Proposal
Cub Foods is requesting approval of an interim conditional use permit to conduct outdoor
seasonal sales and to erect two 21 -foot by 60 -foot greenhouses on their property at 8690 East
Point Douglas Road. Both greenhouses will be used for storing and displaying plant materials.
Plants and landscaping materials will also be displayed outside the temporary greenhouses. A
split -rail fence will be erected along the perimeter of the outdoor sales area. The outdoor sales
at this site are proposed to operate from April 1 to July 1. The applicant is requesting that the
interim conditional use permit be granted annually for a five -year period.

Background
An interim conditional use permit for a temporary greenhouse in Cub Foods parking lot was origi-
nally granted by the City in 1992, and several others have been granted since that period. The
latest interim conditional use permit (Resolution 2009 -044) expired July 1, 2013. Each year since

1992, Cub Foods obtained a building permit from the City to erect the temporary greenhouse and
operate the outdoor sales of plants and landscaping materials. An annual fee for interim conditional
uses is collected with the building permit. The current annual rate for interim use is $300.
Planning Considerations
Property Characteristics
The Cub Foods site is fully developed on approximately 8.2 acres of land. The property is com-
mercially guided and located within the B2- Retail Business District. The 64,569 square foot
building is located at the north end of the site and was recently remodeled. There are 371 parking
spaces provided on the south and west sides of the building. Motor vehicle access is provided from
East Point Douglas Road, Jamaica Avenue, and 90th Street. The outdoor display and sales of
nursery products and merchandise utilizes 23 parking spaces. This parking impact has occurred
since 2009, and has not had a negative impact on the site parking operation, as an abundant
number of parking spaces are still available in the vicinity and on the site as a whole.
Outdoor Sales
The applicant proposes to continue operating outdoor sales of landscaping material in the twenty -
three parking spaces as they have in the past. The perimeter of the display area will be fenced with
a split -rail type barrier. The site plan for the outdoor sales areas is attached.
Public Hearing Notices
Notices announcing this public hearing were published in the South Washington County Bulletin
on April 16, 2014. Public hearing notices were mailed to 110 property owners within 500 feet of
the Cub Foods property.
Summary
The proposed use is temporary in nature and the sales items are consistent with approved mer-
chandise for the B -2 zoning district. Seasonal outdoor sales are listed as an interim conditional
use, and as proposed, the use would meet the criteria for issuing this type of permit.
Recommendation
That the Planning Commission recommends that the City Council approve Cub Foods' interim
conditional use permit to construct two 21 -foot by 60 -foot temporary greenhouses and the out-
door display and sales of landscaping materials and plants in the southwest corner of their
parking lot, subject to the following conditions:
1. The interim conditional use permit is valid beginning on April 29, 2014 and expiring on July
1, 2019. The approved start date is April 1 in subsequent years.
2. The applicant must annually pay the interim conditional use permit application fee to the
City prior to the operation of the seasonal outdoor sales.

3. A building permit for the temporary greenhouses must be issued by the City before any
greenhouse is erected. A building permit is required each year that a greenhouse is used on
the property.
4. The temporary greenhouses must setback a minimum of 20 feet from the property line
along East Point Douglas Road and 20 feet from the back of the curb for that portion of
private drive providing access into the Cub Foods parking lot.
5. Landscaping materials and fencing are prohibited on the grass areas between the Cub
Foods parking area and East Point Douglas Road or the private access drive along the west
side of the site.
6. Overhead electrical service or electrical extension cords are prohibited from any power
source that extends across the parking /paved area of the Cub Foods site.
Advertising signage attached to the temporary tent is permitted. Free - standing signs or off-
premise advertising are prohibited.
8. A sign package shall be submitted with the building permit application, and will be reviewed
and approved by the Planning Division.
