During Open Forum, a person may address the City Council on any subject not on the regular meeting agenda, but must limit their remarks to three minutes per person. The purpose of Open Forum is to give the public an opportunity to present information or to request action by the City Council. It may not be used to make personal attacks, to air personality grievances, to make political endorsements, or for political campaign purposes. Open Forum will adjourn to the regular meeting at 7:30 p.m. The following were present: Council Member Steve Dennis, Council Member Justin Olsen, Council Member Jen Peterson, Council Member Dave Thiede, and Mayor Myron Bailey. The following were absent: None. Also present were: Ryan Schroeder, City Administrator; Caron M. Stransky, City Clerk; Robin Roland, Finance Director; Korine Land, City Attorney-LeVander, Gillen & Miller, PA; Craig Woolery, Public Safety Director; Les Burshten, Public Works Director and Jennifer Levitt, City Engineer. Mayor Bailey asked if anyone in the audience wished to address the City Council on any topic not on the agenda. John Myers, 10990 Manning Avenue South, Cottage Grove, addressed the Council regarding the placement of controversial items such as land uses, variances, etc., on the consent calendar. He felt that Council Member Peterson should recuse herself from voting on the Bushilla variance because she has had fundraisers on the property. Mr. Myers stated that there should always be some discussion by the Council on variance requests. Tonight there are two variance requests on the agenda. One is to build a tree house structure 3.6 feet from the rear property line (Bushilla) and another is for a variance on a 60-foot minimum lot width on a five-acre site on Keats Avenue (Kingston Grove). Mayor Bailey closed Open Forum to the Regular Meeting. CALL TO ORDER — Mayor The City Council of the City of Cottage Grove, Washington County, Minnesota, held a regular meeting on January 21, 2015, at the Cottage Grove City Hall, 12800 Ravine Parkway. Mayor Bailey called the meeting to order at 7:30 p.m. PLEDGE OF ALLEGIANCE The audience, staff, and the Mayor and City Council Members pledged allegiance to the flag of the United States of America and the State of Minnesota. ROLL CALL — City Clerk The following were present: Council Member Steve Dennis, Council Member Justin Olsen, Council Member Jen Peterson, Council Member Dave Thiede, and Mayor Myron Bailey. Mayor Bailey presided over the meeting. 1. ADOPTION OF AGENDA Motion by Council Member Olsen, seconded by Council Member Thiede, to approve the agenda as presented. Motion carried 5-0. 2. PRESENTATIONS A. Washington County Commissioner Karla Biqham. Washington County Commissioner Bigham thanked the Council for allowing her time to address the Council this evening. She stated that she wanted to inform the Council that she was willing to work with them on any issue that the County can provide assistance on, and that she looks forward to having a strong working relationship. A few projects mentioned were the improvements to 70t" Street, Ravine Park, and the Red Rock Corridor. January 21, 2015 Cottage Grove City Council Page 3 3. APPROVAL OF MINUTES A. November 5, 2014 Reqular Meetinq. Mayor Bailey and members of the City Council approved the minutes as presented. B. November 12, 2014 Special Meetinq. Mayor Bailey and members of the City Council approved the minutes as presented. C. November 19, 2014 Reqular Meeting_ Mayor Bailey and members of the City Council approved the minutes as presented. 4. CONSENT CALENDAR The Council pulled the following items from the consent calendar: B and E. Council Member Olsen pulled item E for a separate vote. Item B was pulled to recognize the donations received in the fourth quarter of 2014. Motion by Council Member Dennis, seconded by Council Member Peterson, to: A. Accept and place on file the following minutes: i. Advisory Committee on Historic Preservation minutes from the October 28, 2014 meeting. ii. Environmental Commission minutes from the September 10, October 8, and the November 12, 2014 meetings. B. Adopt Resolution No. 2015-003, a resolution recognizing donations received in the fourth quarter of 2014. � C. Adopt Resolution No. 2015-004, a resolution approving updates to the AWAIR Safety Policy and Right-to-Know Policy. D. Adopt Resolution No. 2015-005, a resolution approving an amendment to an existing Conditional Use Permit to mount three additional antennas, relocate existing antennas, and install six smaller pieces of equipment on top of the City's 3.0 MG Water Reservoir at 8520 81St Street South, Cottage Grove. E. Removed from Consent Calendar. January 21, 