Attached are two versions of the draft sign ordinance amendment. The first is the marked - up version, which shows language that was struck and new language that was added. The second is a "clean" copy. The "clean" version has the exact same language that is in the marked -up version but will be much easier to read and comprehend. Purpose: The purpose of this chapter is to protect and promote the general welfare, health, safety 22 and aesthetics within the city through the establishment of comprehensive standards, regulations 23 and procedures governing the erection, use and /or display of devices, signs or symbols serving as 24 visual communicative media to persons situated within or upon public rights of way or properties. 25 Signs are an essential element of any community. Their location, number, size, design and 26 relationship to each other and to other structures has a significant influence upon a community's 27 appearance and welfare. 28 B. Intent: The provisions of this chapter are intended to encourage creativity, a reasonable degree of 29 freedom of choice, an opportunity for effective communication and a sense of concern for visual 30 amenities on the part of those designing, displaying or otherwise utilizing needed communicative 31 media of the types regulated by this chapter, while at the same time assuring that the public is not 32 endangered, annoyed or distracted by unsafe, disorderly, indiscriminate or unnecessary use of 33 such communicative facilities. (Ord. 747, 10 -15 -2003) 34 9 -8 -2: DEFINITIONS: 35 36 For the purposes of this chapter, the following words and phrases shall have the meanings respectively 37 ascribed to them by this section. Words and phrases not defined in this section but defined in the 38 zoning ordinance of the city shall be given the meanings set forth in the zoning ordinance: 39 40 ACCESSORY USE: A subordinate and incidental building or use which is located on the same lot on 41 which the main building or use is situated and which is reasonably necessary and incidental to the 42 conduct of the primary or main use of such buildings. An interior lot has one 334 street frontage, and a corner lot has two (2) frontages. 335 336 SWINGING SIGN: A sign that moves back and forth freely, or sways in the wind. 337 338 TEMPORARY EVENT SIGN: A temporary sign advertising a community event sponsored by a 339 governmental entity or not - for - profit entity that is limited only to one type of temporary sign that may 340 include either a banner, balloon, flying banner, pennant, or valance. 341 342 TEMPORARY SIGN: Any sign which is intended to be erected or displayed for a limited period of time, 343 including signs affixed or attached to vehicles, including trailers, and capable of being readily removed; 344 flyers, banners, a -frame signs, inflatable signs, or flying signs. 345 346 WALL SIGN: A sign which is affixed to the exterior wall of a building and which is parallel to the building 347 wall and which does not project more than twelve inches (12 ") from the surface to which it is attached, 348 nor extend beyond the top of the parapet wall. 349 350 WINDOW SIGN: A sign affixed to or inside of a window in view of the general public. This does not 351 include merchandise on display. (Ord. 833, 11 -21 -2007) 352 353 9 -8 -3: PERMIT REQUIREMENTS: 354 A. Compliance And Permit Required For Anv Sian Except as otherwise provided in subsection B of 355 this section, no sign or structure shall be erected, constructed, altered, rebuilt or relocated, except 356 as provided in this chapter, and until a permit for the same has been approved by the community 357 development director and issued by the building inspection division, upon application therefor 358 submitted, in such form as the building inspection division may prescribe so as to include such 359 information as may be required for a complete understanding of the proposed work. 360 B. Exemptions From Permit: Permit Not Required 361 1. Ne Permit , sae required under this GhaPter f—.r ,Te #^III- 362 1. A-A- Window sign (placed within a building and within view of the general public not exceeding 363 thirty percent (30 %) of display surface. 364 a. Window sign consisting solely of individual alphabetic letters, numerals, or other symbolic 365 characters without any background may be displayed but the net area shall not cover more than 366 30 percent of the total window area. Page 8 367 368 b. A window sign that includes opaque objects, logos, and other images with anv type of 369 background may be displayed, but the net area of the window sign shall not exceed 30 percent 370 of the window area. Opaque objects without any lettering, numerals, other symbolic characters. 371 logos or any other images are not limited to window coverage area. 372 373 c. The "total window area" shall be one continuous panel of glass or other transparent material 374 or a set of two or more panels divided by mullions of six inches in width or narrower. Panels 375 surrounded on all sides by solid walls or mullions wider than six inches shall be considered 376 individual windows. 377 378 d. The net area, for purposes of subsections 1 and 2 of this Section shall be determined by 379 measuring a box around each group of characters, objects, images, logos and any background. 380 381 e. For purposes of this section, any banner attached to the outside of a window shall not be 382 considered a window sign and shall require a permit. 383 384 f. Hours of operation shall not be included in window sign area calculation. 385 386 g. Temporary Builder Directional Signs Provided: 481 a. No more than three (3) temporary directional signs for each model home they may 482 have within a subdivision. 483 484 b. No more than eighteen (18) inches by twenty four (24) inches (18" X 241 485 486 c. Must be located within the developing subdivision. 487 488 d. May not be closer than six (6) feet to the curb nor closer than two (2) feet of any 489 sidewalk and /or trail. 490 491 e. Sign(s) are permitted every day of the week within the developing subdivision. 492 493 f. All subdivisions must install landscaped entrance features at main entrances to 494 subdivisions which must be a monument design, may not exceed thirty (30) square 495 feet in size and reauire a permit. •: 497 15. Athletic Field Signage. Signs, banners and scoreboards designed solely for view from 498 spectator areas and displayed on interior walls, fences or other structures located inside an 499 enclosed athletic field at a school, park, other public or private athletic complex: except that 500 approval of the Park. Recreation and Natural Resource Commission shall be required to 501 display a sign, banner or scoreboard under this paragraph at a city park. 502 503 16. Scoreboards that qualify under this paragraph may include flashing elements, if adeauate 504 screening is provided to screen the view from abutting streets. 505 506 17. Memorial signs or tablets such as cornerstones denoting only the names of buildings and date 507 of erection, cut or set into a masonry_ surface and displayed on a wall only_ . Holiday lights and decorations. 515 516 20. The illumination of building facades with neon or light emitting diode (LED) architectural 517 lighting shall be permitted when properly maintained. (Ord. 858. 5 -6 -2009) 518 C. 2, The exemptions permitted by this subsection shall apply only to the requirement of a permit and 519 shall not be construed as relieving the owner of the sign from responsibility for its erection and 520 maintenance. Page 11 521 D� Application For Permit: The following information shall be submitted within or along with the 522 permit application for a sign: 523 1. Name, address and telephone number of person making application. 524 2. Name, address and telephone number of person owning sign. 525 3. A site plan drawn to scale showing the location of lot lines, buildings, structures, parking areas, 526 existing and proposed signs and any other physical features. 527 4. Plans, location, specifications, number of signs and their dimensions and method of 528 construction and attachment to the building or placement method in the ground. 529 5. Copy of stress sheets and calculations showing that the structure is designed for dead load and 530 wind pressure in any direction in the amount required by this chapter and all other laws and 531 ordinances of the city. 532 6. Written consent of the owner or lessee of any site on which the sign is to be erected. 533 7. Such other information as the building official or director of community development shall 534 require to show showing full compliance with this chapter and all other laws and ordinances of 535 the city. The building official may waive subsections C4 and C5 of this section. (Ord. 747, 10- 536 15 -2003) 538 E. Sign Contractors: 539 ,4 1. License Required; Application; Fee: No person shall install, erect or maintain any signs within 540 the city without having first obtained a license from the city. An applicant shall complete and file the 541 application form required by the director of community development and pay the fee set by the city 542 council. 543 B-. 2. Exemption From License: Licenses are not required for exempt signs as identified in subsection 544 9 -8 -3 13 of this chapter. 545 G-. 3. Insurance Requirements: No license granted under the terms stated herein shall become 546 effective until the licensee shall have filed with the city clerk a copy or a certificate of insurance for a 547 minimum of seven hundred fifty thousand dollars ($750,000.00) combined single limit liability 548 coverage for injury to or death of any one person or persons, or damage /destruction of property in 549 any one accident. (Ord. 747, 10 -15 -2003) 550 9 -8 -4: PROVISIONS APPLICABLE TO ALL ZONING DISTRICTS: 551 A. General Standards: The following standards shall apply to all signs in all districts as permitted by 552 this chapter unless specifically set forth otherwise by this section. Determination as to the 553 applicability of the standards to any given sign shall rest with the Director of Community 554 Development, subject to the administrative appeal procedures set forth in this chapter. Traffic Interference: No sign may be erected that by reason of position, shape, movement, color 558 or in any other manner interferes with the proper functioning of a traffic sign or signal or 559 otherwise constitutes a traffic hazard. Any sign illuminated and located within fifty feet (50') of a residential district lot line shall be 655 diffused or indirect so as not to reflect direct rays of light into adjacent residences. All 656 illuminated signs in business and industrial districts in close proximity to residential districts 657 shall be designed, to the extent practical, so as to illuminate the sign and not residential 658 property. Page 16 659 2. Illuminated signs lighted by any means, whether as an integral part of the sign or a light away 660 from the sign, such as floodlights, shall be governed as follows: 661 a. Any combination of signs or light sources which cast a light on a public street shall not 662 exceed one foot - candle (foot - candle meter reading) as measured from the property line. 663 b. Due to the 888 multiple land uses in a planned unit development, all signs shall be compatible in character, 889 materials and color with each other and the surrounding land uses. All signs in the PUD shall be 890 restricted as in a B -2 retail business district; however, upon the discretion of the planning 891 commission or city council, such signs may be more restrictive than the B -2 retail business 892 district. 893 C. Shopping Centers: Shopping centers shall submit a comprehensive sign plan at the time when 894 the building plans are reviewed by the planning commission. Such signs shall be regulated as in a 895 B -3 general business district. 896 D. Mississippi River Critical Area: Within the designated Mississippi River critical area, no sign is 897 permitted that is visible from the river, except those necessary for safe navigation along the river. 898 E. Movie Theaters: Movie theaters are allowed one freestanding sign not to exceed two hundred 899 (200) square feet and not to exceed twenty five feet (25') in height. Page 23 900 F. Multiple Residential Buildings: 901 1. Multiple residential buildings are allowed one address sign of no more than three (3) square 902 feet per principal entrance. 903 2. A multiple residential complex consisting of three (3) or more structures or ten (10) or more 904 units shall be allowed an area identification sign not to exceed sixty four (64) square feet. 905 G. Statues, Sculptures, and Architectural Features: Symbols, statues, sculptures and integrated 906 architectural features of a design which deviates from the architectural character of the 907 surrounding structures shall require a conditional use permit. Such signs 924 must not create a public safety hazard, must not be within any public right -of -way and not 925 encroach the clear view triangle requirements as specified in 11- 8- 5A(3)(c) for this section. 926 J. Projecting Signs: 927 Projecting signs shall be permitted only in the Planned Unit Development District, subject to the 928 following restrictions: 929 1. The maximum sign area shall be 20 square feet per facjna. 930 2. Not less than eight feet of clearance shall be provided between the sidewalk elevation and the 931 lowest point of the projecting sjan. 932 3. Signs shall project from the face of the building no more than the lesser of : 933 (a) One -third of the sidewalk width: or Page 24 934 (b) Four feet. 935 Sidewalk width shall be measured perpendicular to the face of the building at the proposed 936 sign location. 