Code at the October 2, 2013 City Council meeting; and
WHEREAS, the verbatim text of the ordinance is cumbersome, and the expense of the
publication of the complete text of the ordinance is not justified; and
WHEREAS, the Council has determined that the following summary will clearly inform the
public of the intent and effect of Ordinance No. 6-2-1.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Cottage Grove,
Minnesota, that the city clerk shall cause the following summary of Ordinance No. 6-2-1 to be
published in the official newspaper in lieu of the entire ordinance:

AN ORDINANCE FOR THE CITY OF COTTAGE GROVE, MINNESOTA, AMENDING TITLE 6,
CHAPTER 2, SECTION 1 OF THE COTTAGE GROVE CITY CODE RELATING TO GENERAL
PARKING RESTRICTIONS
The City Council has adopted Ordinance No. 6-2-1, an ordinance entitled "AN ORDINANCE FOR
THE CITY OF COTTAGE GROVE, MINNESOTA, AMENDING TITLE 6, CHAPTER 2, SECTION
1 OF THE COTTAGE GROVE CITY CODE RELATING TO GENERAL PARKING
RESTRICTIONS." This summary of the ordinance is published pursuant to Minn. Stat. § 412.191,
subd. 3.
The ordinance amends the prohibited parking months for snow and ice
removal between October 1 and April 30 to November 1 and March 31. The
ordinance no longer requires fifteen (15) minutes of demand to remove a vehicle.
The ordinance will now allow if a motor vehicle is found in violation of this
ordinance a police officer is authorized to issue a citation and/or have the motor
vehicle removed at the owner's expense. Language also includes snow and ice
removal before November 1 and after March 31 shall not interFere with snow
removal. Copies of the full text of the ordinance are available for public inspection
in the City Clerk's office during normal business hours or upon request by calling
651-458-2800.

BE IT FURTHER RESOLVED, that the city clerk is directed to keep a copy of the
ordinance in her office at city hall for public inspection and to post a full copy of the ordinance in a
public place in the City for a period of two weeks.

AN ORDINANCE RELATING TO
GENERAL PARKING
RESTRICTIONS; AMENDING
SECTION 6-2-1 OF THE COTTAGE
GROVE CITY CODE
THE CITY OF COTTAGE GROVE DOES ORDAIN:
Section 1. Section 6-2-1, subsection A, paragraph 1 of the Cottage Grove City
Code is amended to read as follows:
Snow And Ice Removal: Between November 1 and March 31

the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M. on any day. At all

� 3. Number Of Days Limited: No vehicle shall be parked continuously on a public street for a
period of seventy two (72) hours or more. This prohibition is in addition to subsection A1 ofthis
section.
�. 4. Exemptions: All emergency and official vehicles responding to an emergency call,
including doctors' automobiles, shall be excluded from the provisions of this subsection A. (1971
Code § 14-7)
B. No Parking Zones: No vehicle shall be left standing or parked on the streets of the city:
1. Where any section of street has been designated as a no parking zone by resolution of the city
council or by order of the fire chief or designee.
2. Within fifteen feet (15') of any mailbox between the hours of ten o'clock (10:00) A.M. and four
o'clock (4:00) P.M. on Monday through Saturday. (1971 Code § 14-7.1; amd. 2000 Code)
C. Liability Of Owner: Whenever any motor vehicle shall be parked or left standing within the
city by any peison other than the owner, with the consent of the owner, express or implied, the
operator thereof shall be deemed to be the agent of the owner of such motor vehicle for the
purposes of subsections A and B of this section. (1971 Code § 14-7)