2015 Cottage Grove City Council Page 4 F. Receive information on a Draft Air Permit for Flint Hills Resources Pine Bend Refinery. G. Approve the request on assigning the rights under a Solar Power Purchase Agreement (PPA) from Adolfson & Peterson Construction to New Equities Energy contingent upon approval of the City Attorney. Motion Carried 5-0. E. Adopt a resolution qrantinq a variance to allow a treehouse structure to be 3.6 feet from the rear property line when 50 feet is required at Hope Glen Farm, 10276 East Point Douqlas Road South, Cottaqe Grove Motion by Council Member Olsen, seconded by Council Member Dennis, to adopt Resolution No. 2015-006, a resolution granting a variance to allow a tree house structure to be 3.6 feet from the rear property line when 50 feet is required at Hope Glen Farm, 10276 East Point Douglas Road, Cottage Grove. Motion carried. 4-0-1 with Council Member Peterson abstaining due to a concern raised during Open Forum. 5. RESPONSE TO PREVIOUSLY RAISED OPEN FORUM ISSUES — None. 6. PUBLIC HEARINGS — None. 7. BID AWARDS — None. 8. UNFINISHED AND NEW BUSINESS A. Consider adoptinq a resolution approving a variance to reduce the 60-foot minimum lot width requirement for lots on the cul-de-sac to be not less than 49.5 feet and approvinq the preliminary plat for the development of a 12-lot residential subdivision named Kinqston Grove. Senior Planner McCool summarized the application of Mason Development for a variance and preliminary plat for a 12-lot subdivision named Kingston Grove. ' The applicant, Mark Mason of Mason Development, addressed the Council stating that they are not going to build the homes. They have some builders interested including one who is interested in buying and building on the entire development. John Myers, 10990 Manning Avenue South, Cottage Grove, spoke in opposition to the need for a variance. January 21, 2015 Cottage Grove City Council Page 5 Motion by Council Member Olsen, Seconded by Council Member Peterson, to adopt Resolution No. 2015-007, a resolution approving the preliminary plat named Kingston Grove and a variance to the minimum lot width requirement. The Council discussed the Planning Commission's recommendation to name the street Jorgensen Alcove South. Council Member Olsen amended his motion to approve the understanding that he would like to use a unique suffix for that particular cul-de-sac, the street name Jorgenson is acceptable but if you can find a unique suffix versus Alcove that would be his preference. Council Member Peterson agreed with the amendment. Upon vote being taken on the motion as amended, motion carried. 5-0. B. Consider passing an ordinance rescinding and replacing City Code Title 9, Chapter 8, Siqns, in its entiretV. McCool summarized the proposed sign ordinance and highlighted the following modifications: • Signs not requiring a building permit • Outdoor business signs • Real estate signs • Temporary banner signs • Bus bench signs • Off-Premise Signs • Potential civic garden site (future action) • Monument and pylon sign size regulations • Wall sign area • Window sign area • Temporary sign permits — Business districts • Temporary sign permits — Residential • Sign information sign • Community opportunities The Planning Commission recommended approval of the proposed ordinance. Motion by Council Member Olsen, seconded by Council Member Dennis, to pass Ordinance No. 938, an ordinance for the City of Cottage Grove, Minnesota, amending Title 9, Chapter 8 of the Cottage Grove City Code January 21, 2015 Cottage Grove City Council Page 6 relating to signs, amending the ordinance to allow signs for 40 percent of total window area. Motion carried 5-0. 9. RESPONSE TO PREVIOUSLY RAISED COUNCIL COMMENTS AND REQUESTS 10. COUNCIL COMMENTS AND REQUESTS Council Member Peterson announced the upcoming Fare for All and reminded people to shovel snow from around fire hydrants. Council Member Thiede announced that the 2015 Cottage Grove Strawberry Fest would be held on June 18-21. For additional information, go to their website at www.cottaqeqrovestrawberr ryfest.com. Mayor Bailey announced that the Skate Night is January 30 and the Friday Night Fish Fry at River Oaks has begun. The Washington County Swat Team was called out last week and the City received a letter from a family member for taking the route that they did and no one was hurt. 11. PAY BILLS A. Approve Payment of Check Numbers 189511 to 189639 in the amount of $465,882.01 and EFT Payment of $18,687.31. Motion by Council Member Olsen, seconded by Council Member Thiede, to approve payment of check numbers 189511 to 189639 in the amount of $465,882.01 and EFT Payment of $18,687.31.