937 4. The maximum sign area of wall signs located on the same building of the projecting sign shall 938 not exceed five percent of the wall area. 939 5. Proof of insurance and indemnification shall be provided in accordance with Section Title 9, 940 Chapter 8, Section 4(C ). 941 K. Hand - Carried Portable Signs: 942 Displayed on Public Property. Hand - carried portable signs may be displayed on public property 943 without a sign permit only as follows: 944 1. Used in a parade for which a permit is not required. 945 2. Displayed during and within the confines of an event for which a valid special use permit has 946 been issued, or displayed on private on private property directly adjacent to the area for which 947 the street use permit has been issued and only while the street use permit is valid. 948 3. Used at a city park during and within the confines of an event for which a valid permit has 949 been issued by the Parks and Recreation Department and only while the permit is valid. 950 4. Hand - carried portable signs on private property with the owner's permission or hand - carried 951 signs on the public sidewalk or other pedestrian way if the person carrying the sign or the sign 952 itself is not in violation of other ordinances or laws applicable to the location and conduct. 953 including but not limited to obstructing traffic, obstructing the sidewalk, trespassing. or 954 conducting or participating in an event for which a special event permit, street permit or park 955 event permit would be required by city ordinance. 956 5. A quasi - public sign may not be erected or maintained more than thirty (30) 988 days prior to the date on which the event or activity advertised is to occur or be conducted 989 and shall be removed within five (5) days after the termination thereof. 990 C. Failing determination of the sign owner, user or 1032 owner of the property on which the sign is located, the notice may be affixed in a conspicuous 1033 place to the sign or to the business premises with which the sign is associated. (Ord. 747, 10- 1034 15 -2003) 1035 9 -8 -8: LEGAL NONCONFORMING SIGNS: 1036 A. Continuance Of Use: Any legal nonconforming sign, including its structure, may be continued 1037 at the same size and in the same manner of operation except as hereinafter specified. 1038 B. Dangerous Conditions: A legal nonconforming sign must be removed if the sign and /or 1039 structure is declared unsafe by the building inspection division. Page 27 1040 C. Discontinuance Of Use: When a legal nonconforming sign has discontinued its usage for a 1041 period of six (6) months or has changed to conform with this chapter, any further use of the 1042 sign must comply with all provisions of this chapter. 1043 D. Damaged Signs: Whenever a legal nonconforming sign shall have been damaged by fire, 1044 flood, explosion, earthquake, war or an act of God and the damage of the sign and /or 1045 structure is fifty percent (50 %) or more of its fair market value as estimated by the building 1046 inspection division, the reconstruction shall comply with all provisions of this chapter. 1047 E. Alteration Of Signs: A legal nonconforming sign may not be altered so as to become a more 1048 restrictive legal nonconforming sign. 1049 F. Maintenance And Repair: Normal maintenance of a legal nonconforming sign is permitted, 1050 including necessary structural repairs and incidental alterations which do not extend or 1051 intensify the nonconforming status. (Ord. 747, 10 -15 -2003) 1052 9 -8 -9: MAINTENANCE AND REPAIR REQUIREMENTS: 1053 A. All signs, together with all their supports, braces, guys and anchors shall be kept in repair and 1054 in proper state of preservation. 1055 B. The display surfaces of all signs shall be kept neatly painted or posted at all times. 1056 C. All signs which are unsafe and /or unsightly shall be repaired or removed. Unsightly signs 1057 must be repaired or removed within fifteen (15) days of notification. The term "unsightly" shall 1058 mean a condition in which the sign has deteriorated to the point where at least one -fourth ( 1059 of the surface area of the name, identification, description, display, illustration or other symbol 1060 is no longer clearly recognizable at a distance of twenty feet (20'); or where paint is peeling, 1061 chipping, or flaking from the structure surface, or where the sign has developed significant 1062 rust, corrosion, rotting, or other deterioration in the physical appearance. 1063 D. Every sign and the immediate surrounding premises shall be maintained by the owner or 1064 person in charge thereof in a clean, sanitary and inoffensive condition and free and clear of all 1065 obnoxious substances, rubbish and weeds. Notice shall be given to the director of community 1066 development of any change in sign user, sign owner or owner of the property on which the 1067 sign is located. (Ord. 747 10 15 200 1077 9 -8 -10: SIGNS IN RESIDENTIAL AND AGRICULTURAL DISTRICTS: 1078 1079 Signs shall be permitted in residential and agricultural districts in accordance with the following 1080 minimum standards: Page 28 1081 1082 A. Sign Type: 1083 1. Identification Signs: 1084 a. Purpose: Identification signs are intended for the display of the name and /or address of 1085 the primary use on the property where the sign is located. 1086 b. Number And Size: 1087 (1) For one - family, two - family and bed and breakfast residences, one identification sign 1088 not exceeding a total of three (3) square feet in area. 1089 (2) For agricultural uses, one identification sign not exceeding a total of fifty (50) square 1090 feet in area. 1091 2. Area Identification Signs: 1092 a. Purpose: Area identification signs are intended for the identification of residential 1093 neighborhoods, subdivisions, and multiresidential complexes, and are also referred to as 1094 monument signs and /or pylon signs. 1095 b. Location: 1096 (1) Area identification signs shall be located at the entrance to the project or subdivision. 1097 (2) Area identification signs shall be located on private property and prohibited on public 1098 rights of way. Area identification signs may be permitted in right of way upon city 1099 council approval. 1100 c. Number And Size: A maximum of two (2) area identification signs, not exceeding a total of 1101 one hundred (100) square feet in sign area with no more than fifty (50) square feet per 1102 sign, may be permitted at each project entrance or subdivision entrance. Two (2) signs 1103 are permitted at each project entrance only to create a gateway effect at opposite corners 1104 of the entrance to the project. 1105 d. Height: The maximum height of an area identification sign shall be ten feet (10') 1106 3. Temporary Signs: 1107 a. Permitted Temporary Signs: 1108 (1) One temporary sign for transient/seasonal merchant and produce merchant in the 1109 agricultural districts is permitted. The sign shall not exceed thirty two (32) square feet 1110 in sign area, nor exceed eight feet (8') in height. Such sign shall be erected only 1111 during the period of transient/seasonal sale. (Ord. 747. 10 -15 -20031 1112 1113 Page 29 1114 9 -8 -11: SIGNS IN BUSINESS DISTRICTS: 1115 A. B -1 Limited Business District: Business signs are specifically intended for use by allowed 1116 commercial enterprises and are used to direct attention to the business, profession, commodity, 1117 or service which is found on the premises where the sign is located. Signs shall be permitted in 1118 the B -1 limited business district in accordance with the following minimum standards: 1119 1. Permitted Sign Types: 1120 a. One monument sign. 1121 b. Flat wall sign(s). 1122 2. Size: 1123 a. Monument signs shall have a maximum copy and graphic area of thirty six (36) square 1124 feet and a maximum monument area of two (2) times the potential copy and graphic area. 1125 b. No combination of wall signs and monument signs shall exceed one hundred twenty (120) 1126 square feet. 1127 c. Innlrlcntal and Informational signs shall not exceed four (4) square feet of surface area per 1128 sign. 1129 3. Height: No sign shall project above the highest outside wall of the building or twenty five feet 1130 (25'), whichever is less. 1131 4. Illumination: No illuminated sign which changes in either color or intensity of light shall be 1132 permitted except one giving time and /or temperature. The granting of permits for illuminated 1133 signs shall specify the hours during which the same may be lighted when necessary to 1134 prevent the creation of a nuisance. All illuminated signs shall have a shielded light source and 1135 conform to the provisions of subsection 9 -8 -5 C of this chapter. 1136 B. B -2, B -3 And P -B Zoning Districts: Signs shall be permitted in the B -2 retail business district, B -3 1137 general business district, and P -B planning business district in accordance with the following 1138 standards: 1139 1. Permitted Sign Types: Permitted sign types are the same as permitted in the B -1 limited 1140 business district. Each property is permitted one freestanding sign, either a pylon or 1141 monument sign. 1142 2. Freestanding Signs: 1143 a. Size of sign permitted is determined by the gross square footage of the principal structure 1144 located in the development. 1145 b. One sign per development unless a multitenant building or limited tenant building is eighty 1146 thousand (80,000) gross square feet or more and has two (2) or more primary access 1147 points. A second monument at a secondary access point is permitted if the primary 1148 freestanding sign is of monument style. The second monument sign shall include a Page 30 1149 shopping center identification message only and shall not exceed fifty percent (50 %) of 1150 the copy and graphic area and height requirement of the permitted principal sign. 1151 c. Incidental and informational signs shall not exceed four (4) square feet of surface area per 1154 sign. 1155 3. Wall Mounted Signs: 1156 a. Multitenant Wall Signs: 1157 (1) Each tenant is permitted tenant identification and one logo and shall not include 1158 product advertising except as part of the tenant's trade name or logo. 1159 (2) Tenant identification shall be individually mounted or located on a raceway that is 1160 consistent in color with the designated sign background and internally illuminated 1161 letters. Wall signs not containing individual letters may be approved by the city if all 1162 signs are of a similar design and incorporated into the architecture of the principal 1163 structure. 1164 (3) Each tenant is permitted one logo which shall not exceed thirty six inches (36 ") high 1165 by thirty six inches (36 ") wide. 1166 (4) The vertical dimension of the tenant identification shall not exceed twenty six inches 1167 (26 ") in height. Heights may be revised based on unique circumstances, such as 1168 extraordinary distance from right of way or unusual building configuration, when 1169 determined by the city council that signs would not be readable from adjacent public 1170 right of way according to commonly accepted industry standards. Page 31 1171 (5) Each tenant sign shall be installed within a twenty six inch (26 ") high designated 1172 horizontal band. The band shall be of uniform background consisting of building 1173 surface, facade, or treatment. The sign band and letter height may be modified upon 1174 approval of the city council to allow for architectural integration of the tenant sign. 1175 Consideration will be given to the proportional relationship of the sign width and height 1176 to the scale of the building. 1177 1178 1179 1180 1181 1182 1183 1184 1185 1186 1187 1188 1189 1190 1191 1192 1193 1194 1195 1196 (6) Each tenant sign shall not extend closer than two feet (2') from the tenant's lease line. (7) All letters in a tenant identification shall be of uniform colors, not to exceed two (2), except for logos, which may be multicolored. A multicolored logo must comply with the restrictions in subsection B3a(3) of this section. (8) The city may recognize separate sign plans for multitenant buildings which will supersede the ordinance. The sign plans which have been approved by the city council will have the effect of a sign ordinance for the specific property. b. Limited Tenant Wall Signs: (1) Size of signage is determined by gross square footage of principal structure on property. Gas station canopies or other canopies are considered principal structures for computing allowable signage. All illuminated signs shall have a shielded light source and conform to the provisions of 1205 subsection 9 -8 -5 C of this chapter. 1206 C. N -B Neighborhood Business District: 1207 1. Monument signs must be installed to denote the overall development project within the 1208 district. 1209 2. Monument sign sizes will be as regulated in subsection B2c of this section. 1210 3. Covenants must be recorded to ensure consistency of signage for all properties in the district. 1211 The covenants must identify permitted sizes, locations, and types of signage. Sign covenants 1212 will be based upon the sign regulations for the B -2 commercial district. 