Discussion The City Council adopted a policy in September 2008 that provides for the deferral of special assessments for senior citizens, disabled, and military persons pursuant to Minnesota Statute 435.193 to 435.195. The established policy identifies income guidelines for determination of hardship in order to defer payment of special assessments ($22,340 for a one person household, $30,260 for a two person household etc.). The option to defer the payment of special assessments shall terminate and all amounts accumulated plus applicable interest, shall become due upon the occurrence of any of the following events: (a) the death of the owner, provided that the spouse is otherwise not eligible for the benefits hereunder; (b) the sale, transfer, or subdivision of the property of any part thereof; (c) if the property should for any reason lose its homestead status; or (d) if for any reason the taxing authority deferring the payments shall determine that there would be no hardship to require immediate or partial payment. All four property owners meet the qualification guidelines. Action Requested Adopt the resolution authorizing the deferral of special assessments on properties: 10-027-21-24-0048 10-027-21-23-0046 08-027-21-42-0134 08-027-21-42-0109 RESOLUTION NO. 13- RESOLUTION AUTHORIZING THE DEFERRAL OF SPECIAL ASSESSMENTS WHEREAS, on September 3, 2008, the City Council of the City of Cottage Grove, Minnesota adopted Ordinance 844, Establishing a Program to Defer Payment of Special Assessments, which provides guidelines for determining the eligibility to defer payment of special assessments; and WHEREAS, the owners of the properties located at: 9493 Indian Blvd. South 7420 Jeffery Lane South 7486 Hinton Park South 7442 Hinton Park South 10-027-21-24-0048 $3700.75 10-027-21-23-0046 $3700.75 08-027-21-42-0134 $527.89 08-027-21-42-0109 $527.89 have submitted the required application for the deferred payment of a special assessment and qualify for the deferral under Ordinance 844. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Cottage Grove, County of Washington, State of Minnesota, that the assessments for the above properties for street improvements in the 2013 Pavement Management District and the Hinton Avenue Reclamation Project adopted October 2, 2013 be deferred in accordance with Ordinance 844.
