December 18, 2013 Regular Meeting. 4. CONSENT CALENDAR A. Accept and Place on File the Following Minutes: i. Environmental Commission Meeting Minutes from November 13, 2013 and January 8, 2014. FEBRUARY 19, 2014 AGENDA Cottage Grove City Council B. Consider authorizing issuance of a tobacco license to Wal -Mart Stores, Inc. /DBA Walmart #2448, 9300 East Point Douglas Road. Staff Recommendation: Authorize issuance of the tobacco license. During the required background investigation, no facts were found that would constitute a basis for denial of the application. C. Consider reappointing Commissioners to the Human Services /Human Rights Commission; Parks, Recreation and Natural Resources Commission; Public Safety, Health and Welfare Commission; Public Works Commission; Planning Commission; Environmental Commission; and Advisory Committee on Historic Preservation. Staff Recommendation: Approve the appointments per Joe Fischbach's memo dated 211412014. D. Consider adopting a resolution amending the Personnel Policy, adding Criminal Convictions and Workplace Violence Prevention policies. Staff Recommendation: Adopt the resolution. E. Consider accepting the contents of and place on file the 2014 Cottage Grove Athletic Facility Improvements Plan. Staff Recommendation: Accept the contents of and place the plan on file. F. Consider authorizing staff to apply for the Bell Helmets Grant in the amount of $33,000 to be used towards the construction of a jump line at the Cottage Grove Bike Park. Staff Recommendation: Authorize staff to apply for the grant. G. Consider approving the Private Utility Easement Agreement for a private electrical facility located near 11865 Point Douglas Drive South to provide power to an existing non - conforming billboard. Staff Recommendation: Approve the agreement. H. Consider authorizing issuance of a massage therapist license to Jessica Josephson. Staff Recommendation: Authorize issuance of the massage therapist license. During the required background investigation, no facts were found that would constitute a basis for denial of the application. Ms. Josephson will be working at The Healing Place, 8617 West Point Douglas Road. 5. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES 6. PUBLIC HEARINGS A. Hold the public hearing and consider authorizing issuance of an off -sale intoxicating liquor license to Wal -Mart Stores, Inc. /DBA Walmart #2448, 9300 East Point Douglas Road. Staff Recommendation: Authorize issuance of the liquor license. During the required background investigation, no facts were found that would constitute a basis for denial of the application. 7. BID AWARDS FEBRUARY 19, 2014 AGENDA Cottage Grove City Council 8. UNFINISHED AND NEW BUSINESS A. Allow the representative for Supervalu, Inc. /DBA Cub Foods to admit or deny the allegation that their business sold alcohol to an underage buyer during the Public Safety Department's compliance check on December 5, 2013. Staff Recommendation: If the representative admits to the violation, impose the schedule penalty for their 1st violation in a 24 -month period of a $500.00 fine and one -day suspension, or, at the City Council's discretion, in lieu of the suspension, the participation of all employees in an educational program approved by the Public Safety Director. If the representative denies the allegation, schedule a contested case hearing before an administrative law judge. B. 1. Consider approving the agreement between the South Washington Watershed District and the City of Cottage Grove regarding the East Ravine Area Stormwater Facilities. 2. Consider approving the license agreement between the South Washington Watershed District and the City of Cottage Grove for facilities in the East Ravine Stormwater Area. 3. Consider approving the Permanent Public Drainage and Municipal Utility Easement Agreement and Temporary Construction Easement. Staff Recommendation: 1. Approve the agreement. 2. Staff Recommendation: Accept the report. E. Consider not waiving tort liability limits. Staff Recommendation: Do not waive the statutory tort limits where an individual claimant would be able to recover no more than $500, 000 on any claim to which the statutory tort limits apply. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would be limited to $1.5 million. F. Consider appointing Mark Nelson as Chair of the Parks, Recreation, and Natural Resources Commission. Staff Recommendation: Approve the appointment. G. Consider appointing Rick Johnson as Chair of the Human Services /Human Rights Commission. Staff Recommendation: Approve the appointment. H. Consider appointing Thaddeus Owen as Chair of the Environmental Commission. Staff Recommendation: Approve the appointment. I. Consider appointing Jim Rostad as Chair of the Planning Commission. Staff Recommendation: Approve the appointment. J. Consider approving a fee increase to 2 percent of the constructed value for fire suppression system permits. Staff Recommendation: Pass the ordinance amending the fee. K. Consider changing the meeting date for the Public Safety, Health and Welfare Commission to the fourth Tuesday of the month at 7 p.m. in the City Council Chamber. Staff Recommendation: Change the meeting date. L. Consider appointing Jodi Lewis as Chair of the Public Safety, Health and Welfare Commission. Staff Recommendation: Approve the appointment. 5. Hold the public hearing and consider amending the City Code to change the number of members on the Environmental Commission to seven and adding two youth members. Consider acceptance of the proposal from Stevens Engineering to perform an Ice System Evaluation Study for the Cottage Grove Ice Arena for the amount of $4,900.