1213 4. Each tenant within the district is permitted one temporary sign for a period not to exceed thirty 1214 (30) days in a calendar year. (Ord. 747, 10 -15 -2003) 1215 9 -8 -12: SIGNS IN INDUSTRIAL DISTRICTS: 1216 1217 Within the 1 -1, 1 -2, 1 -3, and 1 -4 zoning districts, permanent signs which comply with the following 1218 standards are permitted: 1219 A. Monument Identification Sign: Any single- or multi- tenant building within an industrial zone is 1220 permitted one of the following freestanding identification signs that must comply with the listed 1221 standards: 1222 1. Building Identification Sign: 1223 a. One monument style sign; 1224 b. Sixty (60) square feet maximum copy and graphic area; 1225 c. Ninety (90) square feet maximum total monument size; 1226 d. Ten foot (10') maximum height; and 1227 e. Address and /or building identification displayed only; no product or service advertising is 1228 permitted. Page 33 1229 2. Tenant Identification Monument Sign: 1230 a. One monument sign; 1231 b. Sixty (60) square feet maximum copy and graphic area; 1232 c. Ninety (90) square feet maximum monument size; 1233 d. Ten foot (10') maximum height; 1234 e. Sign may display only identification of tenants; 1235 f. Tenant identification monuments are not permitted to be located along designated 1236 collector or arterial streets; 1237 g. Tenant identification monuments are not permitted in areas designated for mixed uses on 1238 the city comprehensive guide plan map or zoned P -B, planned business, on the city 1239 zoning map; and 1240 h. Individual tenant identification signs specified in subsection B of this section are not 1241 permitted. 1242 B. Individual Tenant Identification Signs: For multitenant buildings, one of the options listed in this 1243 subsection may be selected for tenant identification. All signs must comply with the listed 1244 standards. The building owner or a representative shall designate a sign design for each 1245 multitenant building. This designation will be recorded by the city and kept on record for the 1246 building. Each sign on the property must conform to the designated tenant identification sign 1247 option. Changes to the sign designation may be made upon request and approved 1248 administratively if all signs located on the site are brought into conformance with the requested 1249 sign plan modification. The planning commission must review sign plan changes if nonconforming 1250 signs are created. These signs are not permitted if the building's freestanding sign is a tenant 1251 identification freestanding sign. 1252 1. Option 1: Wall sign: 1253 a. One sign at the tenant's primary building entrance; 1254 b. Three foot by four foot (3'x 4') maximum dimension; 1255 c. Located adjacent to the tenant entrance; 1256 d. Eight foot (8') maximum from the ground to top edge of sign. 1257 e. Tenant identification message with no product advertising; and 1258 f. Uniform material, color, and style. 1259 2. Option 2: Individually mounted letters: Page 34 1260 a. Individually mounted letters not to exceed eighteen inches (18 ") in height with one per 1261 tenant at their primary entrance; 1262 b. Located within an eighteen inch (18 ") high designated sign band for the entire building; 1263 c. Affixed to a uniform background consisting of the building surface, facade, or treatment; 1264 d. Located no closer than two feet (2') from the tenant's exterior lease lines; 1265 e. Compatible with the building architecture; and 1266 f. Uniform material, color, illumination, and style. 1267 C. Single Tenant Identification Sign: Single tenant building signs within an industrial zone which 1268 comply with the following standards are permitted: 1269 1. Wall mounted individual letters; 1270 2. Wall signs shall not include product advertising. Wall signs shall include tenant identification; 1271 and 1272 3. Total surface area of all building signs shall not exceed five percent (5 %) of the building face 1273 upon which the signs are located up to a maximum one hundred fifty (150) square feet. 1274 D. Illumination: 1275 1. No illuminated sign which changes in either color or intensity of light shall be permitted except 1276 one giving time and /or temperature. 1277 2. The granting of permits for illuminated signs shall specify the hours during which the same 1278 may be lighted when necessary to prevent the creation of a nuisance. 1279 3. All illuminated signs shall have a shielded light source and conform to the provisions of 1280 subsection 9 -8 -5 C of this chapter. (Ord. 747, 10 -15 -2003) 1281 9 -8 -13: INSPECTIONS: 1282 1283 All signs for which a permit is required shall be subject to inspection by the director of community 1284 development. The director of community development, or any other official of the city who may be 1285 appointed by him /her, is hereby authorized to enter upon any property or premises to ascertain whether 1286 the provisions of this chapter are being obeyed. Such entrance shall be made during business hours 1287 unless an emergency exists. The director may order the removal of any sign that is not maintained in 1288 accordance with the maintenance provisions of this chapter. (Ord. 747, 10 -15 -2003) 1289 9 -8 -14: VARIANCES: 1290 A. Conditions Of Variances: Where there are practical difficulties or unnecessary hardships in 1291 any way in carrying out the strict letter of the provisions of this chapter, a variance may be 1292 granted; provided, that all the following conditions are true: Page 35 1293 1. The particular physical surroundings, shape or topographical conditions of the specific 1294 parcel of land involved cause a particular hardship to the owner, as distinguished from a 1295 mere inconvenience, if the strict letter of the regulations were to be carried out. 1296 2. The conditions upon which a petition for a variation is based are unique to the parcel of 1297 land for which the variance is sought and not generally applicable to other property within 1298 the same zoning classification. 1299 3. The alleged difficulty or hardship must be caused by this chapter and not by any person 1300 presently having an interest in the parcel of land. 1301 4. The granting of the variance will not be detrimental to the public welfare or injurious to 1302 other land or improvements in the neighborhood in which the parcel of land is located. 1303 5. The proposed variance will not impair an adequate supply of light and air to adjacent 1304 properties, will not increase the congestion of the public streets, will not endanger the public 1305 safety or will not diminish or impair property value within the neighborhood. 1306 B. Request For Variance; Fee: A person desiring to secure a variance or to appeal the 1307 interpretation and application of any provisions of this chapter by the director of community 1308 development shall fill out and submit to the director of community development a variance 1309 form together with the required filing fee. (Ord. 747, 10 -15 -2003) 1310 9 -8 -15: ENFORCEMENT: 1311 A. Violations: Any person violating any provision of this chapter shall be guilty of a misdemeanor. 1312 Each day that a violation continues to exist shall constitute a separate offense. (Ord. 747, 10- 1313 15 -2003) 1314 B. Removal Of Illegal Signs; Costs: Any sign installed or placed on public property, except in 1315 accordance with the requirements of this chapter, is subject to removal. Signs may be 1316 returned to the owner upon request, but the owner shall pay a fee in such amount as provided 1317 by ordinance of the city council from time to time. Signs not retrieved by the owner within 1318 fourteen (14) days of removal may not be returned. Purpose: The purpose of this chapter is to protect and promote the general welfare, health, safety 20 and aesthetics within the city through the establishment of comprehensive standards, regulations 21 and procedures governing the erection, use and /or display of devices, signs or symbols serving as 22 visual communicative media to persons situated within or upon public rights of way or properties. 23 Signs are an essential element of any community. Their location, number, size, design and 24 relationship to each other and to other structures has a significant influence upon a community's 25 appearance and welfare. 26 B. Intent: The provisions of this chapter are intended to encourage creativity, a reasonable degree of 27 freedom of choice, an opportunity for effective communication and a sense of concern for visual 28 amenities on the part of those designing, displaying or otherwise utilizing needed communicative 29 media of the types regulated by this chapter, while at the same time assuring that the public is not 30 endangered, annoyed or distracted by unsafe, disorderly, indiscriminate or unnecessary use of 31 such communicative facilities. (Ord. 747, 10 -15 -2003) 32 9 -8 -2: DEFINITIONS: 33 34 For the purposes of this chapter, the following words and phrases shall have the meanings respectively 35 ascribed to them by this section. Words and phrases not defined in this section but defined in the 36 zoning ordinance of the city shall be given the meanings set forth in the zoning ordinance: 37 38 ACCESSORY USE: A subordinate and incidental building or use which is located on the same lot on 39 which the main building or use is situated and which is reasonably necessary and incidental to the 40 conduct of the primary or main use of such buildings. In no case shall such "accessory use" dominate 41 in area, extent, or purpose of the principal lawful use or building. 42 ADDRESS SIGN: A sign displaying numbers only, whether written or in numeric form not including the 43 building name. Page 1 44 ADVERTISING SIGN: A structure or portion thereof that is intended for advertising purposes directing 45 attention to a business or profession, or to the commodity, service or entertainment sold or offered upon 46 the premises, on which letters, figures or pictorial matters are intended to be displayed for advertising 47 purposes, other than the name, occupation and /or nature of the enterprise conducted on the premises. 48 This definition will not be held to include a real estate sign advertising for sale or rent the property on 49 which it stands. 50 51 ALTERATION: Any major alteration to a sign excluding routine maintenance, painting or changing of 52 copy of an existing sign. 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 ANIMATED OR FLASHING SIGN: Any sign or part of a sign which changes physical position by any movement or rotation, or which gives the visual impression of such movement by use of lighting, including blinking, chasing, scrolling or other animation effects, or signs which exhibit intermittent or sequential flashing of natural or artificial light or color effects. AREA IDENTIFICATION SIGN: A freestanding monument sign which identifies the name of a neighborhood, a residential subdivision, a multiple residential complex consisting of three (3) or more structures or ten (10) or more units, a commercial development consisting of three (3) or more separate structures, an industrial area consisting of three (3) or more structures or any combination of the above. AWNING: A temporary hood or cover which projects from the wall of a building, and which can be retracted, folded or collapsed against the face of a supporting building. BALLOON: An airtight bag or membrane which is inflated with air or a lighter than air gas typically intended to rise or float above the ground. BANNERS: Temporary attention getting devices which resemble flags or similar types of advertisement constructed of a strip of cloth, paper, or other material supported either between poles or fastened to buildings. 1 `� E Rq�VD OPQJIN BEACON: Any light with one or more beams directed into the atmosphere or directed at one or more points not on the same lot as the light source; also, any light with one or more beams that rotate or move. 77 BENCH SIGN: A sign which is affixed or painted to a bench, such as a bus stop. 78 79 BILLBOARD: See definition of Off Premises Advertising Sign. 80 81 BUILDING FACADE: That portion of any exterior elevation of a building extending from grade to the top 82 of the parapet wall or eaves and the entire width of the building elevation. Page 2 83 BUILDING HEIGHT: The vertical distance from the average elevation of the adjoining ground level, or 84 the established grade adjacent to the building, whichever is lower, to the top of the cornice of a flat roof, 85 to the deck line of a mansard roof, to a point of the roof directly above the highest wall of a shed roof, 86 the uppermost point on a round or other arch type roof, to the highest gable on a pitched or hip roof. 87 88 BUILDING MARKER: Any sign indicating the name of a building and date and incidental information 89 about its construction, which sign is cut into a masonry surface or made of bronze or other permanent 90 material. 91 92 BUSINESS: Any establishment, occupation, employment or enterprise wherein merchandise is 93 manufactured, exhibited or sold or which occupies time, attention, labor, and materials or where 94 services are offered for compensation. 95 SIGN, BUSINESS: A sign which directs attention to a business or profession or to the commodity, 96 service or entertainment sold or offered upon the premises where such sign is located or to which it is 97 attached. 98 99 CANOPY: A rooflike structure projecting over any entrance of a store, building or place of assembly. 100 101 CHANGEABLE COPY SIGN: A sign or portion thereof with characters, letters, or illustrations that can 102 be changed or rearranged without altering the face or the surface of the sign. A "changeable copy sign" 103 shall also include animated and reader board signs. 