RE: Commercial Property Enforcement Sweep Review
Background
In the spring/summer of 2013, a sweep of commercial properties throughout the community was
conducted to address and enforce code violations. Violations addressed included required
maintenance of parking and drive areas, reduction of window signs, and removal of long grass
and weeds. Notices were sent addressing these violations. Within the 14 days of the notice, the
violations were followed up by Community Development staff. The following summaries highlight
the response to the violation notices.
Discussion
Property owners were sent a detailed notice depicting violations at their property. An overview of
properties addressed and their compliance is shown below:

All commercial properties were brought into compliance after receipt of the first notice. Several
properties, including Target, Burger King, and Cottage Grove Plaza, were in need of mainten-
ance to their parking areas. Burger King repaired all pot holes in their parking area and
entrance; Cottage Grove Plaza seal-coated all problem areas in their lot; and Target repaired all
problem areas and has preliminary plans to resurFace their entire lot and entrance in 2014.
Recommendation
Review 2013 commercial sweep activity and results and consider continuing to address the
following issues in 2014:
• Landscaping
• Parking lot/drive conditions
• Building exterior finishes

RE: Off Premise and Temporary Sign Enforcement
Background
Off-premise advertising signs have not been consistently enforced. In an effort to address all
signs equally, the City is proposing to enforce those code requirements. Off-premise signs can
cause additional distractions for drivers, create safety concerns, pose additional hazards to
pedestrians and motorists, and aesthetically become an unattractive and unappealing sight
within the community. In many cases, the advertisement is placed within the public right of way,
which is not permitted.
City Code Title 9-8-5F7 prohibits off premise advertising signs with the exemption of the signs
listed in Title 9-8-8, Off Premise Advertising Signs. This list includes special event signs and
temporary signs measuring six (6) square feet or less in area, on Saturday and Sunday,
between the hours of 11:00 a.m. and 6:00 p.m., and on Tuesdays between the hours of 10:00
a.m. and 2:00 p.m.
City Code Title 9-8-7 allows for temporary advertisement signs in the form of a banner with a
secured permit. The sign may not exceed 32 square feet in size, must be attached only to the
principal structure, and may only be displayed for a cumulative total of 15 days per calendar
year.
Quasi-Public Signs, giving notice of events and activities sponsored by civic, patriotic, religious,
or charitable organizations located within Cottage Grove for non-commercial purposes are per-
mitted. These signs include banners, pennants, and flags but may not be erected or maintained
more than 30 days prior to the date on which the event advertised is to occur or be conducted
and shall be removed within 5 days after the termination of the event or activity.
Discussion
Multiple commercial properties, non-profit organizations, and other properties, as shown below,
are currently in violation of off-premise and temporary sign ordinances:

Enforcement of all non-compliant signs would include removal or requirement of appropriate
permits to maintain signage. A no-fee application is required to secure a permit for use of a
temporary sign (temporary banners hung on the principal structure) which meet all code
requirements.

Grand opening and special event signs are permitted for no longer than a 30-day period and/or
through the duration of the special event. Portable reader boards, inflatable devices, balloons,
and banners for business grand opening events require a permit and are allowed for no longer
than 10 days.
For sale or lease signs at lots and buildings are permitted and shall be removed within seven
days following the lease or closing of the property. These signs are required to be maintained in
a proper state of preservation, and all display surFaces shall be kept neatly painted or posted at
all times.
Recommendation
Consider enforcement action to be taken for commercial and non-profit, off-premise and tempo-
rary signs. Corrective action: banners (remove within 15 days), signs on posts (removal by
deadline of May 1).

RE: For Sale/Lease Sign Regulations
Background
Vacant lots or buildings are sometimes empty for periods of time leading to signs advertising
that the property is for the sale or lease. City code allows for these types signs to be posted
without securing a permit, with requirements that the signs are no larger than 32 square feet in
size and are maintained in an aesthetically-pleasing manner through the duration of the posting.
For sale or lease banner signs are exempt from sign permit requirements but are required to be
posted on the principle structure. One free-standing sign per street frontage upon which the
property abuts is permitted. All for sale and lease signs must be removed within seven days
following the lease or closing of such building or lot.
For sale or lease signs that have been posted for a long term can become unappealing. Be-
cause the City is unable to regulate the duration of these posted advertisement signs, they can
become unaesthetic looking.
Discussion
The City has concerns regarding the maintenance and duration of posted for sale and for lease
signs throughout the community, such as the maintenance of the "for lease" sign on 80th Street.
Investigation has been done into peer communities and their requirements pertaining to for sale
and/or lease advertisement signs, including duration of sign posted regulations and mainten-
ance regulations.
Similar communities and their regulations show similar regulations, such as required removal of
signs after sale or lease of the property as well as required setbacks. Similar growing communi-
ties do not regulate the duration of time in which a sale or lease sign may be posted. The main
regulations pertain to the size, location, and maintenance of such signs.
Woodburv:
On-site real estate signs for the sale and lease of property are allowed subject to regulations
including:
• One sign per street frontage
o No more th�n 32 squ�re fPet in area �nd 12 feet maximum height
• Signs shall be removed upon sale or lease of the property
• Signs shall be at least 10 feet from the curb or shoulder of the road
Burnsville:

Property for sale or lease signs shall be wall (does not project more than 12 inches from the
surface of the building) or freestanding signs and shall be removed within 10 days after closing
of property.
• Such signs must be professionally designed and painted on all sides including support
posts
• Signs shall be limited to one per street frontage
• Signs shall not measure more than 40 square feet
• Sign height maximum of 12 feet
• Sign shall be set back from the front property line no less than one foot per one foot of
sign height
Apple Valle�
One temporary sign per street frontage shall be permitted in the front or side yard of the
building. The sign shall be removed within 10 days after the property is rented or the closing of
the sale.
Oakdale:
Temporary selling or leasing signs adjacent to the public right of way shall be permitted
provided:
Signs do not exceed six square feet
• One sign is permitted per street frontage
• Sign shall be removed within 7 days following lease or sale
Bloomington:
For sale signs on street frontages may elect one of the following options:
1. Incorporate the real estate sign into the existing permanent sign and increase the total
allowed sign surFace are by 16 square feet. No other real estate sign shall be allowed.
2. One real estate sign, not exceeding 16 square feet, shall be permitted per street
frontage up to a maximum of two signs per site. Maximum height shall be 6 feet and

One sign shall be allowed per street frontage when a building is offered for sale or lease and
shall be a maximum of 64 square feet in area and no more than 10 feet in height.
Maple Grove:
On-premise property sale or lease signs must be removed within 10 days after the sale or rental
of the property. Signs may not measure more than 32 square feet and shall only be posted one
per frontage.
