COUNCIL ACTION REQUEST
City Council pass a motion to approve the Ambulance Service Mutual Aid Agreement and
authorize execution of the agreement between the City of Cottage Grove and the Lower St.
Croix Valley Fire Department, which would begin on January 1, 2014.

APPROVAL OF MUTUAL AID AGREEMENT WITH LOWER ST. CROIX VALLEY
Cottage Grove EMS is required under the Emergency Medical Services Regulator Board to provide
mutual aid agreements in the event that Cottage Grove EMS cannot provide an ambulance within our
primary service area (PSA).
BACKGROUND
Currently Lower St, Croix Valley Fire (LSCVF) operates a BLS-IV Tech ambulance service to our
north/south east primary service area (PSA). Cottage Grove EMS can request a BLS ambulance and use
a Police/Firefighter Paramedic as needed to provide ALS/BLS coverage within our PSA or provide an
ALS/BLS ambulance to LSCVF when requested. Currently LSCVF utilizes Lake View Hospital EMS as their
primary mutual aid and would utilize Cottage Grove EMS in the event that Lake View Hospital EMS is
unavailable.
RECOMMENDATION
I am recommending that we approve and sign the mutual aid agreement. The agreement has
been reviewed by the City Attorney I<orine Land and meets as standards as shown in Minnesota
Statutes, Section 477.59 authorizing two government agencies to jointly exercise any power
common to contracting parties.

AMBULANCE SERVICE
MUTUAL AID AGREEMENT
THIS AMBULANCE SERVICE MUTUAL AID AGREEMENT ("Agreement") is made
effective as of the day of 2013, ("Effective Date") by
and between the City of Cottage Grove, a Minnesota municipal corporation ("Cottage Grove")
and the Lower St. Croix Valley Fire Department, a Minnesota
("Lower St. Croix Valley").
WHEREAS, Cottage Grove and Lower St. Croix Valley desire to be prepared to
adequately address ambulance service requests that may occur within the other's jurisdiction;
and
WHEREAS, State of Minnesota regulations require ambulance services to have
agreements with neighboring ambulance services to provide life support transportation when the
licensee's ambulances are not available; and
WHEREAS, in order to protect the public peace and safety, preserve the lives and
property of people in each jurisdiction, Cottage Grove and Lower St. Croix Valley agree to
furnish assistance to one another in the event of said need; and

units to jointly exercise any power common to contracting pai
NOW, THEREFORE, Cottage Grove and Lower St. Croix Valley hereby agree to furnish Mutual
Aid Assistance to each other upon the teims and conditions set forth in this Agreement.
I. Purpose
The purpose of this Agreement is to identify and record the willingness between Cottage Grove,
doing business as Cottage Grove Emergency Medical Services and Lower St. Croix Valley, to
mutually assist each other during periods of ambulance service requests exceeding available
resources, and to specify the terms of that assistance.
II. Definitions
Mutual Aid Assistance means any ambulance services , useful to the Requesting Party,
including personnel, equipment, supplies and resources.
Party means a Responding Pai or a Requesting Party.
Personnel means personnel vvho possess the necessary qualifications to respond to a request
for Mutual Aid Assistance under this Agreement.
Requesting PartX means the entity that requests Mutual Aid Assistance to the Requesting
Party. .
Requesting Official means the person designated by the Requesting Party who is responsible
for requesting Mutual Aid Assistance from the Responding Party.
Responding Pai�ty means the entity that provides Mutual Aid Assistance to the Requesting
Party.