104 COMMEMORATIVE OR MEMORIAL SIGN: A sign, tablet or plaque commemorating or memorializing 105 a person, event, structure or site. 106 107 COPY AND GRAPHIC: The wording and other display messages such as logos or symbols on a sign. 108 109 COPY AND GRAPHIC AREA: The area in square feet of the smallest four (4) sided figure which 110 encloses the copy and graphic of a sign. 111 112 DIRECTIONAL SIGN: A sign erected on public or private property which is designed to guide vehicular 113 or pedestrian traffic with directional arrows or information on location. 114 115 DIRECTOR OF COMMUNITY DEVELOPMENT: The officer or other person charged with the 116 administration and enforcement of this chapter or his /her duly authorized deputy. 117 118 DISTRICT: A specific zoning district as defined in the city zoning ordinance. 119 120 DWELLING: A building or one or more portions thereof occupied or intended to be occupied exclusively 121 for residence purposes; but not including rooms in motels, hotels, nursing homes, or boarding houses; 122 nor trailers, tents, cabins or trailer coaches. A "dwelling" shall not be interpreted to include lodging 123 rooms. 124 125 DWELLING UNIT: One room or rooms connected together, constituting a separate, independent 126 housekeeping unit for owner occupancy or rental or lease on a weekly, monthly or longer basis and 127 physically separated from any other rooms or dwelling units which may be in the same structure and 128 containing independent cooking and sleeping facilities. 129 130 DYNAMIC DISPLAY: Any characteristics of a sign that appear to have movement or that appear to 131 change, caused by any method other than physically removing and replacing the sign or its 132 components, whether the apparent movement or change is in the display, the sign structure itself, or 133 any other component of the sign. This includes a display that incorporates a technology or method 134 allowing the sign face to change the image without having to physically or mechanically replace the sign Page 3 135 face or its components. This also includes any rotating, revolving, moving, flashing, blinking, or 136 animated display and any display that incorporates rotating panels, LED lights manipulated through 137 digital input, "digital ink" or any other method or technology that allows the sign face to present a series 138 of images or displays. 139 140 FACADE: A false, superficial or artificial appearance of a building side, given special architectural 141 treatment. 142 143 FLAG: Any fabric, banner, or bunting containing distinctive colors, patterns, or symbols, used as a 144 symbol of a governmental, political subdivision, or other entity. 145 146 FLASHING SIGN: An illuminated sign which contains flashing lights or exhibits noticeable changes in 147 color or light intensity. 148 149 FREESTANDING SIGN: Any stationary or portable self - supporting sign not affixed to any other 150 structure. 151 152 GOVERNMENTAL SIGN: A sign which is erected by a governmental unit for the purposes of 153 identification or directing or guiding traffic. 154 155 GRADE: The elevation or level of the ground at the place the sign is to be erected. 156 HOLIDAY DECORATION SIGN: A temporary sign, in the nature of decorations, clearly customary and 157 commonly associated with federal, state, local or religious holidays and contains no commercial 158 message. 159 160 IDENTIFICATION SIGN: Any sign which states the name or address or both of the business or 161 occupant of the lot or building where the sign is placed and may be a directory listing the names, 162 addresses, profession or occupation and business of occupants. 163 r Y 164 ART ILLUSTRATIVE SIGN: 165 166 INFLATEABLE SIGN: A freestanding or moored sign expanded or inflated with air or another gas, like 167 a balloon, and which may rise and float above the ground. 168 169 INFORMATIONAL SIGN: Any sign erected for the safety or convenience of the public including "no 170 parking ", "entrance /exit ", "loading only ", "telephone ", "manager's office ", "danger ", and other signs that 171 do not promote or contain advertising or identification of a business, property or product. 172 173 INSTITUTIONAL SIGN: A sign or bulletin board which identifies the name and other characteristics of a 174 public or private institution on the site where the sign is located. 175 176 LIMITED TENANT BUILDING: A commercial retail establishment or a group of commercial retail 177 establishments with the designed occupancy of three (3) or less tenants. It must have shared parking 178 and a visual appearance as a contiguous structure which may or may not be planned, constructed, or 179 managed as a total entity. This includes single tenant retail structures. 180 Page 4 181 LOGO: A symbol, image, insignia, word, word abbreviation, or initials which is designed for easy 182 recognition, and which represents or identifies in graphic form, a nation or organization of nations, 183 businesses, states or cities, or fraternal, religious and civic organizations or any educational institutions, 184 irrespective of whether they are made of permanent, semi - permanent or temporary materials. 185 186 MENU - BOARD: A wall or free - standing sign which lists the foods or other products available at drive - 187 up facilities. 188 189 MERCHANDISE: A sign made of flexible nonmetallic material attached to and advertising merchandise 190 displayed outside an enclosed building. 191 192 MONUMENT SIGN: A sign not supported by exposed posts or poles which is architecturally designed 193 and located directly at grade where the base width dimension is larger than fifty percent (50 %) of the 194 greatest width of the sign. 195 196 MOTION SIGN: Any sign which revolves, rotates, has any moving parts or gives the illusion of motion. 197 198 NAMEPLATE: See definition of Identification Sign. 199 200 NONCOMMERCIAL SIGN: A sign that does not advertise products, goods, business, or services and 201 that expresses an opinion or other point of view, or promotes the candidacy of a person running for 202 governmental office. 203 204 NONCONFORMING SIGN: 205 206 Illegal: A. A sign which was constructed after the passage of the ordinance codified in this 207 chapter or amendments thereto and does not conform to this chapter. 208 209 B. Any off premises advertising sign which exists five (5) years after the official date of 210 approval and adoption of the ordinance codified in this chapter. 211 212 Legal: A sign which lawfully existed at the time of the passage of the ordinance codified in this 213 chapter or amendments thereto but which does not conform to this chapter. 214 215 OBSOLETE SIGN: Any sign which no longer advertises a bona fide business conducted or products 216 sold. 217 218 OFF PREMISES ADVERTISING SIGN: A freestanding sign which directs attention to a business, 219 commodity, service or entertainment not exclusively related to the premises where such a sign is 220 located or to which it is affixed. 221 222 PARAPET: A low wall which is located on a roof of a building. 223 224 PENNANT: See definition of Banners. Type of temporary sign consisting of fabric, plastic, or metal 225 strand drapery with distinct colors, patterns, symbolic logos, or a series of narrow tapering flags for 226 display. 227 228 PERMANENT SIGN: Any sign which is not a temporary sign. 229 230 PORTABLE SIGN: A sign so designated as to be movable from one location to another and which is 231 not permanently attached to the ground or any structure. 232 233 PROJECTING SIGN: A sign other than a wall sign which is affixed to a building and which extends Page 5 234 perpendicular from the building wall. 235 236 PYLON SIGN: A sign supported by a post or posts so that the sign and supports are finished to grade 237 by encasing the posts in a material consistent with the sign and where the base width dimension is a 238 minimum of twenty percent (20 %) up to and including fifty percent (50 %) of the greatest width of the 239 sign. 240 241 REAL ESTATE DEVELOPMENT SIGN: A business sign placed on the premises of a subdivision or 242 other real estate development. 243 244 REAL ESTATE SIGN: A business sign placed upon a property advertising that particular property for 245 sale, rent or lease. 246 247 ROOF SIGN: Any sign erected and constructed wholly on and over the roof of a building, supported by 248 the roof structure, and extending vertically above the highest portion of the roof. 249 250 ROOF SIGN, INTEGRAL: Any sign erected or constructed as an integral or essentially integral part of a 251 normal roof structure of any design, such that no part of the sign extends vertically above the highest 252 portion of the roof and such that no part of the sign is separated from the rest of the roof by a space of 253 more than six inches (6 "). 254 255 ROOFLINE: The uppermost line of the roof of a building or in the case of an extended facade, the 256 uppermost height of such facade. 257 258 ROTATING SIGN: A sign which revolves or rotates on its axis by mechanical means. 259 260 SHOPPING CENTER: An integrated grouping of commercial stores, under single ownership or control. 261 262 SIGN: Any letter, word, symbol, device, poster, picture, statuary, reading matter or representation in the 263 nature of an advertisement, announcement, message or visual communication, whether painted, 264 posted, printed, affixed or constructed, which is displayed outdoors for informational, corporate 265 identification or communicative purposes and is visible to the general public. 266 267 SIGN AREA: That area within the marginal lines of the surface which bears the advertisement, or in the 268 case of message, figures, or symbols, including those attached directly to any part of a building, which 269 is included in the smallest rectangle which can be made to circumscribe the message, figure or symbol 270 displayed thereon. Double faced signs may be permitted with the maximum square footage on each 271 side; multi -faced signs shall not exceed two (2) times the area of a single faced sign. 272 273 MONUMENT, PYLON OR WALL SIGN, GROSS SURFACE AREA: The entire area within a single 274 continuous perimeter enclosing the extreme limits of a sign and in no case passing through or between 275 any adjacent elements of such sign; however, such perimeter shall not include any structural elements 276 lying outside the limits of such sign and not forming an integral part of the display. In computing square 277 foot area, only one side of a double face or V -type structure shall be considered. 278 Page 6 WIDTH F IF 1 G_HT 279 280 SIGN STRUCTURE: The supports, uprights, bracing and framework for a sign, including the sign area. 281 282 STREET FRONTAGE: The proximity of a parcel of land to one or more streets. An interior lot has one 283 street frontage, and a corner lot has two (2) frontages. 284 285 SWINGING SIGN: A sign that moves back and forth freely, or sways in the wind. 286 287 TEMPORARY EVENT SIGN: A temporary sign advertising a community event sponsored by a 288 governmental entity or not - for - profit entity that is limited only to one type of temporary sign that may 289 include either a banner, balloon, flying banner, pennant, or valance. 290 291 TEMPORARY SIGN: Any sign which is intended to be erected or displayed for a limited period of time, 292 including signs affixed or attached to vehicles, including trailers, and capable of being readily removed; 293 flyers, banners, a -frame signs, inflatable signs, or flying signs. 294 295 WALL SIGN: A sign which is affixed to the exterior wall of a building and which is parallel to the building 296 wall and which does not project more than twelve inches (12 ") from the surface to which it is attached, 297 nor extend beyond the top of the parapet wall. 298 299 WINDOW SIGN: A sign affixed to or inside of a window in view of the general public. This does not 300 include merchandise on display. (Ord. 833, 11 -21 -2007) 301 302 9 -8 -3: PERMIT REQUIREMENTS: 303 A. Compliance And Permit Required For Any Sign: Except as otherwise provided in subsection B of 304 this section, no sign or structure shall be erected, constructed, altered, rebuilt or relocated, except 305 as provided in this chapter, and until a permit for the same has been approved by the community 306 development director and issued by the building inspection division, upon application therefor 307 submitted, in such form as the building inspection division may prescribe so as to include such 308 information as may be required for a complete understanding of the proposed work. 309 B. Exemptions From Permit: Permit Not Required 310 1. Window sign (placed within a building and within view of the general public) not exceeding thirty 311 percent (30 %) of display surface. 312 a. Window sign consisting solely of individual alphabetic letters, numerals, or other symbolic 313 characters without any background may be displayed but the net area shall not cover more than 314 30 percent of the total window area. 315 Page 7 316 b. A window sign that includes opaque objects, logos, and other images with any type of 317 background may be displayed, but the net area of the window sign shall not exceed 30 percent 318 of the window area. Opaque objects without any lettering, numerals, other symbolic characters, 319 logos or any other images are not limited to window coverage area. 320 321 c. The "total window area" shall be one continuous panel of glass or other transparent material 322 or a set of two or more panels divided by mullions of six inches in width or narrower. Panels 323 surrounded on all sides by solid walls or mullions wider than six inches shall be considered 324 individual windows and signage measured separately per window. 