HomeMy WebLinkAbout2014-10-01 MINUTES COTTAGE GROVE CITY COUNCIL City of Cottage Grove, Minnesota Regular Meeting October 1, 2014 OPEN FORUM At 7:15 p.m., Mayor Myron Bailey opened Open Forum and stated that during Open Forum a person may address the City Council on any subject not on the regular meeting agenda, but must limit their remarks to three minutes per person. The purpose of Open Forum is to give the public an opportunity to present information or to request action by the City Council. It may not be used to make personal attacks, to air personality grievances, to make political endorsements, or for political campaign purposes. Open Forum will adjourn to the Regular meeting at 7:30 p.m. The following were present: Council Member Justin Olsen, Council Member Jen Peterson, Council Member Dave Thiede, and Mayor Myron Bailey. The following were absent: Council Member Lehrke. Also present were: Ryan Schroeder, City Administrator; Caron Stransky, City Clerk; Robin Roland, Finance Director; Korine Land, City Attorney-LeVander, Gillen & Miller, PA; Jennifer Levitt, City Engineer; Craig Woolery, Public Safety Director; and Les Burshten, Public Works Director. Mayor Bailey asked if anyone in the audience wished to address the City Council on any topic not on the agenda. There being none, Mayor Bailey closed Open Forum to the Regular Meeting. – CALL TO ORDER Regular Meeting The City Council of the City of Cottage Grove, Washington County, Minnesota, held a Regular Meeting on October 1, 2014 at the Cottage Grove City Hall, 12800 Ravine Parkway. Mayor Bailey called the meeting to order at 7:30 p.m. PLEDGE OF ALLEGIANCE The audience, staff, and the Mayor and Council Members pledged allegiance to the flag of the United States of America. ROLL CALL The following were present: Council Member Derrick Lehrke, Council Member Justin Olsen, Council Member Jen Peterson, Council Member Dave Thiede, and Mayor Myron Bailey. Cottage Grove City Council 2 October 1, 2014 Regular Meeting The following were absent: None. Also present were: Ryan Schroeder, City Administrator; Caron Stransky, City Clerk; Robin Roland, Finance Director; Korine Land, City Attorney-LeVander, Gillen & Miller, PA; Jennifer Levitt, City Engineer; Craig Woolery, Public Safety Director; and Les Burshten, Public Works Director. Mayor Bailey presided over the meeting. 1. ADOPTION OF AGENDA Motion by Council Member Olsen, seconded by Council Member Thiede, to approve the agenda as presented. Motion carried. 5-0. 2. PRESENTATIONS – A. Swearing In Ceremony Police Officers The City Administrator, in the presence of the Mayor, Council Members, and Staff, administered the oath of office to Justin Henseler, Ryan Pierre, Jeffrey s Rydeen, and Jonathan Strehlo as Police Officer for the City of Cottage Grove. 3. APPROVAL OF MINUTES A. September 17, 2014 Regular Meeting. Mayor Bailey accepted the minutes of the September 17, 2014 Regular meeting as presented. 4. CONSENT CALENDAR The Council pulled and briefly discussed item D. Motion by Council Member Thiede, seconded by Council Member Peterson, to: A.Accept and place on file the following minutes: i.Planning Commission meeting from August 25, 2014. st B.Approve Amendment No. 1 to the water tower site lease at 81 Street and Innsdale Avenue with Sprint. C.Approve the appointment of Dan Harrison to the Parks, Recreation, and Natural Resources Commission effective October 1, 2014 to fill the vacancy ’ from Commissioner Rediskes resignation. Cottage Grove City Council 3 October 1, 2014 Regular Meeting D.Adopt Resolution No. 2014-089, a resolution approving the appointment of election judges for the November 4, 2014 General Election. E.Pass Ordinance No. 935, an ordinance amending fees for the Ice Arena and authorize publication of a summary. F.Adopt Resolution No. 2014-090, a resolution granting the application of th Anthony Rudh, 8217 113 Street South, Cottage Grove, for a variance to allow an in-ground pool to be setback 39 feet from the bluff line when 100 feet is required. Adopt Resolution No. 2014-091, a resolution granting the application of th Anthony Rudh, 8217 113 Street South, Cottage Grove, for a variance to allow an existing septic system to be setback 19 feet from the bluff line when 150 feet is required. ’ G.Approve the letter stating the Citys official response to the Metropolitan ’ Councils 2040 Regional Parks Policy Plan provided in conjunction with the Thrive MSP 2040 planning process. MOTION CARRIED.5-0. – 5. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES None. 6. PUBLIC HEARINGS A.Conduct Public Hearing Considering the Assessment for the Removal of Weeds on Private Property Finance Director Roland requested that the Council hold a public hearing and adopt a resolution adopting service charges for the removal of noxious weeds and plants from private property. She noted that in 14 instances the City had to abate the nuisances and are now assessing the property owner for the cost. Mayor opened the public hearing to hear comments from those in attendance. There being none, Mayor Bailey closed the public hearing. Motion by Council Member Olsen, seconded by Council Member Thiede, to adopt Resolution No. 2014-092, a resolution adopting service charges for the removal of noxious weeds and plants from private property. Motion carried. 5-0. B.Conduct Public Hearing Considering the Assessment at Properties for the Removal of Public Safety Hazards Cottage Grove City Council 4 October 1, 2014 Regular Meeting Finance Director Roland requested that the Council hold a public hearing and adopt a resolution adopting service charges for the removal or elimination of public safety hazards from private property. She noted that in three instances the City had to abate the nuisances and are now assessing the property owner for the cost. Mayor opened the public hearing to hear comments from those in attendance. There being none, Mayor Bailey closed the public hearing. Motion by Council Member Olsen, seconded by Council Member Thiede, to adopt Resolution No. 2014-093, a resolution adopting service charges for the removal or elimination of public safety hazards from private property. Motion carried. 5-0. C.Hold a Hearing to Consider Approving the Special Event Permit Application for the Monster Bash Parade to be held on October 25, 2014. Mayor Bailey opened the hearing to hear comments from those in attendance. There being none, Mayor Bailey closed the hearing. Motion by Council Member Thiede, seconded by Council Member Peterson, to approve the special event permit application of the Cottage Grove “” Strawberry Fest Inc., for their annual Monster Bash parade to be held on Saturday, October 25, 2014, contingent upon compliance with the conditions outlined in the staff report. Motion carried. 5-0. D.Hold a Hearing to Consider Approving the Special Event Permit Application for a 5K Walk/Run to be Held on October 4, 2014. Mayor Bailey opened the hearing to hear comments from those in attendance. There being none, Mayor Bailey closed the hearing. Motion by Council Member Peterson, seconded by Council Member Lehrke, to approve the special event permit application of Meghan Kuemmel for a 5K Walk/Run on October 4, 2014 contingent on compliance with the conditions outlined in the staff report. Motion carried. 5-0. E.Hold the Public Hearing for the 2014 Pavement Management Project and Consider Adopting the Assessment Roll. City Engineer Burfeind gave a presentation on the project, recommended that the Council hold the public hearing and to adopt the assessment roll. Mayor Bailey opened the public hearing to hear comments from those in attendance. There being none, Mayor Bailey closed the public hearing. Cottage Grove City Council 5 October 1, 2014 Regular Meeting Motion by Council Member Olsen, seconded by Council Member Thiede, to adopt Resolution No. 2014-094, a resolution adopting assessments for the 2014 Pavement Management (District F-1 & F-4) improvement project. Motion carried. 5-0. – 7. BID AWARDS None. – 8. UNFINISHED AND NEW BUSINESS None. 9. RESPONSE TO PREVIOUSLY RAISED COUNCIL COMMENTS AND REQUESTS – None. 10. COUNCIL COMMENTS AND REQUESTS Council Member Peterson announced that the next Fare for All is October 9 and that October is Domestic Violence Awareness Month. Council Member Olsen noted that Park High School is celebrating their 100-year anniversary and invited everyone to attend the festivities. He also congratulated Council Member Lehrke on the arrival of their child. Motion by Council Member Olsen, seconded by Council Member Lehrke, to request the Community Development Department to re-evaluate the Code Enforcement procedures on the abatement of nuisance violations. Motion carried. 5-0. Council Member Thiede announced that the Monster Bash events are on October 25 and he encouraged the public to participate. Additional information on the events can ’ be found on the Cottage Grove Strawberry Fests website. “” Mayor Bailey announced that the Chamber of Commerce Oktoberfest is on ’ November 5, the Fire Departments annual open house is on October 11, and the Holiday Train will stop in Cottage Grove on December 10. ’’ Mayor Bailey commented that during the League of Women Voters candidates ’ forum, one of the candidates gave false information on the City subsidizing a couple of local businesses. 11. PAY BILLS Motion by Council Member Thiede, seconded by Council Member Olsen, to approve payment of check numbers 187895 to 188113 in the amount of $855,764.71 and EFT payment of $164,052.56.