III. Requests for Assistance

Whenever a Requesting Par in the opinion of the Requesting Official, determines that
conditions within its jurisdiction cannot be adequately addressed by that Party's Personnel
and resources, the Requesting Official may request the Responding Official to furnish
Mutual Aid Assistance. The pal agree to use their usual and customary means of radio
and telephone communications to request and coordinate Mutual Aid Assistance. Unless
excepted pursuant to Section V. A., each party will provide the highest level of service
available when requested.
IV. Fees for Services
A. The Requesting Party and Responding Party shall be responsible for the costs and
compensation of its own Personnel, equipment and supplies.
B. The Responding Party is responsible for obtaining reimbursement from the patient, the
patient's insurer, and/or appropriate third party payor(s). The Responding Party shall not
have any claim against the Requesting Pai for any amounts not collected from the
patient, the patient's insurer, and/or appropriate third party payor(s) for Mutual Aid
Assistance.
C. In the event of an ALS intercept, the transporting party will bill the patient.
V. Limitations
A Responding Par obligation to provide Mutual Aid Assistance is subject to the
following conditions and limitations:
A. A Responding Party may withhold or recall personnel, equipment, supplies and resources
to the extent necessary to provide reasonable protection and services for its own
jurisdiction.
B. The Requesting Party and Responding Pai�ty shall be responsible for injuries or death to
any of its own Personnel or damage to or destruction of its own equipment and supplies.

VI. Liability and Indemnification
A. Each shall provide appropriate liability, automobile, worlcer's compensation, and
professional malpractice insurance coverage, in amounts that a minimum are equal to
those required by Minnesota Statutes Chapter 466 or other applicable laws.
B. The Responding Party agrees to release, defend, and indemnify the Requesting Pai�ty
against any liability, expense, or claim arising fiom the Responding Party's negligent
actions and omissions related to the mutual aid response. The Requesting Pal agrees to
release, defend, and indemnify the Responding Par.�ty against any liability, expense, or
claim arising from the Requesting Party's negligent actions and omissions related to the
mutual aid response.
C. The Requesting Pai-ty agrees to defend and indemnify the Responding Party against any
claims brought or actions filed against the Responding Party or any officer, employee, or
volunteer of the Responding Party for injury to, death of, or damage to the property of
any third person or persons, arising from the perfoi�rnance and provision of assistance in
responding to a request for assistance by the Requesting Pa1 pursuant to this
Agreement. Under no circumstances, however, shall a pai�ty be required to pay on behalf
of itself and other parties, any amounts in excess of the limits on liability established in
Minnesota Statutes Chapter 466 applicable to any one party. The limits of liability for
some or all of the parties may not be added together to detei�nine the maximum amount
of liability for any party.
D. The Responding Party shall not be responsible for any injuries, damages or losses arising
from the acts or omissions of Personnel of the Requesting Pai�ty and its officers,
employees, agents and assigns.
E. No pai�ty shall be liable to the other or to any person for failure to furnish Mutual Aid
Assistance or for recalling Mutual Aid Assistance.
VII. Term of Agreement
This Agreement shall be in full force and effect fiom the Effective Date of this Agreement
and shall continue unless terminated by one of the parties as provided in Section XII.,
Termination or Cancellation of Agreement.
VIII. Notices
All communication and details concerning this Mutual Aid Agreement shall be directed
to the following representatives or their successors or assigns: �

IX. Controlling Law
This Agreement has been made under the laws of the State of Minnesota, and such laws will
govern its interpretation. The appropriate venue and jurisdiction for any litigation arising
hereunder will be located in Washington County, State of Minnesota.
X. Data Practices
Both the Requesting Party and the Responding Party agree to comply with the Minnesota
Government Data Practices Act and all other applicable state and federal laws relating to data
privacy or confidentiality. Each Party agrees to hold the other Paz�ty, its officers and
employees harmless fiom any claims resulting from unlawful disclosure or use of data
protected under state and federal laws.
XI. Non-Discrimination
Both the Requesting Party and the Responding Party agree to comply with the provisions of
all applicable federal and state statutes and regulations pertaining to civil rights and
nondiscrimination including, without limitation, Minnesota Statutes, Section 181.59 and
Chapter 363A, incoiporated herein by reference.
XII. Termination and Cancellation of Agreement
Each Par�ty may cancel this Agreement for any reason without cause upon thirty (30) days
written notice. The Requesting Party and the Responding Party may terminate this
Agreement if either party fails to fulfill its obligations under the Agreement in a proper and
timely manner, or otherwise violates the terms of this Agreement.
XIII. Severability
Should a court of competent jurisdiction rule any portion, section or subsection of this
Agreement invalid or nullified, that fact shall not affect or invalidate any other poi
section or subsection; and all remaining portions, sections or subsections shall remain in full
force and effect.
