COUNCIL ACTION REQUEST
Consider authorizing issuance of a tobacco sales license to Grove Tobacco, Inc., 8461 East
Point Douglas Road.
STAFF RECOMMENDATION
Authorize issuance of the tobacco sales license. During the required background investigation,
no facts were found that would constitute a basis for denial of the application.

Re: TOBACCO LICENSE APPLICATION BACKGROUND — GROVE
TOBACCO
APPLICANT:
HANI FAYEZ GIETH

On February 12, 2014, the applicant made application with the city of Cottage Grove
to possess a tobacco license which would be operated by the commercial
establishment called Grove Tobacco Inc., located at 8461 East Point Douglas Road,
Cottage Grove; MN 55016.
BACKGROUND:
The location of 8461 East Point Douglas Road has been an ongoing tobacco and
tobacco related products retail establishment, which has been operated in the city of
Cottage Grove for a numb�r of years. The ownership has changed hands many
times, however, it should be noted that most, if not all, of the recent owners have
been members of the Wazwaz family, A TLO check of the current applicant, Hani
Gieth, shows that he is also related to the Wazwaz family. Mr. Gieth has made
application with the Secretary of State's office with a filing date of 02-11-2014 with a
renewal date of 12-31-2015 and the status is indicated as active and in good
standing. The applicant has also made application with the State of Minnesota to
obtain a retail cigarette and tobacco related products license to be operated out of
the same location. The applicant has applied for an exemption from obtaining
worker's compensation insurance for this location as he is stating that he will be the
only compensated employee. The applicant has read the Cottage Grove Tobacco
Sales license addendum wherein he agrees not to sell any drug paraphernalia or
drug paraphernalia related items but also indicates that he has been given a copy of
Cottage Grove Ordinance 5-1-11, pertaining to the sale of drug paraphernalia and
has read such ordinance and intends to comply with it. Periodic inspections will be
conducted at the business to ensure compliance with Cottage Grove ordinances
pertaining to drug paraphernalia.
POLICE CONTACTS:
I did check local contacts utilizing our records management system and can find
nothing of a negative contact. I did also contact the city of Blaine and found that the
applicant has no contacts with his residence city of Blaine. I also contacted Anoka
County and again found that the applicant has no negative contacts with any of these
jurisdictions.
CRIMINAL AND TRAFFIC:
I did complete a public records search of the applicant's criminal history and find that
he has no history of arrests and there no wants or warrants for the applicant's arrest.
In reviewing his traffic related history, I find that he received citations o
showing as fines paid.
CIVIL:
I did conduct a MNCIS checks and also TLO checks and find that the applicant has
no history of any civil, family, probate cases against him.
CONCLUSION:
I have conducted a thorough background investigation regarding this applicant and
could find nothing during that investigation which would preclude the applicant from
holding a tobacco and tobacco related sales license from the city of Cottage Grove.