325 326 327 328 329 330 331 332 333 334 335 336 337 338 339 340 341 342 343 344 345 346 347 348 349 350 351 352 353 354 355 356 357 358 359 Total Window Area ■ ■I d. The net area, for purposes of subsections 1 and 2 of this Section shall be determined by measuring a box around each group of characters, objects, images, logos and any background. e. For purposes of this section, any banner attached to the outside of a window shall not be considered a window sign and shall require a permit. f. Hours of operation shall not be included in window sign area calculation if less than 6 square feet. g. Window signs may be illuminated, but flashing are prohibited. 2. A sign not exceeding three (3) square feet of display surface on a residential building stating merely the name, address and profession of an occupant. 3. Signs advertising either the sale, lease or rental of lots, individual lots or buildings subject to the following: a. Such signs shall not exceed nine (9) square feet for residential property and thirty two (32) square feet for nonresidential property. b. Only one such sign is permitted per street frontage upon which the property abuts. c. Such signs shall be removed within seven (7) days following the lease or real estate closing. d. Shall not exceed six feet in height. e. All freestanding for sale, lease or rent signs shall be removed at such time the building is 80% occupied. f. For sale, rent or lease banner signs no larger than 32 square feet in size shall be permitted at non - residential property attached to the principle structure. Page 8 360 4. Election, street, warning, traffic and other official signs erected by a government or by others 361 where required or recommended pursuant to legal authority. 362 363 5. Construction signs denoting the architect, engineer, or contractor placed on premises where 364 construction, repair, or renovation is in the process. 365 366 6. The changing of the copy or message of a painted, plastic face or printed sign; provided, that 367 there is no change in the size, shape or lighting of the sign. 368 369 7. Directional Signs: permitted on -sight of the property to which the directional information 370 pertains. 371 a. No more than three (3) directional signs are permitted per building or location. 372 373 b. Sign(s) shall not exceed three (3) square feet in size. 374 375 c. Signs containing advertising shall be included in total sign area calculation permitted. 376 377 8. Informational Signs are permitted: 378 a. In all zoning districts. 379 380 b. One (1) sign allotted per entrance and one (1) per exit. 381 382 c. Signs containing advertising or logos shall be included in sign area calculation. 383 384 d. May be no larger than three (3) square feet in size. 385 386 9. GarageNard Sale Signs subject to the following: 387 388 a. The sign(s) shall only be displayed during the term of the sale and must be removed 389 when the sale is completed. 390 391 b. Sign(s) may not be tacked or otherwise attached to trees, utility poles, or other such 392 structures. 393 394 10. Noncommercial signs. 395 396 11. Traffic, address, home security systems, scoreboard sponsor, public information, political 397 campaign, noncommercial signs, business vehicle identification, commemorative, construction, 398 flags and insignias of governmental agencies, holiday decorations, nameplates and works of 399 fine art. 400 401 12. Temporary real- estate open house signs provided: 402 403 a. Posted only between the hours of eleven o'clock (11:00) AM and six o'clock (6:00) PM 404 on Saturday and Sunday and between the hours of ten o'clock (10:00) AM and two 405 o'clock (2:00) PM on Tuesdays. 406 407 b. Placed more than ten (10) feet from the back of the street curb or more than two (2) 408 feet from the edge of a sidewalk or trail, whichever is farthest from the street curb. 409 410 13. Builder and Development Sign(s) provided: Page 9 411 a. One temporary development sign announcing the development and availability of lots 412 and /or buildings, or identifying architects, engineers, contractors, builders, or suppliers 413 or other individuals or firms involved in construction, alteration or repair of a building 414 (but not including any advertisement of any product) or announcing the character of 415 the building enterprise or the purpose for which the building is intended. 416 417 b. Not to exceed thirty two (32) square feet and not exceeding more than twelve (12) feet 418 in height. 419 420 c. Sign(s) are permitted to be located on the property under development. 421 422 d. Sign(s) shall be set back at least twenty (20) feet from all property lines. 423 424 e. Sign(s) shall be allowed until eight five (85) percent of the construction in the 425 development is completed. 426 427 f. If an area identification sign exists on the site, then the temporary development sign(s) 428 must be a minimum of two hundred (200) feet away. 429 430 14. Temporary Builder Directional Signs Provided: 431 a. No more than three (3) temporary directional signs for each model home they may 432 have within a subdivision. 433 434 b. No more than eighteen (18) inches by twenty four (24) inches (18" X 24 "). 435 436 c. Must be located within the developing subdivision. 437 438 d. May not be closer than six (6) feet to the curb nor closer than two (2) feet of any 439 sidewalk and /or trail. 440 441 e. Sign(s) are permitted every day of the week within the developing subdivision. 442 443 f. All subdivisions must install landscaped entrance features at main entrances to 444 subdivisions which must be a monument design, may not exceed thirty (30) square 445 feet in size and require a permit. 446 447 15. Athletic Field Signage. Signs, banners and scoreboards designed solely for view from 448 spectator areas and displayed on interior walls, fences or other structures located inside an 449 enclosed athletic field at a school, park, other public or private athletic complex; except that 450 approval of the Park, Recreation and Natural Resource Commission shall be required to 451 display a sign, banner or scoreboard under this paragraph at a city park. 452 453 16. Scoreboards that qualify under this paragraph may include flashing elements, if adequate 454 screening is provided to screen the view from abutting streets. 455 456 17. Memorial signs or tablets such as cornerstones denoting only the names of buildings and date 457 of erection, cut or set into a masonry surface and displayed on a wall only. Maximum net area 458 for memorial signs is 12 sq. ft. 459 460 18. Holiday lights and decorations. 461 Page 10 462 19. The illumination of building facades with neon or light emitting diode (LED) architectural 463 lighting shall be permitted when properly maintained. (Ord. 858, 5 -6 -2009) 464 465 20. Mailboxes posted with address numbers and /or name of the business or occupant of the lot or 466 building where the sign is placed. 467 C. The exemptions permitted by this subsection shall apply only to the requirement of a permit and 468 shall not be construed as relieving the owner of the sign from responsibility for its erection and 469 maintenance. 470 D. Application For Permit: The following information shall be submitted within or along with the permit 471 application for a sign: 472 1. Name, address and telephone number of person making application. 473 2. Name, address and telephone number of person owning sign. 474 3. A site plan drawn to scale showing the location of lot lines, buildings, structures, parking areas, 475 existing and proposed signs and any other physical features. 476 4. Plans, location, specifications, number of signs and their dimensions and method of 477 construction and attachment to the building or placement method in the ground. 478 5. Copy of stress sheets and calculations showing that the structure is designed for dead load and 479 wind pressure in any direction in the amount required by this chapter and all other laws and 480 ordinances of the city. 481 6. Written consent of the owner or lessee of any site on which the sign is to be erected. 482 7. Such other information as the building official or director of community development shall 483 require showing full compliance with this chapter and all other laws and ordinances of the city. 484 The building official may waive subsections C4 and C5 of this section. (Ord. 747, 10 -15 -2003) 485 E. Sign Contractors: 486 1. License Required; Application; Fee: No person shall install, erect or maintain any signs within 487 the city without having first obtained a license from the city. An applicant shall complete and file the 488 application form required by the director of community development and pay the fee set by the city 489 council. 490 2. Exemption From License: Licenses are not required for exempt signs as identified in subsection 491 9 -8 -3 13 of this chapter. 492 3. Insurance Requirements: No license granted under the terms stated herein shall become 493 effective until the licensee shall have filed with the city clerk a copy or a certificate of insurance for a 494 minimum of seven hundred fifty thousand dollars ($750,000.00) combined single limit liability 495 coverage for injury to or death of any one person or persons, or damage /destruction of property in 496 any one accident. (Ord. 747, 10 -15 -2003) 497 9 -8 -4: PROVISIONS APPLICABLE TO ALL ZONING DISTRICTS: Page 11 498 A. General Standards: The following standards shall apply to all signs in all districts as permitted by 499 this chapter unless specifically set forth otherwise by this section. Determination as to the 500 applicability of the standards to any given sign shall rest with the Director of Community 501 Development, subject to the administrative appeal procedures set forth in this chapter. 502 1. Compliance With Building Code: All signs shall be in accordance with applicable provisions of 503 the building code. 504 2. Traffic Interference: No sign may be erected that by reason of position, shape, movement, color 505 or in any other manner interferes with the proper functioning of a traffic sign or signal or 506 otherwise constitutes a traffic hazard. (Ord. 747, 10 -15 -2003) 507 3. Approval of Property Owner: No sign shall be placed on any property without the approval of 508 the property owner. 509 4. Prohibited Locations: 510 a. Public Ways: Signs shall not be permitted within the public right -of -way or easements 511 except for public traffic control signs, signs erected by or on behalf of a governmental body 512 to post legal notices, identify public property, convey public information, and direct or 513 regulate pedestrian or vehicular traffic. 514 b. Trees And Utility Poles: No temporary or permanent sign shall be tacked or otherwise 515 attached to trees, utility poles, or other such structures or supports. 516 c. Benches and Bus Shelter Signs. Advertising on bus shelters and bus benches is prohibited. 517 (Ord. 747, 10 -15 -2003) 518 d. Clear View Triangle: On corner lots, no structure or planting in excess of thirty inches (30 ") 519 above the curb line or less than ten feet (10') above the curb line shall be permitted within a 520 clear view triangle described as that area that begins at the intersection of the front property 521 line and corner side property line and is measured back ten feet (10') along both property 522 lines. Height Above Public Ways: Except for necessary poles, uprights, pedestals and other support 525 structural elements, no portion of any sign shall be less than eight feet (8') above grade level, 526 except for signs that are designed such that they present no hazard to pedestrians or vehicles. 527 5. Determination Of Sign Area: 528 a. Only one side of a double face sign or V- shaped sign shall be used to compute the sign 529 area of a sign. The angle of the V- shaped sign shall be sixty degrees (60 or less. 530 b. To compute the area for a cabinet or panel sign face, compute by means of the smallest 531 square, rectangle, circle, triangle, or combination thereof that will encompass the entire area 532 within a single continuous perimeter enclosing the extreme limits of a sign and in no case 533 passing through or between any adjacent elements of such sign, together with any material 534 or color forming an integral part of the background or the display or used to differentiate the 535 sign from the backdrop or structure against which it is attached or affixed, but not including 536 any support framework, bracing, or decorative fence or wall when such fence or wall 537 otherwise meets the pertinent zoning regulations and is clearly incidental to the display 538 itself. Computing the sign area of individual mounted letters, numerals, logos, symbols and 541 images, the sign surface area shall be determined by means of a single continuous 542 perimeter enclosing the extreme limits of a sign and in no case passing through or between 543 any adjacent elements of such sign, but not including any support framework, bracing, or 544 decorative fence or wall when such fence or wall otherwise meets the pertinent zoning 545 regulations and is clearly incidental to the display itself. 546 MIKE'S A IL Ct MIKE'S Sign Area 547 d . Computing the sign surface area of awning or canopy sign will be the smallest square, 548 rectangle, circle, triangle or combination thereof that will encompass the extreme limits of 549 the copy, representation, logo, emblem or other display, together with any material or color Page 13 550 forming an integral part of the background or the display or used to differentiate the sign 551 from the backdrop. t' T rr a� 552 553 6. Color Of Signs: All signs which have their backs visible to public view shall have such backs 554 painted in a neutral color compatible with the background against which they are set. 555 7. Contents Of Signs: No sign shall contain any obscene matter. 556 8. Dangerous Signs: No sign shall be permitted that is a hazard to the public health, safety, 557 convenience or general welfare. 558 10. Signs Painted On Structures: Signs shall not be painted directly on the outside wall of a 559 building. Signs shall not be painted on a fence, tree, stone or other similar objects in any district. 560 11. Signs Affixed Flat Against Building Walls. No sign affixed flat against a building wall shall 561 extend beyond any edge of such wall. 562 C. Illuminated Signs. Illuminated signs shall comply with the following requirements: 563 1. Any sign illuminated and located within fifty feet (50') of a residential district lot line shall be 564 diffused or indirect so as not to reflect direct rays of light into adjacent residences. All 565 illuminated signs in business and industrial districts in close proximity to residential districts 566 shall be designed, to the extent practical, so as to illuminate the sign and not residential 567 property. 568 2. Illuminated signs lighted by any means, whether as an integral part of the sign or a light away 569 from the sign, such as floodlights, shall be governed as follows: 570 a. Any combination of signs or light sources which cast a light on a public street shall not 571 exceed one foot - candle (foot - candle meter reading) as measured from the property line. 572 b. Any combination of signs or lights which cast light on property zoned for residential use 573 shall not exceed five - tenths (0.5) of a foot (foot - candle meter reading) as measured from 574 any property line of such residential property. 575 c. In no instance shall exposed light bulbs be utilized to light signs, property or merchandise 576 for sale or rent. The lights shall be hooded or controlled in some manner so as to direct light 577 away from public streets or adjacent or nearby property. Page 14 578 d. The illumination source shall not be placed so to cause confusion or hazard to traffic or to 579 conflict with traffic control signs or lights. 580 e. The illumination electrical power supply, wiring and conduits must not be visible on the 581 exterior of the sign. 582 4. The illumination of building facades with neon or light emitting diode (LED) architectural lighting 583 shall be permitted when properly maintained. (Ord. 858, 5 -6 -2009) 584 5. The display luminosity of dynamic signs shall be limited to five thousand (5,000) NITs 585 (illuminative brightness measurement) during daylight hours, and seven hundred fifty (750) NITs 586 between a half hour before sunset to a half hour after sunrise as measured utilizing industry 587 accepted standards. (Ord. 875, 4 -7 -2010) 588 E. Monument or Pylon Signs: 589 1. Number. Only one monument or pylon business sign shall be allowed per each separate 590 freestanding principal building. 591 2. Location. 592 a. Monument or pylon signs shall be no closer than seventy five feet (75') to another 593 monument or pylon sign. 594 595 b. Must be set back a minimum of ten (10) feet from property lines — measured from the 596 furthest edge of the sign face or base whichever is wider. 597 598 c. No monument or pylon sign shall be erected within the clear view triangle. 599 600 d. No sign shall extend above the roofline of any structure. 601 602 3. Height. No monument or pylon sign may exceed twenty five (25) feet in height, except for the 603 height limitations as permitted in subsection 9- 8- 13B(2)(c ) of this chapter. (Ord. 747, 10 -15- 604 2003) 605 606 4. Design. 607 a. Monument signs shall be attached to a base which is at least 75 percent of the width of 608 the sign but shall not exceed the width of the sign by more than 20 percent. 609 610 b. The base of a freestanding sign shall be constructed of class I materials that match 611 those used on the building for which the sign is installed. If no class I materials are 612 used on the building, class 11 materials shall be used. 613 F. Prohibited Signs: The following signs are specifically prohibited in any district: 614 1. Motion Signs: with the exception of barber poles. 615 2. Roof Signs 616 3. Signs Tacked On Permanent Supports: Signs and /or posters which are tacked on trees, 617 fences, utility poles or other such permanent supports. Page 15 618 4. Signs Painted On Walls 619 5. Flashing Signs: including time and temperature signs. 620 6. Off Premises Advertising Signs: except for exempt signs as listed in section 7 -8 -8 of this 621 chapter. 622 7. Obsolete Signs or abandoned signs: Any sign which no longer advertises a bona fide 623 business or product sold shall be taken down and removed by the owner, agent or person 624 having the beneficial use of the building or structure upon which the sign may be found within 625 ten (10) days after written notification from the building official. Upon failure to comply with 626 such notice within the time specified in such order, the building official is hereby authorized to 627 cause removal of such sign, and any expense incident thereto shall be paid by the owner of 628 the building or structure to which such sign is attached. (Ord. 747, 10 -15 -2003) 629 8. Illegal Nonconforming Signs 630 9. Inflatable Signs or tethered balloons, except as allowed in subsection 9 -8 -6D of this chapter. 631 10. Signs Which Include Dynamic Display: Except as allowed in subsection J of this section. (Ord. 632 858, 5 -6 -2009) 633 11. Signs, other than governmental or traffic signs which are attached to utility poles, street lights, 634 trees. 635 12. Search lights or beacons. 636 13. Billboard signs. 637 14. Signs on Bridges and Overpasses. No person shall display, place, erect, post, maintain, 638 install, affix or carry any sign, including a hand - carried sign, on any portion of a vehicular or 639 pedestrian bridge or overpass that passes over a freeway or a controlled access highway 640 when such highway has a speed limit of more than 40 miles per hour. V 641 15. Illustrative Signs: 642 G. Noncommercial Signs: 643 1. MUSA: Noncommercial signs may be placed in any district inside the MUSA, providing such 644 signs do not exceed eight (8) square feet per sign in a residential area and sixteen (16) 645 square feet per sign in any other district. Noncommercial signs may be placed in any district 646 outside of the MUSA, providing such signs do not exceed sixteen (16) square feet per sign in 647 a residential area and thirty two (32) square feet per sign in any other district. 648 2. Residential And Agricultural Areas: In residential and agricultural areas, a maximum of two (2) 649 noncommercial signs are allowed on any one lot, except as provided in subsection G4 of this 650 section. Page 16 651 3. Noncommercial Signs Exempt provided they are located more than ten (10) feet from the 652 back of the street curb or more than two (2) feet from the edge of a sidewalk or trail, 653 whichever is farthest from the street curb and /or mounted on the face of a fence if the fence is 654 less than ten (10) feet from the back edge of the street curb or less than two (2) feet from the 655 edge of a sidewalk or trail. 656 a. In a state general election year, all noncommercial signs of any size may be posted in any 657 number within or outside the public right of way from forty six (46) days before the state 658 primary in a state general election year until ten (10) days following the state general 659 election. 660 661 b. If there is a primary for any office in a year that is not a state general election year, 662 noncommercial signs may be posted with or within the public right of way twenty one (21) 663 days before the primary election. When there is no primary, noncommercial signs may be 664 posted twenty one (21) days before the general election. 665 666 c. All noncommercial signs must be removed within ten (10) days following the general 667 election. (Ord. 888, 4 -20 -2011) 668 H. Wall Signs: 669 1. Signs on awnings, marquees and canopies shall be considered wall signs under the terms of 670 this section and subject to the regulations for said signs. 671 a. Awnings, canopies or marquees shall be considered as part of the wall area calculation. 672 b. An awning may be designated as a sign area as an alternative or addition to a sign on the 673 building facade, provided the awning does not exceed the total sign area allowed. 674 c. A sign may be displayed on the side panels of the awning. 675 d. The sign displayed on the awning shall not be more than 40 percent of the awnings principal 676 face. 677 e. Awnings, canopies or marquees constructed of transparent or translucent material shall be 678 deemed to be a sign panel for purposes of determining sign area. 679 2. Wall signs shall not extend above the roofline of any principal building. 680 I. Dynamic Display Signs: Dynamic display signs shall be governed as follows: 681 1. Permitted locations: 682 a. On wall or monument signs. 683 b. On properties located in any commercial or industrial zoning district. 684 c. On properties with a conditional use permit for religious or institutional use. 685 d. On government buildings or sites located in any zoning district. Page 17 686 e. On pylon or monument signs for retail uses required by Minnesota statutes to display 687 prices. 688 f. On temporary signs used for traffic control during construction or maintenance projects on 689 state, county, or local roads. 690 2. Prohibited locations: 691 a. On pylon signs except for retail uses required by Minnesota statutes to display prices. 692 b. As window signs greater than three (3) square feet. 693 c. As portable signs. 694 d. On rooftops. 695 3. Setback locations: Ten feet (10') from edge of sign to any property line. 696 4. Display size: 697 a. Twenty four (24) square feet maximum per property. 698 b. Included in total wall and monument signage square footage calculations. 699 5. Display height: Fifteen feet (15') maximum from grade to top of sign. (Ord. 858, 5 -6 -2009) 700 6. (Rep. by Ord. 875, 4 -7 -2010) 701 7. Display image: Pictures, graphics, logos, symbols, images and messages displayed on the on 702 site dynamic sign must be static. Time and temperature display is prohibited. (Ord. 875, 4 -7- 703 2010) 704 8. Display transition; scrolling, appearance of motion, flashing, animation, motion video: 705 Prohibited. 706 9. Display frequency: 707 a. One (1) hours minimum between changes in display utilizing fade transition. Emergency 708 notifications or alerts posted on government or institutional signs are exempt from this 709 section. (Ord. 858, 5 -6 -2009) 710 9 -8 -5: AREAS OF SPECIAL CONTROL: 711 A. Places of Worship, Parks, Hospitals, Schools, Etc.: 712 1. Places of worship, parks, community centers, hospitals, schools, libraries, city and other 713 governmental buildings are allowed one monument or pylon sign upon their property. Such 714 sign(s) shall not exceed a total of fifty (50) square feet and shall not exceed a height of ten 715 feet (10'). Page 18 716 B. Planned Unit Developments: Planned unit developments (PUD) shall submit a comprehensive 717 sign plan at such time when the total PUD is reviewed by the planning commission. Due to the 718 multiple land uses in a planned unit development, all signs shall be compatible in character, 719 materials and color with each other and the surrounding land uses. All signs in the PUD shall be 720 restricted as in a B -2 retail business district; however, upon the discretion of the planning 721 commission or city council, such signs may be more restrictive than the B -2 retail business 722 district. 723 C. Shopping Centers: Shopping centers shall submit a comprehensive sign plan at the time when 724 the building plans are reviewed by the planning commission. Such signs shall be regulated as in a 725 B -3 general business district. 726 D. Mississippi River Critical Area: Within the designated Mississippi River critical area, no sign is 727 permitted that is visible from the river, except those necessary for safe navigation along the river. 728 E. Movie Theaters: Movie theaters are allowed one freestanding sign not to exceed two hundred 729 (200) square feet and not to exceed twenty five feet (25') in height. 730 F. Multiple Residential Buildings: 731 1. Multiple residential buildings are allowed one address sign of no more than three (3) square 732 feet per principal entrance. 733 2. A multiple residential complex consisting of three (3) or more structures or ten (10) or more 734 units shall be allowed an area identification sign not to exceed sixty four (64) square feet. 735 G. Statues, Sculptures, and Architectural Features: Symbols, statues, sculptures and integrated 736 architectural features of a design which deviates from the architectural character of the 737 surrounding structures shall require a conditional use permit. (Ord. 747, 10 -15 -2003) 738 I. Signs Not Regulated: Signs located on the interior of a building and are not visible from outside 739 of said building, national flags, flags of political subdivisions and holiday decorations are exempt 740 from the provisions of this article and shall not require permits or payment of fees. Such signs 741 must not create a public safety hazard, must not be within any public right -of -way and not 742 encroach the clear view triangle requirements as specified in 11- 8- 5A(3)(c) for this section. 743 J. Projecting Signs: 744 Projecting signs shall be permitted only in the Planned Unit Development District, subject to the 745 following restrictions: 746 1. The maximum sign area shall be 20 square feet per facing. 747 2. Not less than eight feet of clearance shall be provided between the sidewalk elevation and the 748 lowest point of the projecting sign. 749 3. Signs shall project from the face of the building no more than the lesser of 750 (a) One -third of the sidewalk width; or 751 (b) Four feet. Page 19 752 Sidewalk width shall be measured perpendicular to the face of the building at the proposed 753 sign location. 754 4. The maximum sign area of wall signs located on the same building of the projecting sign shall 755 not exceed five percent of the wall area. 756 5. Proof of insurance and indemnification shall be provided in accordance with Section Title 9, 757 Chapter 8, Section 4(C ). 758 K. Hand - Carried Portable Signs: 759 Displayed on Public Property. Hand - carried portable signs may be displayed on public property 760 without a sign permit only as follows: 761 1. Used in a parade for which a permit is not required. 762 2. Displayed during and within the confines of an event for which a valid special use permit has 763 been issued, or displayed on private on private property directly adjacent to the area for which 764 the street use permit has been issued and only while the street use permit is valid. 765 3. Used at a city park during and within the confines of an event for which a valid permit has 766 been issued by the Parks and Recreation Department and only while the permit is valid. 767 4. Hand - carried portable signs on private property with the owner's permission or hand - carried 768 signs on the public sidewalk or other pedestrian way if the person carrying the sign or the sign 769 itself is not in violation of other ordinances or laws applicable to the location and conduct, 770 including but not limited to obstructing traffic, obstructing the sidewalk, trespassing, or 771 conducting or participating in an event for which a special event permit, street permit or park 772 event permit would be required by city ordinance. 773 5. Hand - carried sign is prohibited on any pedestrian bridge or overpass that passes over a 774 freeway or a controlled access highway when such highway has a speed limit of more than 40 775 miles per hour. 776 9 -8 -6: TEMPORARY SIGNS: 777 A. Temporary Banner Signs: One temporary advertisement sign in the form of durable, weather 778 resistant materials are allowed according to the requirements set forth below: 779 1. Location: Such banner may only be attached to principal structures on a lot. No banner will 780 be allowed in or on accessory structures, landscaped areas, motor fuel station canopies, or 781 similar locations. 782 2. Size: The banner must not exceed thirty two (32) square feet in size. 783 3. Time Limit For Display: 784 (a) The banner may only be displayed for a cumulative total of fifteen (15) days or less per 785 permit, per business. Page 20 786 787 788 789 790 B. 791 792 793 794 795 796 797 798 799 OR (b) Four (4) permits shall be permitted per building per calendar year. (c) In the case of multi- tenant commercial buildings, four (4) permits shall be available to the building per calendar year. 4. A permit is required for all temporary banners. Not for Profit Event Signs: giving notice of events and activities sponsored by charitable, patriotic, or places of worship organizations within Cottage Grove for noncommercial purposes shall be permitted in conformance with the following: 1. Are permitted in the form of a temporary banner or temporary freestanding sign. 2. May be posted off premise in the public right of way no less than ten (10) feet from the curb and no less than two (2) feet form a sidewalk or trail. 3. Shall not be posted for longer than thirty (30) days prior to the date on which the event or activity advertised is to occur or be conducted and shall be removed within five (5) days after the termination thereof. 800 B. Not for Profit Event Signs: Prohibited 18 X61 7 802 B. Quasi - Public Signs: A "quasi- public sign" is a sign giving notice of events and activities sponsored 803 by civic, patriotic, religious or charitable organizations located within Cottage Grove for noncommercial 804 purposes, and may include all banners, pennants, and flags incidental thereto. A quasi - public sign may 805 not be erected or maintained more than thirty (30) days prior to the date on which the event or activity 806 advertised is to occur or be conducted and shall be removed within five (5) days after the termination 807 thereof. 808 C. Special Events Signs: Special event signs (e.g., parade of homes, spring preview of homes, 809 community events, etc.) are permitted no longer than a thirty (30) day period and /or shall only be 810 permitted through the duration of the special event with the appropriate sign permit secured. 811 D. Grand Openings. No more than two temporary banners may be displayed for the grand opening or 812 grand re- opening of a business. Temporary signs, inflatables, pennants, and banners displayed in 813 connection with a grand opening of a business shall comply with the following: 814 1. Each temporary banner and one portable reader board sign shall not exceed 32 square 815 feet in area. Banner signs must be affixed to the principle building. 816 2. All temporary banners, portable reader board, balloons, inflatable devices and the like 817 are allowed for a period not to exceed ten days. 818 3. Inflatable devices are prohibited on top of roofs. 819 4. A permit is required for all temporary grand opening signs. Page 21 820 5. One grand opening or re- opening shall be permitted per calendar year per business. 821 E. Merchandise Signs permitted in accordance with the following: 822 1. One sign will be permitted per business. 823 2. Signs will be no larger than six (6) square feet. 824 3. Signs will be located no further than 20 from the main entrance to the building. 825 4. Signs are not permitted on the public right of way or easements. 826 5. Permit not required. 827 F. Temporary Portable Signs exempt when provided for an event sponsored by a local, state or federal 828 event on government property, parks. 829 830 9 -8 -7: OFF PREMISE ADVERTISING SIGNS: 831 A. Prohibited Generally; Exceptions: All off premise advertising signs are prohibited, except for 832 special event signs posted with a sign permit, real estate and builder signs in compliance with 833 section 9 -8 -3, garage sale signs and noncommercial signs posted during a state general 834 election year or a primary for any office. 835 B. Survey For Existing Signs; Notice: The director of community development shall, as soon as 836 practicable, survey the city for off premises advertising signs and shall use reasonable efforts 837 to so notify, either personally or in writing, the user or owner of the property on which the sign 838 is located of the nonconformity of the sign. Failing determination of the sign owner, user or 839 owner of the property on which the sign is located, the notice may be affixed in a conspicuous 840 place to the sign or to the business premises with which the sign is associated. (Ord. 747, 10- 841 15 -2003) 842 843 9 -8 -8: LEGAL NONCONFORMING SIGNS: 844 A. Continuance Of Use: Any legal nonconforming sign, including its structure, may be continued 845 at the same size and in the same manner of operation except as hereinafter specified. 846 B. Dangerous Conditions: A legal nonconforming sign must be removed if the sign and /or 847 structure is declared unsafe by the building inspection division. 848 C. Discontinuance Of Use: When a legal nonconforming sign has discontinued its usage for a 849 period of six (6) months or has changed to conform with this chapter, any further use of the 850 sign must comply with all provisions of this chapter. 851 D. Damaged Signs: Whenever a legal nonconforming sign shall have been damaged by fire, 852 flood, explosion, earthquake, war or an act of God and the damage of the sign and /or 853 structure is fifty percent (50 %) or more of its fair market value as estimated by the building 854 inspection division, the reconstruction shall comply with all provisions of this chapter. Page 22 855 E. Alteration Of Signs: A legal nonconforming sign may not be altered so as to become a more 856 restrictive legal nonconforming sign. 857 F. Maintenance And Repair: Normal maintenance of a legal nonconforming sign is permitted, 858 including necessary structural repairs and incidental alterations which do not extend or 859 intensify the nonconforming status. (Ord. 747, 10 -15 -2003) 860 9 -8 -9: MAINTENANCE AND REPAIR REQUIREMENTS: 861 A. All signs, together with all their supports, braces, guys and anchors shall be kept in repair and 862 in proper state of preservation. 863 B. The display surfaces of all signs shall be kept neatly painted or posted at all times. 864 C. All signs which are unsafe and /or unsightly shall be repaired or removed. Unsightly signs 865 must be repaired or removed within fifteen (15) days of notification. The term "unsightly" shall 866 mean a condition in which the sign has deteriorated to the point where at least one -fourth ( 867 of the surface area of the name, identification, description, display, illustration or other symbol 868 is no longer clearly recognizable at a distance of twenty feet (20'); or where paint is peeling, 869 chipping, or flaking from the structure surface, or where the sign has developed significant 870 rust, corrosion, rotting, or other deterioration in the physical appearance. 871 D. Every sign and the immediate surrounding premises shall be maintained by the owner or 872 person in charge thereof in a clean, sanitary and inoffensive condition and free and clear of all 873 obnoxious substances, rubbish and weeds. Notice shall be given to the director of community 874 development of any change in sign user, sign owner or owner of the property on which the 875 sign is located. (Ord. 747, 10 -15 -2003) 876 9 -8 -10: SIGNS IN RESIDENTIAL AND AGRICULTURAL DISTRICTS: 877 878 Signs shall be permitted in residential and agricultural districts in accordance with the following 879 minimum standards: 880 A. Sign Type 881 1. Identification Signs: 882 a. Purpose: Identification signs are intended for the display of the name and /or address of 883 the primary use on the property where the sign is located. 884 b. Number And Size: 885 (1) For one - family, two - family and bed and breakfast residences, one identification sign 886 not exceeding a total of three (3) square feet in area. 887 (2) For agricultural uses, one identification sign not exceeding a total of fifty (50) square 888 feet in area. 889 2. Area Identification Signs: Page 23 890 a. Purpose: Area identification signs are intended for the identification of residential 891 neighborhoods, subdivisions, and multiresidential complexes, and are also referred to as 892 monument signs and /or pylon signs. 893 b. Location: 894 (1) Area identification signs shall be located at the entrance to the project or subdivision. 895 (2) Area identification signs shall be located on private property and prohibited on public 896 rights of way. Area identification signs may be permitted in right of way upon city 897 council approval. 898 c. Number And Size: A maximum of two (2) area identification signs, not exceeding a total of 899 one hundred (100) square feet in sign area with no more than fifty (50) square feet per 900 sign, may be permitted at each project entrance or subdivision entrance. Two (2) signs 901 are permitted at each project entrance only to create a gateway effect at opposite corners 902 of the entrance to the project. 903 d. Height: The maximum height of an area identification sign shall be ten feet (10') 904 3. Temporary Signs: 905 a. Permitted Temporary Signs: 906 (1) One temporary sign for transient/seasonal merchant and produce merchant in the 907 agricultural districts is permitted. The sign shall not exceed thirty two (32) square feet 908 in sign area, nor exceed eight feet (8') in height. Such sign shall be erected only 909 during the period of transient/seasonal sale. (Ord. 747. 10 -15 -20031 910 911 9 -8 -11: SIGNS IN BUSINESS DISTRICTS: 912 A. B -1 Limited Business District: Business signs are specifically intended for use by allowed 913 commercial enterprises and are used to direct attention to the business, profession, commodity, 914 or service which is found on the premises where the sign is located. Signs shall be permitted in 915 the B -1 limited business district in accordance with the following minimum standards: 916 1. Permitted Sign Types: 917 a. One monument sign. 918 b. Flat wall sign(s). 