COUNCIL ACTION REQUEST
Hold the public hearing and consider authorizing issuance of an off-sale intoxicating liquor
license and tobacco sales license to Yayin Gadol, LLC/DBA Top Ten Wine & Spirits, 8617
East Point Douglas Rd S.
STAFF RECOMMENDATION
Authorize issuance of the licenses. During the required background investigation, no facts
were found that would constitute a basis for denial of the applications.

Subject: 2014 LIQUOR LICENSE APPLICATION
INTRODUCTION
All locations within the City of Cottage Grove that self alcoholic beverages are required by
State Law and City Ordinance to be licensed.
BACKGROUND '
Pursuant to City Ordinance, Jonathan Garett Halper and David William Halper, on behalf of i
Northgate Liquors and Yayin Gadol, LLC., dba/Top Ten Wine and Spirits, located at 8617 I
E. Pt. Douglas Road South, Cottage Grove, Minnesota, has submitted an application for an j
"Off Sale" intoxicating liquor license. The Department of Public Safety is required to conduct '
a police investigation of the applicants.
DISCUSSION
The application of Top Ten Wine and Spirits, as submitted, is complete and in compliance
with our ordinance.
We have investigated the applicants and have not found any facts which would constitute a
basis for denial of an "Off Sale" intoxicating liquor license under the provisions of the City
Liquor Ordinance or Minnesota Statutes relating to alcoholic beverages.
RECOMMENDATION
Recommend that the City Council approve the Liquor License application for Top Ten Wine
and Spirits.

Subject: Review of Financial Information - Yayin Gadol, LLC
I have reviewed three years of tax returns and the business plan submitted by Yayin Gadol,
LLC as required background information for their liquor license application.
The financial information provided indicates a solid and viable business plan. A liquor license
should not be denied on financial grounds.

NOTICE IS HEREBY GIVEN, that an application has been filed with the City
Council of the City of Cottage Grove for an "Off Sale" Intoxicating Liquor License by
Yayin Gadoi, LLC, for the establishment known as Top Ten Wine & Spirits, located on
that property described as follows:
Commonly known as 8617 East Point Douglas Road South,�
City of Cottage Grove, Washington County, Minnesota.
NOTICE IS FURTHER GIVEN, that a public hearing will be held on said
application on Wednesday, August 13, 2014, at 7:30 p.m., at Cottage Grove City Hall,
12800 Ravine Parkway South, Cottage Grove, Minnesota.
All interested persons will be heard at this time.
