COUNCIL ACTION REQUEST:
Allow the representative for Supervalu, Inc./DBA Cub Foods to admit or deny the allegation
that their business sold alcohol to an underage buyer during the Public Safety Department's
compliance check on December 5, 2013.
STAFF RECOMMENDATION
If the representative admits to the violation, impose the schedule penalty for their 1 st violation
in a 24-month period of a$500.00 fine and one-day suspension, or, at the City Council's
discretion, in lieu of the suspension, the participation of all employees in an educational
program approved by the Public Safety Director. If the representative denies the allegation,
schedule a contested case hearing before an administrative law judge.

RE: Liquor License Violation--Cub Foods, Cottage Grove, Minnesota
This letter is to request the presence of a representative of Supervalu, Inc. to attend the February 19,
2014 Regular Cottage Grove City Council meeting, where the City Council will asi<your company's
representative to admit or deny the allegation that your business sold liquor to a minor during a Public
Safety Department compliance checl< on December 5, 2013. The City Council meeting will tal<e place at
7:30 p.m. at Cottage Grove City Hall, 12800 Ravine Parl<way, Cottage Grove, MN 55016.
If your company's representative admits to the allegation or fails to attend the meeting, the City Council
will be asf<ed to impose the scheduled penalty:
$500.001st Violation in a 2-Year Period (plus 1-day suspension; or, at the city council's
discretion, participation of all employees in an educational program approved by the
Public Safety Director.)
if your company's representative denies the allegafiion, staff will recommend that a confiested case
hearing be scheduled before an administrative law judge.

ALCOHOL COMPLIANCE CHECKS
On Dec 5, 2013 Officers Pelton and Ziebarth conducted alcohol compliance checks using two underage buyers.
Sixteen open businesses successfully passed the checics.
Cub Foods failed (11317000) and sold alcohol to an underage buyer.
The following businesses refused to sell to the underage buyers:
