HomeMy WebLinkAbout2014-09-22 PACKET 06.2.Planning Staff Report Planning Case CUP14 -022 November 28, 2011 Proposal Velocitel (representing AT &T Mobility) has applied for an amendment to their conditional use permit to replace and add antennas to an existing monopole tower. The project does not change the tower's height or any of the existing equipment shelters. The three new antennas will be mounted at the 87 -foot elevation of the 120 -foot high monopole. The size of the new antennas will be similar to the width and height of the existing six antennas. The existing monopole is located on property at 10475 Kimbro Avenue, owned by Jerome and Helen Goulet. Location Map Background The existing 120 -foot monopole and the first equipment building were constructed on this property in July 1998. Sprint Spectrum was the communication company that initiated the construction of the monopole and equipment building. Nextel Communications co- located their antennas and con- structed their equipment building in 2004. In 2011, AT &T co- located their six antennas on the exist- ing monopole and constructed a 12 -foot by 28 -foot equipment building. Planning Staff Report Planning Case No. CUP2014 -028 September 22. 2014 Page 2 of 5 City Resolution No. 2011 -154, which approved AT &T's conditional use permit, will need to be amended since three more antennas are proposed to be added to this communication tower. Planning Considerations Zoning Ordinance Criteria The Electro Magnetic Communications Facilities (EMCF) ordinance allows freestanding anten- nas in agriculturally zoned property by conditional use permit. This existing monopole was origi- nally approved by the City on March 18, 1998. Approval of AT &T's conditional use permit was subject to the provisions of the Zoning Ordinance and the conditions stipulated in City Resolution No. 2011 -154. Property Characteristics A private access drive for the Goulet's farmstead extends east of Kimbro Avenue, past the house and machine shed. There is a windbreak of trees along the north side of the private drive and ex- tends to the entrance of the machine shed. The rest of the property north and east of the farm- stead is Goulet's farmland. An aerial photo of this area is shown below. Aerial Photo The existing monopole and equipment building is located on the northeast side of the windbreak. The monopole was designed to accommodate more than one antenna array. The monopole and its foundation were designed to account for soil conditions and local wind loading guidelines. The original leased area for the monopole and equipment building is a 50 -foot by 50 -foot area. The lease area proposed by previous conditional use permit approvals required the leasable area to Planning Staff Report Planning Case No. CUP2014 -028 September 22, 2014 Page 3 of 5 be enlarged to accommodate the third user. A security fence eight feet in height surrounds the area that is leased by the various tenants. The original installer of the monopole mounted their antennas at the top of the pole. The second wireless communication carrier mounted their an- tennas at the 100 -foot elevation. AT& T mounted their antennas at the 85 -foot elevation. An illustration of the vertical elevation for the monopole and photos of the existing equipment buildings are shown below. All buildings are constructed of an aggregate- exposed concrete block material. Housed inside the equipment buildings are electrical and telephone lines used in transmitting and receiving equipment for wireless communication systems. Minor modifications will be made inside AT &T's equipment building to accommodate the pro- posed infrastructure changes. Landscaping Landscaping exists around the lease area and the proposed improvements will not require addi- tional landscaping. The property owner does not want trees planted on the north or east sides of the monopole site because the trees would encroach into the property owner's tillable acreage. City Department and Advisory Commission Comments This application was distributed to other city departments for comment. The only responses re- ceived were from the Engineering Department and Building Division. Neither expressed any concerns for this application. Public Hearing Notices The public hearing notice was mailed to 14 property owners who are within 500 feet of the pro- posed monopole site on the Goulet's property and published in the South Washington County Bulletin on September 10, 2014. Recommendation Planning staff recommends approval to amend City Resolution No. 2011 -154, which granted ap- proval for the installation of six antennas on the existing monopole and the construction of a 12- foot by 28 -foot equipment building at 10475 Kimbro Avenue South, to replace existing antennas and add three additional antennas for a total of nine antennas on the existing monopole, subject to the following conditions: 1. The applicant must complete a building permit application for the replacement of six existing antennas and the installation of the three additional antennas and other related tower mounted equipment and cables. 2. All applicable electrical and building permits must be obtained prior to commencement of construction. 3. No advertising shall be displayed on the monopole, antenna panels, equipment building, or fence. 4. The antennas must be painted the same color as the tower.