919 2. Size: 920 a. Monument signs shall have a maximum copy and graphic area of thirty six (36) square 921 feet and a maximum monument area of two (2) times the potential copy and graphic area. 922 b. No combination of wall signs and monument signs shall exceed one hundred twenty (120) 923 square feet. Page 24 924 c. 1nr 0den4 -1 and informational signs shall not exceed four (4) square feet of surface area per 925 sign. 926 3. Height: No sign shall project above the highest outside wall of the building or twenty five feet 927 (25'), whichever is less. 928 4. Illumination: No illuminated sign which changes in either color or intensity of light shall be 929 permitted except one giving time and /or temperature. The granting of permits for illuminated 930 signs shall specify the hours during which the same may be lighted when necessary to 931 prevent the creation of a nuisance. All illuminated signs shall have a shielded light source and 932 conform to the provisions of subsection 9 -8 -5 C of this chapter. 933 B. B -2, B -3 And P -B Zoning Districts: Signs shall be permitted in the B -2 retail business district, B -3 934 general business district, and P -B planning business district in accordance with the following 935 standards: 936 1. Permitted Sign Types: Permitted sign types are the same as permitted in the B -1 limited 937 business district. Each property is permitted one freestanding sign, either a pylon or 938 monument sign. 939 2. Freestanding Signs: 940 a. Size of sign permitted is determined by the gross square footage of the principal structure 941 located in the development. 942 b. One sign per development unless a multitenant building or limited tenant building is eighty 943 thousand (80,000) gross square feet or more and has two (2) or more primary access 944 points. A second monument at a secondary access point is permitted if the primary 945 freestanding sign is of monument style. The second monument sign shall include a 946 shopping center identification message only and shall not exceed fifty percent (50 %) of 947 the copy and graphic area and height requirement of the permitted principal sign. 948 c. Incidental and informational signs shall not exceed four (4) square feet of surface area per 951 sign. 952 3. Wall Mounted Signs: 953 a. Multitenant Wall Signs: 954 (1) Each tenant is permitted tenant identification and one logo and shall not include 955 product advertising except as part of the tenant's trade name or logo. 956 (2) Tenant identification shall be individually mounted or located on a raceway that is 957 consistent in color with the designated sign background and internally illuminated 958 letters. Wall signs not containing individual letters may be approved by the city if all 959 signs are of a similar design and incorporated into the architecture of the principal 960 structure. 961 (3) Each tenant is permitted one logo which shall not exceed thirty six inches (36 ") high 962 by thirty six inches (36 ") wide. 963 (4) The vertical dimension of the tenant identification shall not exceed twenty six inches 964 (26 ") in height. Heights may be revised based on unique circumstances, such as 965 extraordinary distance from right of way or unusual building configuration, when 966 determined by the city council that signs would not be readable from adjacent public 967 right of way according to commonly accepted industry standards. 968 (5) Each tenant sign shall be installed within a twenty six inch (26 ") high designated 969 horizontal band. The band shall be of uniform background consisting of building 970 surface, facade, or treatment. The sign band and letter height may be modified upon 971 approval of the city council to allow for architectural integration of the tenant sign. 972 Consideration will be given to the proportional relationship of the sign width and height 973 to the scale of the building. 974 (6) Each tenant sign shall not extend closer than two feet (2') from the tenant's lease line. 975 (7) All letters in a tenant identification shall be of uniform colors, not to exceed two (2), 976 except for logos, which may be multicolored. A multicolored logo must comply with the 977 restrictions in subsection B3a(3) of this section. 978 (8) The city may recognize separate sign plans for multitenant buildings which will 979 supersede the ordinance. The sign plans which have been approved by the city 980 council will have the effect of a sign ordinance for the specific property. 981 b. Limited Tenant Wall Signs: Page 26 982 983 984 985 0 0. #11 991 992 993 994 995 996 999 1000 1001 1002 (1) Size of signage is determined by gross square footage of principal structure on property. Gas station canopies or other canopies are considered principal structures for computing allowable signage. (4) Wall signs shall not include product advertising. Wall signs may include tenant identification, tenant logo, shopping center name, shopping center logo, or any combination of the four (4). (5) The city may recognize separate sign plans for multi- tenant buildings which will supersede the ordinance. The sign plans which have been approved by the city council will have the effect of a sign ordinance for the specific property. 4. Height: No wall sign shall project above the highest outside wall of the building or twenty feet (20'), whichever is less. 5. Illumination: a. No illuminated sign which changes in either color or intensity of light shall be permitted except one giving time and /or temperature. b. The granting of permits for illuminated signs shall specify the hours during which the same may be lighted when necessary to prevent the creation of a nuisance. c. All illuminated signs shall have a shielded light source and conform to the provisions of subsection 9 -8 -5 C of this chapter. 1003 C. N -B Neighborhood Business District: 1004 1. Monument signs must be installed to denote the overall development project within the 1005 district. Page 27 1006 2. Monument sign sizes will be as regulated in subsection B2c of this section. 1007 3. Covenants must be recorded to ensure consistency of signage for all properties in the district. 1008 The covenants must identify permitted sizes, locations, and types of signage. Sign covenants 1009 will be based upon the sign regulations for the B -2 commercial district. 1010 4. Each tenant within the district is permitted one temporary sign for a period not to exceed thirty 1011 (30) days in a calendar year. (Ord. 747, 10 -15 -2003) 1012 9 -8 -12: SIGNS IN INDUSTRIAL DISTRICTS: 1013 1014 Within the 1 -1, 1 -2, 1 -3, and 1 -4 zoning districts, permanent signs which comply with the following 1015 standards are permitted: 1016 A. Monument Identification Sign: Any single- or multi- tenant building within an industrial zone is 1017 permitted one of the following freestanding identification signs that must comply with the listed 1018 standards: 1019 1. Building Identification Sign: 1020 a. One monument style sign; 1021 b. Sixty (60) square feet maximum copy and graphic area; 1022 c. Ninety (90) square feet maximum total monument size; 1023 d. Ten foot (10') maximum height; and 1024 e. Address and /or building identification displayed only; no product or service advertising is 1025 permitted. 1026 2. Tenant Identification Monument Sign: 1027 a. One monument sign; 1028 b. Sixty (60) square feet maximum copy and graphic area; 1029 c. Ninety (90) square feet maximum monument size; 1030 d. Ten foot (10') maximum height; 1031 e. Sign may display only identification of tenants; 1032 f. Tenant identification monuments are not permitted to be located along designated 1033 collector or arterial streets; 1034 g. Tenant identification monuments are not permitted in areas designated for mixed uses on 1035 the city comprehensive guide plan map or zoned P -B, planned business, on the city 1036 zoning map; and Page 28 1037 h. Individual tenant identification signs specified in subsection B of this section are not 1038 permitted. 1039 B. Individual Tenant Identification Signs: For multitenant buildings, one of the options listed in this 1040 subsection may be selected for tenant identification. All signs must comply with the listed 1041 standards. The building owner or a representative shall designate a sign design for each 1042 multitenant building. This designation will be recorded by the city and kept on record for the 1043 building. Each sign on the property must conform to the designated tenant identification sign 1044 option. Changes to the sign designation may be made upon request and approved 1045 administratively if all signs located on the site are brought into conformance with the requested 1046 sign plan modification. The planning commission must review sign plan changes if nonconforming 1047 signs are created. These signs are not permitted if the building's freestanding sign is a tenant 1048 identification freestanding sign. 1049 1. Option 1: Wall sign: 1050 a. One sign at the tenant's primary building entrance; 1051 b. Three foot by four foot (3'x 4') maximum dimension; 1052 c. Located adjacent to the tenant entrance; 1053 d. Eight foot (8') maximum from the ground to top edge of sign. 1054 e. Tenant identification message with no product advertising; and 1055 f. Uniform material, color, and style. 1056 2. Option 2: Individually mounted letters: 1057 a. Individually mounted letters not to exceed eighteen inches (18 ") in height with one per 1058 tenant at their primary entrance; 1059 b. Located within an eighteen inch (18 ") high designated sign band for the entire building; 1060 c. Affixed to a uniform background consisting of the building surface, facade, or treatment; 1061 d. Located no closer than two feet (2') from the tenant's exterior lease lines; 1062 e. Compatible with the building architecture; and 1063 f. Uniform material, color, illumination, and style. 1064 C. Single Tenant Identification Sign: Single tenant building signs within an industrial zone which 1065 comply with the following standards are permitted: 1066 1. Wall mounted individual letters; 1067 2. Wall signs shall not include product advertising. Wall signs shall include tenant identification; 1068 and Page 29 1069 3. Total surface area of all building signs shall not exceed five percent (5 %) of the building face 1070 upon which the signs are located up to a maximum one hundred fifty (150) square feet. 1071 D. Illumination: 1072 1. No illuminated sign which changes in either color or intensity of light shall be permitted except 1073 one giving time and /or temperature. 1074 2. The granting of permits for illuminated signs shall specify the hours during which the same 1075 may be lighted when necessary to prevent the creation of a nuisance. 1076 3. All illuminated signs shall have a shielded light source and conform to the provisions of 1077 subsection 9 -8 -5 C of this chapter. (Ord. 747, 10 -15 -2003) 1078 9-8-13: INSPECTIONS: 1079 1080 All signs for which a permit is required shall be subject to inspection by the director of community 1081 development. The director of community development, or any other official of the city who may be 1082 appointed by him /her, is hereby authorized to enter upon any property or premises to ascertain whether 1083 the provisions of this chapter are being obeyed. Such entrance shall be made during business hours 1084 unless an emergency exists. The director may order the removal of any sign that is not maintained in 1085 accordance with the maintenance provisions of this chapter. (Ord. 747, 10 -15 -2003) 1086 9 -8 -14: VARIANCES: 1087 1088 A. Conditions Of Variances: Where there are practical difficulties or unnecessary hardships in 1089 any way in carrying out the strict letter of the provisions of this chapter, a variance may be 1090 granted; provided, that all the following conditions are true: 1091 1. The particular physical surroundings, shape or topographical conditions of the specific 1092 parcel of land involved cause a particular hardship to the owner, as distinguished from a 1093 mere inconvenience, if the strict letter of the regulations were to be carried out. 1094 2. The conditions upon which a petition for a variation is based are unique to the parcel of 1095 land for which the variance is sought and not generally applicable to other property within 1096 the same zoning classification. 1097 3. The alleged difficulty or hardship must be caused by this chapter and not by any person 1098 presently having an interest in the parcel of land. 1099 4. The granting of the variance will not be detrimental to the public welfare or injurious to 1100 other land or improvements in the neighborhood in which the parcel of land is located. 1101 5. The proposed variance will not impair an adequate supply of light and air to adjacent 1102 properties, will not increase the congestion of the public streets, will not endanger the public 1103 safety or will not diminish or impair property value within the neighborhood. 1104 B. Request For Variance; Fee: A person desiring to secure a variance or to appeal the 1105 interpretation and application of any provisions of this chapter by the director of community Page 30 1106 development shall fill out and submit to the director of community development a variance 1107 form together with the required filing fee. (Ord. 747, 10 -15 -2003) 1108 9 -8 -15: ENFORCEMENT: 1109 A. Violations: Any person violating any provision of this chapter shall be guilty of a misdemeanor. 1110 Each day that a violation continues to exist shall constitute a separate offense. (Ord. 747, 10- 1111 15 -2003) 1112 B. Removal Of Illegal Signs; Costs: Any sign installed or placed on public property, except in 1113 accordance with the requirements of this chapter, is subject to removal. Signs may be 1114 returned to the owner upon request, but the owner shall pay a fee in such amount as provided 1115 by ordinance of the city council from time to time. Signs not retrieved by the owner within 1116 fourteen (14) days of removal may not be returned. (Ord. 783, 2 -15 -2006) Page 31
