Dear Jennifer,
The Developer, Lennar Corporation, recently completed the Pinecliff 4tn Addition improvements.
PROJECT REVIEW
This project began in July, 2oil and was substantially completed in November, 2012. All remaining punch
list items were recently completed in November 2013.
CURRENT LETTER OF CREDIT
There is currently one letter of credit for this project that is being retained by the City. LOC# CPCS-
9 which is for public improvements, is in the amount of $2,800.
RECOMMENDATION
The Developer, Lennar Corporation, has satisfactorily completed the requirements in accordance with the
project plans and specifications. A copy of the record plans submitted by the developer has been included
for your reference. Therefore, it is recommended that the public infrastructure be accepted by the City of
Cottage Grove. It is also recommended that the current letter of credit for the project be released upon
project acceptance.

RESOLUTION NO. 2013-XXX
RESOLUTION ACCEPTING THE STREET AND UTILITY
IMPROVEMENTS FOR PINECLIFF 4TH ADDITON
WHEREAS, pursuant to the Development Agreement between the City of Cottage
Grove and Lennar Corporation ("Developer"), the Developer undertook to complete certain
Public Improvements relating to the Pinecliff 4th Addition (the "Addifion"). Specifically,
Developer undertook to construct and install the following defined Public Improvements
relating to the Addition: Sanitary Utility, Water Utility, Storm Utility, Earth Work, Landscaping,
Erosion Control, Engineering/Administrative, Streets, Sidewalks, Lighting, Trails, etc., as more
fully defined in the Development and as documented by the plans and specifications on file
with the City; and
WHEREAS, the Developer has stated that the Public Improvements have been
completed in accordance with the Plans therefor then in effect and that the entire cost of the
Public Improvements has been paid; and
WHEREAS, the City has inspected the Public Improvements as of the date hereof; and
WHEREAS, the City hereby determines and certifies that the Public Improvements
have been completed in accordance with the Development Agreement, City standards, and
the Construction Plans; and
WHEREAS, the Developer and the City warrant and represent that all information
provided herein is true and correct as of the date of this document.
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove,
County of Washington, State of Minnesota:
1. Based upon compliance with the Development Agreement; Grading Permit; City
Ordinances, standards, and specifications; and the Construction Plans, the
Public Improvements are hereby accepted by the City.
2. Based upon this acceptance by the City, the Public Improvements shall become
the property of the City.
3. Based upon compliance by Developer pursuant to the Development Agreement,
the construction of the sidewalks within the appropriate road right-of-way by the
Developer is hereby approved and accepted by the City.
4. Based upon compliance by Developer pursuant to the Development Agreement,
the construction of the trails by the Developer is hereby approved and accepted
by the City.

5. Based upon compliance by Developer pursuant to the Development Agreement,
the installation of street lighting by the Developer is hereby approved and
accepted by the City.
6. The City hereby certifies and accepts the As-Built Drawings of the Public
Improvements.
7. The City hereby releases the letter of credit on file for these Public
Improvements.

and other wastes must 6e dtsposed of propedy and must comply with MPCA disposai requfrements.
2.Haznrdous Molerials: 011, gasoltne, paint and any hazardous substances must be properly stored, Including secondary contalnment, to prevent
spNs, Ieaks or other dlscharge. Restdcted access to storage areas must ha prodded to prevent vandaltsm. Storage and disposal of hazardous
wasle must be In compliance with MPCA regulatlons.
3.Ezternol washing of trucks and other construclfon vehicieo must be limited to a defined areo of ihe s(te. Runoff must be contained and waste
properly disposed of. No engine degreosfng is allowed on site.
4.Concrete washout onsita: All Iiquid and soltd wastes generated by conerete washout operaUons must be contafned in a leak-proof conlalnment
focll(ty or Impermeable Itner. A compacted clay linrs that does not allow washout liquids to enter ground woter is considered on fmpermeahle
Iineo The Ilquid and aolid waetea must not rnntact the ground, and thera muat not be runoff from the concrete washout operaHone or areae.

2.The Permittee(s) must ensure that the permanent siormwater treatment system meets all requiremenls fn Part 111, C. This includes but is not
limited to, a final dean out of temporary or permanent sedimantatfon 6osfns that are to be used as parmanent wate� qudity monagement
basins and flnal construction or malntenance of Intiltration basins. All sedtment must be removed from conveyance sysiems and dltches must
6e stabilized with permanent cover.
3.Prtor to submission of the NOT, all temporary synthetic and structural erosion prevendon and sediment control BMPs (such as siR �ence) must
be removed on the portfons of the sfte for whlch the Pertnittea is rasponslble. BMPs designed to decomposa on site (such as svme compost
